Dear Sir:
This is written in response to the appeal of Richard E. Cottle to relax area
requireme�ts to allow a duplex on property located on the north side of Summit
between Dale and Kent Streets. This property is further described as Lot 14,
Block 23, Weed and Willius Addition.
This matter was heard by the Board of Zoning at its April 6, 1972, public hear-
ing at which time the staff report on file was read. It was noted that the
Model Cities office was contacted on this matter but declined to comment since
this site is not within its boundaries. It was noted that the adjacent row
house containing the former residence of the late author F. Scott Fitzgerald had
recently been put on the National Registery of Historic Sites. In connection with
this, the Minnesota Historical Society, which is the State Liaison Office of the
National Park Service, addressed a letter to the Board and, referring to the pro-
posed development, stated that "emphasis should be placed on the design of the
structure as a complementary element in its neighborhood."
Mr. Richard Cottle, the appellant, said he owns the lot in question. He said he
intends to build on this lot a side by side duplex designed by his architectural
firm. He showed the Board members plans of the proposed structure stating he
attempted to make it compatible with the adjacent row house, and that he would
reside in one of the duplex units.
Mr. John Enochson, who owns a single family home adjacent to the subject site on
the west, expressed concern that the proposal would increase the parking problem
on Summit Avenue and should be of such design as to conform to the neighborhood
and be built with top quality materials and craftsmanship.
Mrs. Ethel D. Cline, owner of the former Fitzgerald residence, commented on the
plan saying she thought the duplex should be narrower and be faced with stone rather
than brick.
The Board noted that the plan shows the building as violating the side yard require-
ment of the Building Code. The applicant was told he would have to make a separate
appeal for that provision before the Building Board of Appeals.
Subsequently, the Board heard a motion to recommend approval since the Comprehensive
Plan recommends medium density for the area and since the variance is small. The
tpotion was seconded and carried by a vote of 5 to 0.

B. PROPOSA',_,: The letter of appeal states that the appellant intends to
build a duplex on the lot.
C. NEED FOR APPEAL: The Lot is short of the area required for a duplex in
an "A" Residential district.
D. PRESENT STANDARD: A duplex in an "A" Residential district requires a
lot area of 7,500 square feet.
t E. VARIANCE: The lot contains an area of 7,100 square feet which is 400
square feet or 5.63% short of the area required.
F. AREA ZONTNG: A parcel on the southeast corner of Su�nit Avenue and Dale
Street is zoned "C"��Residence. A parcel on the southeast corner of Portland
and Dale Street is C Residential. There is extensive "C" Residential
zoning north of Portland Avenue. The rest of the area is zoned "A" Residential.
The Comprehensive Plan reconunends medium density residential use of the area
around Summit Avenue, It calls for Dale to be made an arterial street and to
cut through this block to Oakland and the Grand Avenue hill presumably east of
the row houses.
G. SITE CONDITIONS: The site is vacant and about 3 feet above the grade of Summit
Avenue. Several trees exist near the east property line.
H. AREA CONDITIONS: Two dwellings exist west of this site. A communityservices
building, a three-plex, a duplex and an apartment exist north of it on Portland
Avenue. A row house protected by the Federal government adjoins this lot on the
east. Itow houses and apartments exist on the south side of Summit Avenue and
large homes converted to apartments or rooming accommodations exist west of
Dale Street.
