0088646), located at 1724 University Avenue West in Saint Paul is hereby ordered to pay a fine
of $500.00 for the violation of Sale of Alcoholic Beverages to Underage Persons.
Said fine shall be paid to the Office of License, Inspections and Environmental Protection
within thiriy (30) days of the adoption of this resolution by the Council and signature by the
Mayor.
This resolurion and the action of the Council in this matter are based upon the facts
contained in the Apri122, 2002 Notice of Violation letter to the licensee, Police Report CN 02-
058-376, the March 25, 2002 Liquor Compliance Check Sheet, and such arguments as were
made at the time of the public hearing. The licensee did not contest the facts of the violation.

for the premises located at 1724 University Avenue West in Saint Paul
License ID #: 0088646
Dear Sir/Madam:
The Office of License Inspections and Envirorunental Protection has recommended
adverse action against the licenses held by Little Grocery d/b/a Little Grocery for the premises
located at 1724 University Avenue West in Saint Paul. The basis for the recommendation is as
follows:
On March 25, 2002, an alcohol compliance check was
conducted at the premises of the Little Grocery located at 1724
University Avenue West in Saint Paul. A 19-year old male
entered the premises and purchased a 6-pack of Budfveiser
beer. The clerk rang up the sale and took the money without
asking his age or asking for identification. Sale of alcohol to an
underage person is a violation of Minn. Stat. §340A.503.
Since this is considered a first violation, the licensing office will recommend a$500.00
fine, pursuant to St. Paul Legislative Code §409.26.

At this time you have three options on how to proceed:

If you do not dispute the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental
Protection, Room 300 I.owry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you are entitled. A self-
addressed envelope is enclosed if this is your choice.
2. Altematively, if you do not dispute the above facts, but wish to have a public hearing
before the Saint Paul City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearing by Friday, May 3, 2002. The matter wiil
then be scheduled before the City Council for a public hearing to determine what penalty,
if any, to impose. You will have an opportunity to appear before the Council and make a
statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Friday, May
3, 2002, how you wish to proceed.
If you have not contacted me by Friday, May 3, 2002, I will assume that you are not
contesting the facts and will schedule this matter for the St. Paul City Council and have it
placed on the Consent Agenda during which no public discussion is allowed and the
recommended penalty will be imposed.

The Little Grocery failed a liquor compiiance check
NARRATIVE
I, Secgeant Ranutad, am a memher of the VIce Unit. The Vice Unit is conducting liquor
compliance checks on all licensed establishments in St. Paul.
On 3/25/2002, I, along with OfFicer Namen, conducted checks using an under age checker.
The checker was Checker 11-02. He has a verified DOB of 1/24/1983 making him 19 yeazs of age.
The checker has received training on how a check should be conducted. He was told that he
could not lie about his age or birth date during the checks. I took all of his personai property so
he would be unable to show identification or use his own money. I provided him with buy
money to use in any purchases.
I placed a transmitter and microphone on him so I could monitor his conversations during his
checks. This was done so I could detemune if the check was done properly.
At about 1814 hours I directed him into the Little Grocery at 1724 University Avenue West. Ae went
in and grabbed a 6 pack of Budweiser Beer Cans. He brought them to the counter. The clerk rang
them up. THe checker paid for [he beer with the buy money we had provided. The clerk gave the
checker his change and the checker lefr the store with the beer.
I waited outside and the checker gave me the beer and the change. I retumed to the store and
spoke with the clerk. He identified himself as CONTRERAS, CHRISTOPHER HENRY WlM, DOB:
OS/12/1970 with a MN Picture ID cazd. He admitted that he sold the beer to the checker without
asking about his age. He told me he thought the checker was 2� years old. I told Contreras that he
was the 23rd place we had checked that night and the first 22 carded the checker.
I took a picture of the beer and the change. It was retumed to Contreras and he retumed my but
money out of the register.
I informed him that the store would be contacted by LIEP about the liquor license. I told him that the
case would be su6mitted to the city attorney's office for cciminal chazges.
