WHERTAS, pursuant to resoiutiott, C. F. No. 2575oT, approved February 25, 19T2s a public hearing was scheduled for 10:0� a.m. on March 21, 1972, at which time said public hearing was laid over and ultimately held on April 20, 1972, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structures located at 737-739 Dayton Avenue, Saint Panl, Minnesota; and WHEREAS, upon facts presented at said hearing consisting of photographs , inspection reports and the reeommendations of the City Architect, it is found and determined by the City Council that according to the records and files in the offiee of the Ramsey County llbstract Clerk, the last record owner and other parties of interest in the above described property are Lesley and Delores Nelson, A1 Bsoxn and Service 5avings and Loan Association; and that there are tto other lien holders of record; and that it is Yurther determiaed that the above described buildings eonstitute hazardous buildings within the definition of Minnesota Statutes Section 463.15 for the folloxing reasons : a. �he building and accessory building are standing vacant , abandoned and are sub�ect to being entered by uaauthorized persons ; COUNCILMEN Adopted by the Council 19— Yeas Nays Butler , Caxlson � Approve� 19� Levine _�n Favor Meredith Sprafka Mayor A gainst Tedesco Mr. President, McCarty � • ! ; �����lTt� b . The exterior condition of the building is as folloWS : The chimney requires pointing and there areloose bricks . The rear porch is rotted and decayed with broken rails . Pieces of the asbestos siding are broken or missing on all four sides of the building and the cornice, trim, window and door frames are broken and decayed. c . The interior condition of the building is as follovs : The lath e�nd plaster on the walls and ceilings on the first floor has been removed or broken. Floors sag as much as four inches in : tWelve feet and are buckled in places . On the second floor the lath and plaster or wall board on the wall and ceilings have been removed or broken. The floors sag and the radiators have been removed. On the third floor the floors made of six inch fir boards sag as much as six inches in fourteen feet. The Walls , which are covered with a variety of materials , including card board from boxes , are in poor repair• The electrical system is inadequate and outdated. The rubble stone foundation walls need pointing and the cancrete patchwork basement floor is in a poor state of repair. d. The building in the above condition is beyond reasonable repair ; e. The building is unfit for human habita- tion in its present condition and the above corrections must be made in compliance With the Building Code and the Housing Code of the City oP Saint Paul in order to make the same habitable; f. The building constitutes a nuisance and a hazard to the public health, safety and welfA,re because of its physical damage , dilapidation and inadequate maintenance; g. There is an 18 x 36 foot frame garage on the property, the roof and cornice of which is rotted. LTnless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of the District Court of Ramsey County, Minnesota, kithin twenty (20 ) days from the date of the service of this Order , a Motion for Summary Enforcement of this Order to raze and remove the said building Will be made to the Ram�ey Countg Distriet Court ; 3. In the event that the building and aceessory building ia to be razed by the City of Saint Paul pursuant to 3udgment oP the District Court , all personal property or fixtures which may un- reasonably iaterfere with the razing and removal of this building and accessorq building shall be removed Within ten (10) days from the estr_� of 3udgment ; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtnres as provided by law; 1�. AMES, City Archi4ec+ 445 City Hall, 55102 223-4212 March 21, 1972 Honorable Charles McCarty, Mayor and Members of the City Council Re: 737-39 Dayton Avenue File No. 2156 Gentlemen: The Building Department is hereby submitting its report on the condition of the structures at the above location. The owner of record is Lesley Nelson and the legal description of the property is the West � of Lot 20 and all of Lot 19 , Block 2 , Holcombe' s Addition. There is a three story 48 foot by 60 foot frame four plex and an 18 foot by 36 foot frame garage on teh property. The chimney of the four plex requires pointing and there are loose bricks. The rear porch is rotted and decayed with broken rails . Pieces of the asbestos siding are broken or missing on all four sides of the building. The cornice, trim, window and door frames are broken and decayed. The rubble stone foundation walls need pointing and the concrete patch- work basement floor is in a poor state of repair. On the first floor the lath and plaster on the walls and ceilings have been removed or broken. Doors , frames and trim have been removed and broken. Floors sag as much as four inches in twelve feet and are buckled in places. On the second floor the lath and plaster or wall board on the wall and ceilings have been removed or broken. Floors sag. The sliding doors and outside walls and frames are decayed. The subject property has been boarded up by the city since August 27, 1971. Charles McCarty, Mayor and Members of the City Council Gentlemen: Re: File No. 2156-- 737-739 Dayton Ave. On March 20, Mr. Leslie Nelson, fee owner of the subject property, called and reported that Mr. Albert Brown , contract purchaser had to leave the city sudd.enly to attend the funeral of his sister who was killed in a fall. He reports that Mr, Brown requested him to ask that the public hearing on 737-39 Dayton Avenue be laid over for thirty days, as his mother who is also interested in rehabilitating the property, must attend. the funeral also and remain to handle the legal matters involved with her daugher!s sudden death.
