Dear Mayor Cohen:
Re: 799 Englewood Avenue - Our File No. R 72-0025,
Subd. 13
On October 27, 1971, the City Council awarded the sum of
$70.00 for damages caused to the above property in the con-
struction of Avon Street. Upon completion of this work and
construction of new sidewalk along their property, the owner,
Leland E. Bruss and Lois A. Bruss, notified our office that
the award was insufficient for the following reasonss tl�,�
City sidewalk was incorrectly constructed so as to be located
on their land to the extent of one foot off the City' � right-
of-way, the necessity of relocating their chain link fence,
and damages to their garage in the nature of their having
to raise the garage 16" from its original location because
the new sidewalk grade anade it impossible for them to drive
in and out of the garage.
This matter haa been inve�tigated by the Bureau of Valuations,
and our investigator, and it is my opinion that the City has
in fact cau�ed additional damage not contemplated at the time
the City Council made its original award of $70.00. Also,
because of the sidewalk being located on private property, it is
necessary to acquire the additional on� foot. I have discussed
this matter with Mr. Bruss, and he has agreed to accept the
sum of $950.00 for the City' s taking of his property and
damages to his garage and fence.
I have prepared a resolution authorizing payment of the new sum
of $950.00 in lieu of the $70.00 award and request that you
approve the same and transmit it to the City Council. If you
have any questions, please contact me.
