Please take notice that a hearing concerning the above-named establishment has been
scheduled for 5:30 p.m., Wednesday, June 5, 2002 in the City Council Chambers, Third Floor,
Saint Paul City Hall and Ramsey County Courthouse.
Enciosed are copies of the proposed resolution and other documents which will be
presented to the City Council for their consideration. This is an uncontested hearing, in that the
facts conceming the sale of cigarettes to an underage person have not been disputed. You will
have an opportuuity at the Council hearing to present oral and/or written remarks as to the

Dear Mr. Abdelhamid:
The Office of License, Inspections and Environmental Protection has recommended
adverse action against the Cigarette/T'obacco License held by Hussein Abdelhamid, cilb(a Rice
Street Grocery for the premises at 873 Rice Street in Saint Paul. The basis for the
recommendation is as follows:
On February 13, 20Q2, a tobacco compliance check was
conducted at Rice Street Grocery located at 873 Rice Street in
Saint Paul. A seventeen year old female entered the store and
asked to buy cigarettes. She was asked to show her
identification, and did so. It correctly stated her date of birth.
The clerk nevertheless sold her a package of Camel Lights
cigarettes. Sale of tobacco to an underage person is a violation
of Minn. Stat. §609.685 and Saint Paul Legislative Code
§324.07.
Since this is a third violation, the licensing office will recommend a 30 day suspension of your
Cigarette/Tobacco license.

At this time you have three options on how to proceed:

If you do not dispute the above facts and do not wish to have a public hearing, you will
need to contact the licensing office to arrange for the suspension of your
Cigarette/Tobacco license. The licensing office can be reached by writing to: Office of
License, Inspections and Environmental Protection, Room 300 I,owry Professional
Building, 350 Saint Peter Street, Saint Paul, Minnesota 55102. The letter should be
directed to Ms. Christine Rozek. Scheduling of the suspension will be considered to be a
waiver of the hearing to which you are entitied.
2. Alternatively, if you do not dispute the above facts, but wish to have a public hearing
before the Saint Paul City Councii, you will need to send me a letter with a statement
admitting the violation and requesting a public hearing. We will need to receive your
letter by Monday, May 6, 2002. The matter will then be scheduled before the City
Council for a public hearing to determine what penalty, if any, to impose. You will have
an opportunity to appear before the Council and make a statement on your own behaif.
3. If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appear and present
witnesses, evidence and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. If this is your choice, please advise my legal assistant,
Peter Pangborn, and we will take the necessary steps to schedule the administrative
hearing. He can be reached at 266-8710.
If we have not heard from you by Monday, May 6, 2002, we will assume that you do
not contest the facts and will schedule this matter for the St. Paul City Council and have if
placed on the Consent Agenda during which no public discussion is allowed and the
recommended peQalty will be imposed.
Please be advised that as the clerk who was identified as having made the sale on this
date, you will also be charged an administrative penalty pursuant to Minn. Stat. §461.12, subd. 3.
This is a separate action from this license matter and you will receive separate correspondence
related to the administrative fine.

To whom it may concern:
This Letter is for an appeal for the suspension of
the cigarette license at my store. I had call
before when I received my first and second fine
and asked if I receive a third fine in the future
will have an affect on my license The person
that I spoke with, said that each year you renew
your cigarette license that it shouldn't have an
affect and that I`m ok. I did receive a third
penalty for selling to minor cigarette. It was
honest mistake not purposely intended to
happen. My income comes from the candy,
pop and mostly cigarettes sale in my very small
store. I not deining that I did not sell cigrette to
a minor; I know I did. I did read the birth date
wrong, because I use eyeglasses or a magnifying
glass to see the little writing at that time I did not

use my glass because I could not find them to
read the date of birth on the ID. I'm very
careful when I'm selling if there is a lesser
approach to this I will be mostly grateful thank
you.
