3 WFIEREAS, Centex Multi-Family Communities has submitted for City Council approval the attached

WHEREAS, the appropriate City departments have reviewed the plat and found, subject to recommended
conditions, that it meets the requirements of Chapter 67 of the Zoning Code; and

WHEREAS, the City Council held a public hearing on the proposed plat on May 22, 2002, where all
interested parties were given the oppommity to be heazd, and the Council considered all the facts and
recommendations concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached combined
plat for Upper Landing Urban Village in the area generally bounded by Chestnut Street, new Shepard Road,
High Bridge and Samuel H. Morgan Regional Trail (old Shepard Road), subject to the following conditions:
1. The applicant shall file a copy of the Councii Resolution approving the plat with the Rainsey County
Registrar of Titles.
2. Concurrent with the filing and recording of the plat in Ramsey County land records, the applicant shall
record the declaration of restrictive covenants, acceptable to the Saint Paui Division of Parks and
Recreation, stating that Outlots A, B and E, while privately owned axid maintained, shall be available
for use by the public in perperixity. Outlot A will be used as park, and Outlots B and E will be used
for passive recreational uses.

3. The applicant shall foilow the principles of the Ramsey County Erosion and Sediment Control
Handbook to address short-term erosion concerns such as sediment from construction entering the
Mississippi River, erosion from wind, and tracking of sediment on local roads by construction vehicles.

A. PURPOSE: Combined plat to create seven blocks and associated streets for the
construction of approximately 6Q0 housing units and some commercial space on the Upper
Landing.
B. PARCEL SIZE: 897,402 sq. ft. (20.6 acres)
C. EXISTING LAND USE: The site is currently vacant, undergoing the final stages of soil
remediation and site preparation.
D. SURROUNDING LAND USE:
North: Shepard Road
East: Future site of Upper Landing Park
South: Mississippi River
West: Xcel High Bridge Piant
E. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision (1)
creates five or more fots or parcels each of which is 2Yz acres or less in size; or (2) requires
paved streets, alleys and other public improvements; or (3) is previously unplatted land.
§67,.406 provides criteria for review of subdivision applications. These criteria are
addressed below under °Required Findings."
F. HISTORY/DISCUSSION: The Upper Landing has been the subject of a great deai of
attention over the last several years. The Upper Landing Precincf Plan, released in 1997 as
part of the Saint Paul on the Mississippi Development Framework, laid out a vision of a
mixed-use urban village on a site where "the balance between the culture of the city and the
nature of the river is piayed out." In 2001, the UpperLanding Urban Design MasterPlan
was completed and adopted as the offciai ur6an design framework for the site. By setting
the street and block pattern, buiiding configurations and heights, and network of open
spaces for the new neighborhood, the Master P/an has guided preparation of the combined

plat. An Upper Landing Advisory Committee (comprising neighbors, key property owners,
Centex and its representatives, and City staffj has been working since completion of the
Master P(an to ensure that both the Precinct Plan and Master Plan are followed in
subsequent design and development phases. It will continue to meet after approval of the
ptat to guide the more detailed desig� of buildings, streets and public space.
G. DISTRICT COUNCIL RECOMMENDATION: None received prior to preparatio� of staff
report.
H. REQUIRED FINDINGS: § 67.406 of the Zoning Code requires that ail of the following
findings be made prior to approval of a subdivision:
9. All the applicabie provisions of the Legislative Code are complied with. City staff
have reviewed the proposed plat. Parks staff have requested that the declaration of
restrictive covenants specify that Outlots A, B and E will be available for public use. In
their comments, staff from the Ramsey Soil and Water Conservatio� District were
concemed with short-term erosion issues, and suggested that these be addressed by
following the principles of the Ramsey County Erosion and Sediment Controi Handbook.

2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. TFie proposed plat has been designed specifically to be
consistent with surrounding Iand uses, and will not be detrimental to present and future
use of surrounding land.
3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision. The area
surrounding the proposed plat is generally developed and compatible with the proposed
plat. The plat recognizes, allows for, and is compatible with development of new uses
adjacent to the site, inGuding the Samuel H. Morgan Regional Trail, Chestnut Plaza and
Upper Landing Park.
4. The subdivision is in cortformance with the Comprehensive Plan. The subdivis+on
is in conforman�e with the Land Use chapter of the Comprehensive Plan, which calis for
the development of a mixed-use urban village on the Upper Landing. It also conforms
with redeveiopment pfans for the area and the Upper Landing Ur6an Design Master
Plan, adopted by the City Council as the offcial urban design framework for the Upper
Landing.
5. The subdivision preserves and incorporates the site's important existing naturai
features whenever possible. Over the years, the site's natural features have been
severely compromised and, in some cases, destroyed. Already, soil contamination has
been remediated, and the site is ready to support human activity once again.
Stormwater detention ponds and the incorporation of a series of g�een spaces wili help
to restore some of the natural environmental features on the site. The new
neighborhood is being planned and designed in conjunction with the adjacent regional
trail, which will re-establish a more natural rive�s edge.

6. Ail land intended for building sites can be used safely without endangering
residerrts by perii from floods, erosion, continuausly high water tabte, severe soit
conditions or other menace. The entire site is being raised ouf of the floodplain to
protect buildings and residents from flooding. Current plans indicate that a floodplain
special condition use permit wiil be required to allow the construction of underground
parking. Soil contamination has been remediated.
