The Port Authority.is nearing completion of redevelopment of the Great Northern Business
Center, Phase I. As you know, fhe Port Authority plans to retain ownership, in perpetuity, of
two outlots, where contaminated soii is buried, as an approved disposal remedy by the
Minnesota Pollution Control Agency.

he Saint Paul Port Authority is seeking and will ascertain a Certificate of Completion on the
business center property, a No Action Letter on the two berms which are outlots A and B, and
a No Action Letter on Topping Street, where addi#ional contaminated soil is buried.
The disposal of contaminated soil underneath Topping Street has been approved by the City
of Saint Paul Department of Public Works pursuant to terms and conditions contained in a
letter from the Public VVorks Department.
We befieve that using public rights-of-way and other berms as disposal sites for contaminated
soil is a cost effective and safe way to save public funds in the redevelopment of
contaminated sites. ft is becoming more standard today, through out the Twin Cities area,
and we plan on implernenting these activities in the future in consultation with the City's Real
Estate Department and the City's Department of Public Works.
If you have any questions regarding this matter, please do not hesitate to call.

RE: Custom Drywail Building/Great Northera Business Center
u
Dear )ohn:
Your Consant to plat request ro Custom Drywalt was referred to me for review.
In reviewing the documents, I noticed that they ad been drafted for signature oa behalf
of "Custom Drywall, Tnc." rather than "Custom xchange, LLC" which is the actuai fee
owner. As yon may recall, Cus[om Exchange, LLC has acquired the property as part of
a reverse 1031 taX deferred exchange which is being engaged in by Custom Drywall,
Tnc. Accordingly, I have revised your documents by substiwting Custom Exchange,
LLC as tde fee owners and have had them executed on trehalf of Custom Bxchange,
1.LC, the originally executed copies of which are enclased.
If you need anyching further, piease let me know.
Very truly yours,
