to execute on behalf of the City of Saint Paul. the Agreement between the City
and the Soo Line Railroad. Company�
Said Agreement provides for alterations of signal and com�nunication wires
made necessary by City construction project on Maryland Avenue within the
Soo Line Ra3.lroad Company ri�ht-of-way a,nd further provides covenants in the
matter of mutuai cooperat�.on o£ aforesa3d construction.
A copy of said Agreem�:nt being attached hereto and incorporated herein by
reference.
FURTI�R RESOLVED, Tha� thE costs incurred by the City of Saint Paul under
the terms of th3.s A�reement shall be paid from Code 1971 County Aid in the sum
of $6,818.00 and this code fund sha11 be reimbursed from Federal T.O.P.I.C.S.
funds if approved. Said costs shall be accounted for under D�partment of
Public Works Project Number P-o526A.

10. Costs �or the Railway Force Account Work will be computed as outlined

' Railway bills for the Railway Force Account Work wi11 be submitted to the
City in the rs�.nner prescribed in PPPd 30-3, Para�raph 15. All Railway cost records .
and accounts relating to the Railway Force Account Work s�rill be available for
inspection by the representatives of the City in accorda.nce with PPl�i 30-3, Para�raph 15-c•
The City �rill rei.mburse the Railway for the cost of the Railway Force
Account Work wi.thin thirty (30) days after receipt �nd approval of said bills.
11. .All costs of the Project, includin� any extra worl: orders or changes
in the p12.ris r.:U,cie d�,�sin� cor.struction, at the request of the Ci�y, 4rill be paid
for by the City at no cost to the Railt•ray. Upon completion of construction o�
Bridge ido. E2j25, t�:e City sha11 at its own e�nense *naintain, rep�ir and renew
said brid&e, includin� all atipurtenances thereto and thereof; however, nothing
herein contaa.ned shall be construed to relieve either the City or the R�.iltaay
of co�on la�•r or statutory liability, if ax�y, for ar�y damages to Bridge No.
62525, or the work �.s caxried out on the Project, resultin� from the operations
of the Railway ox the Ci-�y. The obligation to so r.iaintain said bridge sha11
eontinue unless chan�ed by future agreeme.�ts a.nd in accordance. with the law of
the �Sta-te of D�:innesota, as it sha11. be from time to tame a.n the flzture.

drain�e water onto a sw.table place on the ri�ht-of-way of the Ra�.].way dur3ng
the period be�:reen the construction of the embanY,rnent in Sta�e T a.nd the
installatio:� of the dxaa.na.ge systen in Stage II� providin� that in the opi�ion of
the Rai.].svay's Chie� E�ineer, it does not hinder or mar;e unsafe the railroad
operations.

a.ny and aLl e�ense incurred. by i-� by reason oF any failure of the Ci�y to

15. Immediately prior to the start of the construction operations ad�acent
to the Railw�yts right-of-way, the City wi.11 t�ce elevations at the tops of both
ends of the piers and abutments of Bridge �Jo. 6599 and on the top of each rail
of the ftailway's track for a distance of 600 feet in each direction from the
;�intersection of the track and the center line of Bridge No. 6599• At the time .
that elevations are taken, the al i�ent of the existang cenl:er oP the track
will also be surveyed and recorded for the sarse distance. The notes, showing
the elevations and alignment, will be submi.tted to the Ra,ilway to be used to
determine the amount of settlement in Bridge No. 6599 or the track and to deter-
mine Fzny chan�e in a1.i.�;nrnent of the track that mi�ht occur as a result of the
Project. The City will Ue responsible for a two-year extraordinary maintenance �

per3od to provide ar�y future track surfa,cing and ali�ni.ng that may become necessary
as a result of the Project. The City will also be responsible for repairs due to
settlement that may occur in Bridge No. 65g9 as a result of the Project over a two •
year extraordinary maintenance period.
This two-yeax extraordinary �aintenance period will start upon the completion
of the approach earth emban�.�ent placed 200 feet on both sides o� the center line
of the track. .
16. This Agreement sha11. not in any manner su�ercede ar�y existing Agreements
in respect to r.:G.i.ntena.nce of Bridge P1o. 6599 other than as no�ed in Para.graph 15.
