Dear Sir:
This is written in response to the appeal and application for a permit
of Virgil Doerfler to relax parking lot buffer requirements and install
a 36-car parking lot for an apartment building on property located on
the northwest corner of Van Dyke Street and E. Magnolia Avenue. This
property is further described by the legal description on file.
This matter was first heard at the March 16, 1972, Board of Zoning
public hearing, at which time the matter was laid over to the April 6,
1972, meeting at the request of the applicant.
At the April 6, 1972, hearing, the staff reported that the parking lot
meets design standards except for the buffer area which is being appealed.
It was explained that a fence is proposed between the lot and the adjoin-
ing property.
The Board considered questions of headlights and green space. They noted
that a buffer was required by the Code even though the property was zoned
Heavy Industry because a residential use adjoined it.
Separate motions were made to recommend approval of the appeal and then
approval of the permit. The motions passed by separate votes of 3 to 2.

A. HISTORY: The proposed development of this property with a 36-car parking
lot in conjunction with a 24-unit apartment, designed as proposed, re-
quired a relaxation of the required 8-foot buffer area. The Board of
7oning heard this matter on April 1, 1971 and recommended denial of the
appeal. No one appeared on behalf of the matter and subsequently, the
appeal was withdrawn by the appellant.
B. PROPOSFD USE: Develop the site with a 24-unit aparttnent and a 36-car
parking lot.
C. PRESENT STANDARD: Chapter 64, Section 23, Sd, states that off-street
parking facilities on open lots with a capacity of 10 or more cars shall
not be Located closer than 8 feet to property zoned residential or property
containing a structure the ground floor of which fs used for residential
purposes.
D. VARIANCE: The appellant is requesting a 100% varfance to eliminate the
buffer area entirely.
�. AREA 7.ONING: The surrounding area is zoned Heavy Industry.
F. SITE CONDITIONS: The site is vacant, relatively level and approximately
at the grade of the adjacent streets.
G. AREA CONDITIONS: To the south along the west side of Van Dyke Street,
there is a 17-unit apartment, vacant land and an 18-unit apartment. Ad-
joining to the east is a 42-unit apartment complex. Further east are more
recently developed apartments.

You are hereby notified that a public hearing will be held in the Council
Chambers of the City Iiall and Court House in the City of St. paul at 10:00
a.m. on April 27, 1972 on the application of Virgil Doerfler for
1) a permit to construct a 36-car parking lot for use in con�unction
with an apartment buflding, and
2) an appeal to relax the parking lot buffer requirementa, all on
the property described as follows:
Lot 13-15, Block 2 and South 1/2 vacated alley adjacent; Lots 1 and 2, Block
3, except South 40 feet of Lot 2 and North 10 feet of East 38 feet of
vacated East Magnolia Avenue adjoining Lot 1, and also vacated Van Dyke
Street adjacent to Lots 1 and 13, all in flazel Park Plat "B", except
Railway right-of-way. The property is located on the North side of East
Magnolia Avenue between White Eear Avenue and Haael Street.
