and situated upon those premises
legally described as the North
part of Lots S and 6, Block 4,
Lewis Addition, according to the
plat on file and of record in the
office of the Register of Deeds in
and �or the County of Ramsey, State
of Minnesota.
WHEREAS, pursuant to resolution, C. F. No. 259130, approved
June 26, 1972, a public hearing was scheduled for 10:00 a.m. on
July 11, 1972 before the Council of the City of Saint Paul, said
hearing pertaining to the condition of the structure located at
878 Park Street, Saint Paul, Minnesota; and
WHEREAS, upon facts presented at said hearing consisting of
photographs, inspection reports and the recommendations of the
Building Department, it is found and determined by the City Council
that according to the records and files in the office of the Register
of Deeds, the last record owners of the above described property are
Bert A. and Annabel Bailey and Shirley N. Bailey; and that there are
no lien holders of record; and that it is further determined that
the above described building constitutes a hazardous building within
the definition of Minnesota Statutes Section 463.15 for the following
reasons:
a. The building is standing vacant,
abandoned and is subject to being entered by
unauthorized persons;

b. The exterior condition of the building is
as follows: Nearly all of the windows are broken.
The exterior frame stairway used as a second means of
egres5 is not structurally sound due to dry rot.
There is evidence that the roof leaks as the ceiling
tile is stained and the plaster ceilings are loose
and falling. The roof on the south side sags and the
chimney on the south side is deteriorated at the roof
line. Asbestos siding is broken and pieces are
missing. Soffit, fascia and window sash are rotted;
c. The interior . condition of the building is
as follows: The interior has been vandalized and is
rapidly deteriorating. The floors sag and floor
covering is missing. The plaster walls have large
areas where the plaster has fallen or has been torn
off. A great deal of debris litters the floors of
the apartments. The bathroom floor on the second floor
is buckling and has dry rot. Some of the plumbing
fixtures have been removed leaving open waste lines
which expel sewer gas. The electrical system is in-
adequate. The heating is by space heaters. The
basement is da.mp because of the porou� foundation.
Mortar is missing in places in the foundation. There
.�.... is evidence of dry rot throughout the building;
d. The building in the above condition is beyond
reasonable repair;
e. The building is unfit for human habitation in
its present condition and the above corrections must be
ma.de in compliance with the Building Code and the Housing
Code of the City of Saint Paul in order to make the same
habitable;
f. The building constitutes a nuisance and a hazard
to the public health, safety and welfare because of its
physical damage, dilapidation and inadequate maintenance;
now, therefore, be it
RESOLVED, that in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby
make the following Order:
ORDER
1. The owner of the above described building shall ma.ke the
same safe and not detrimental to the public peace, health, safety
and �elfare by having the said building razed and the materials
therefrom removed from the premises within thirty (30) days from
the date of the service of this Order;

2. Unless such corrective action is taken to comply with
this Order or an answer served upon the City of Saint Paul and
filed in the Office of the Clerk of the District Court of Ramsey
County, Minnesota, within twenty (20) days from the date of the
service of this Order, a Motion for Summary Enforcement of this
Order to raze and remove the said building will be made to the
Ramsey County District Court;
3. In the event that the building is to be razed by the City
of Saint Paul pursuant to judgment of the District Court, all per-
sonal property or fixtures which may unreasonably interfere with the
razing and removal of this building shall be removed within ten (10)
days from the entry of judgment; and if not so removed, the City of
Saint Paul shall remove and dispose of such personal property and
fixtures as provided by law;
4. If the City of Saint Paul is compelled to take any corrective
action herein, all necessary costs expended by the City will be
assessed against the above described real estate and collected as
other taxes; and be it
FURTHER RESOLVED, that a certified copy of this resolution
and incorporated Order herein be served upon the last record
owners of the above described property in the manner provided
by law.

Honorable Council:
The Bureau of Public Buildings is her�by submitting its report on
the condition of the structure at the above location.
The owners of record are Bert A. and Annabel Bailey and Shirley N.
Bailey (Mrs. Duane) and the legal description of the property is
the North 40 feed of Lots 15 and 16 , Block 4 , Lewis ' Addition to
St. Paul.
This is a 2 story, 36 ' x 42 ' frame 4 unit apartment.
A recent inspection indicates that nearly all of the windows are
broken. The exterior frame stairway used as a second means of
egress is not structurally sound due to dry rot. There is evi-
dence tht the roof leaks as the ceiling tile is stained and the
plaster ceilings are loose and falling. The roof on the south
side sags and the chimney on the south side is deteriorated at
the roof line. Asbestos siding is broken and pieces are missing.

Some of the plumbing fixtures have been removed leaving open
waste lines which expel sewer gas. The electrical system is
inadequate. The heating is by space heaters.
The subject property has been boarded up by the city since Dec-
ember 2, 1971. This is the second time that the City Council
has been asked for a public hearing regarding this property. In
� July of 1968 this matter was referred to the office of the City
Attorney but the owner repaired and tenants occupied the building
in 1969.
The Housing and Redevelopment Authority does not intend to acquire
this property.
Inasmuch as the conditions outlined above consitutue a public
hazard and the owner has made no attempt to satisfactorily repair
the damage despite our warnings and the cantinued vacant and
boarded up condition contributes a blighting influence on the
neighborhood, it is the recommendation of this bureau that this
matter be referred to the City Attorney's office for razing and
removal through District Court proceedings.
