WHEREAS, Chapter 293 of the Saint Paul L,egislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Central Ministries, represented by Reverend Bob
Battle, who has been designated as the responsible person on the
application, has applied for a variance to allow amplified music
at Berern Church of God In Christ, 639 Jackson Street, on June 21
and 22, 2002; and
WHEREAS, applicant is seeking a variance for the hours of
4:00 p.m. to 5:00 p.m. on both days; and
WHEREAS, if applicant is not granted a variance iC will not
be able to have amplified music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance for June 21 and 22, 2002 to Central Park
Ministries, subject to the following conditions:
1) The variance shall be for the hours of 4:00
p.m. to 8:00 p.m. on June 21 and 3une 22,
2002.
2) Al1 electronically powered equipment used in
conjunction with the event shall not exceed
9� dBA as measured at 50 feet from the noise
source.

3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 4:00 p.m. and 8:00
p.m. on June 21 and June 22, 2002 to ensure
compliance with Condition ##2.
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than 8:00 p.m.
on each date.

FURTHER RESOLVED, that any violation of the conditions set
forth above on the June 21, 2002 date may result in revocation of
the grant of a variance for the June 22, 2002 date, in addition
to any criminal citation which might issue.

Attached is a sound level variance application from Reverend Robert Battle, representing
Central Park Ministries, 639 Jackson Street, to allow amplified music outside on the
