1 WHEREAS, the Parks and Recreation Division is the owner of property located northwesteriy of the
2 intersection of Iohnson Parkway and Phalen Boulevazd in Saint Paul, Minnesota, and described as:

4 That part of Lots I S and 16, Block 3, Kiefer-Park, Zying northeasterly of a line described as
5 follows: Commencing at the northwest corner of said Lot I5; thence on an assumed bearing of
6 South 00 degrees I2 minutes 12 seconds East along the west line of said Lot I S a distance of
7 22.69 feet to the point of beginning of said line to be described, thence South 41 degrees 26
g minutes 21 seconds East to the east line of said Lot 16 and there terminating; and

10 WHEREAS, said property was originally acquired by the City of Saint Paul ("City") for park purposes
11 for Johnson Parkway; and
WHEREAS, the Parks and Recreation Division wishes to dispose of said property as it is not necessary
for use and enjoyment of Johnson Parkway and is desired by the adjacent property owner to become part
of a 59-unit senior housing development; and
WHEREAS, Chapter 13 of the Saint Paul City Charter requires that land acquired for park purposes
cannot be diverted to other uses or disposed of except in accordance with the provisions of Chapter
13.01.1; and
WHEREAS, in accordance with that chapter, the Saint Paul Parks Commission has reviewed the
proposed disposal of the property and has recommended that the Ciry Council approve such disposal;
and further, that an appraisal of said parks property has been performed by a qualified independent
appraiser and an appraised market value of the property has been determined; and
WHEREAS, the City Council finds that the disposal of the property is in the best interests of the public
as the property is not currently open to the public as a park and there are no such plans for such use in
the future; and
WHEREAS, in accordance with Chapter 51 of the Saint Paul Administrative Code, the Saint Paul
Housing and Redevelopment Authority ("HRA") has submitted to the City a proposal to exchange said
pazks property with an HRA-owned parcel determined by the City's Valuation & Assessment Engineer
to be of equal value to the parks property, said HRA parcel being located within the Upper Landing Park

1 and described as: the Easterly 18 feet of Lot 8 and all of Lot 9, Block 46, Rice and Irvines Addition, Saint
2 Paul Minnesota; now, therefore be it
4 RESOLVED, that the Saint Paui City Council hereby accepts the HRA's proposal and authorizes the
5 disposal of said parks property to the HRA; and be it further

7 RESOLVED, that the Pazks and Recreauon Division is authorized to accept the HRA parcel, and that
8 said HRA-owned parcel shall be considered to be the replacement pazk land required by the City
9 Charter; and be it further

11 RESOLVED, that the Real Estate Division is hereby authorized to convey the Utle to the pazks property
12 through warranty deed or quit claim deed upon final transfer of the HRA-owned property to the City
13 without need for further council resolution; and be it finally
14
15 RESOLVED, that the HRA shall reimburse the City $900.00 for the required appraisal of the pazks
16 property within 60 days of the effective date of this resolution.

e City of Saint Paul has determined there is no longer a public purpose for owning and maintaining an
xcess portion of Johnson Parkway right of way. The City wishes to vacate its rights and interests in this
roperty and convey the property to the Housing and Redevelopment Authority (HRA) for use in a senior
ousing development project Because this property is parKland, the City Charter requires a review and
ecommendation of the St Paul Parks Commission (see attached), with approval by the City Council, before
e ro ert ma be conve ed to the HRA.

WHEREAS, the HR.A by its Resolution 02-3/13 has agreed to convey a pazcel of HRA
property at the Upper Landing site to the City of Saint Paul, Division of Parks and Recreation for
inclusion in the new Ugpet I.anding Park, said pazcel described as:
"The Easterly 18 feet of Lot 8 and ail of Lot 9, Btock 46, Rice and Irvincs Addition"; and
WHEREAS, �he City and the HRA, in acknowledgment of the mutually beneficial result
of conveying said properties as described herein, wish to convey thcir respective properties to the
oth�r pazry at no cost;
NOW, THEREFORE, BE IT RESOLVED, tb.at the Saint Paul Parks and Recreation
Commission concurs with the conveyance of the City property located at Johnson PazI.tivay and
Phalen Boulevard to the XIF2A for subsequent conveyance to Realife, Inc.; and
BE IT FURTHER RESOLVED, that the Saint Paul Pazks and Recreation Commission
finds that Use reciprocal conveyance of properties by ihe City and the HZtA. is indeed of mutual
benetit to the City and the HR.A, and with respect to the provisions of Section 13.01.1 of the City
Chuter, therefore recommends approval by the City Council �vith the value of City and HRt1
properties determined to be equal to one another, such that there is no cost to either party for the
property obtained from the other.
