WHEREASt The � ter of the City of Saint Paul, pproved by
the voters on November 3� 1970� provides by its terms- ,that it
shall become effective June 6� 1972, and tha.t the previously
existing Charter of the City is repealed as of June �, 1972; and
WHEREAS! The new Charter in the transitional provisions con-
tained therein permi.ts the City Council to establish executive
departments, describe their functions and provide for the qua.li-
fications, salaries and powers of department heads to become
effective on June 6, 1972; and
WHEREAS4 The Council of the City of Saint Paul is of the
opinion that the new Mayor together with the members of the City
Council elected on April 2�� 1972, should be given complete and
unfettered opportunity to participate in the development of the
forthco�i.ng AdrninT.strative Code and the establishment of executive
departments and, therefore, this Council does not intend to adopt
ordinances reorganizing the City�s executive departments prior to
June 6, 1972; now, therefore, be it
RESOLVED! Pu�suant to t1�.e.findings ,stated above and in
accordance with the transitional provi.sions contained in the new .
Charter for the City of Saint Paul� the executive departments that
sha.11 exist on and after June 6� 1972, sha.11 be the Office of the
Ma.yor, Office of the City Attorney, Office of the City C]:erk; and
the Departments of Public Safety; Public Works; Public Utilities;
Parks� Recreation and Public Buildings; Libraries and Museums; and
Fina.nce� with such powers and duties as existed under the previous
Charter of the City of Saint Paul and� further� that all other
offices and agencies of the City which existed June 5, 1972� sha11
become part of the Office of the Mayor; and be it

the salaries and qua.lifications of department heads, the Ma.yor
sha.11, with the advice and consent of the Council� designa.te from
among employees of the City persons to serve as acting heads of
the respective depa.rtments who shall retain throughout such
service their positions� if any� in the classified service and
return thereto when removed as acting department heads; and be it
FINALLY RESOLVED� That the above conditions of City govern-
ment shall continue until such time as the City Council ma.y� by
admi.nistrative ordina.nce, provide for the reorganization of the
executive departments.

Dear Commissioners:
Pursuant to the authority contained in the charter of
the city of Saint Paul, I herewith veto and return to
this council C.F. No. 258250 , adopted the 20th day of
April 1972 .
The council file above referred to is a resolution of
the city council and the action contemplated according
to the terms of said resolution must be accomplished
according to the terms of the new charter by an
ordinance; thus, said C.F. 258250 i� on its face
contrary to the law and therefore illegal.
