In the Matter of hazardous buildings
being that single family frame dwelling
known and described as 877 Marion in the
City of Saint Paul and situated upon those
premises legally described as Lot 2, Block
13, Lewis 2nd Addition, according to the
plat on file and of record in the office of
the Register of Deeds in and for the County
of Ramsey, State of Minnesota.
WHEREAS, pursuar�,t to resolution, C. F . No. 255958, approved
Octob er 7, 1971, a public hearing was scheduled £or 10: �0 a.m. on
October 26, 1971 at which time said public hearing was laid over
and ultimately held on December 8, 1971, be£ore the Council of the
City of Saint Paul, said hearing pertaining to the condition of the
structures loeated at 877 Marion, Saint Paul, Minnesota; and
WHEREAS , upon facts presented at said hearing consisting of
photographs, inspection reports and the recommendations of the
City Architect� it is found and determined by the City Council
that according to the records and files in the offiEe of the Ramsey
County Abstraet Clerk, the last record owner and other parties of
interest in the above described property are R. DeWayne Beard,
Janice Farley and Trin City Federal Savings and Loan; and that
there are no other lien holders of record; and that it is further
determined that the above described building constitutes a hazardous
building within the definition of Minnesota Statutes Section 463. 15
for the following reasons:
a. The building and accessory building are
standing vacant, a�andoned and are subject to
being entered by unauthorized persons;
b. The exterior condition of the building is
as follows : The two chimneys are in poor condition;

the siding is rotted; part of the roof is in poor
condition; the cornice is rotted and the foundation
is crumbling and the south side is settling;
c. The interior condition of the building is
as follows;: The plaster is missing and cracked in
two rooms on the first floor. In the center room
the floor slopes approximately eight inches . The
living room ceiling sags . The floor in the north
room is rotted and sagging. The floors are sagging
on the second floor and the plaster is off the
ceiling amd shows evidence of a leaking roof. The
plumbing is missing and broken. The soil pipe in
the basement has holes; the electrical wiring is
inadequate; the house is heated by a space heater.
The foundation is falling into the basement;
d. The building in the above condition is beyond
reasonable repair;
e. The building is unfit for human habitation
in its present condition and the above corrections
must be made in compliance with the Building Code
and the Housing Code of the City of Saint Paul in
order to make the same habitable;
f. The building constitutes a nuisance and a
hazard to the public health, safety and welfare
because df its physical damage, dilapidation and
inadequate maintenance;
g . There is a 14 ' x 20 ' frame building on the
premises which is structurally unsound and is leaning;
now, therefore, be it
RESOLVED, That in accordance with Minnesota Statutes Sections
463. 15 through 463. 26, and based upon the foregoing findings of
the City Council, the Council of the City of Saint Paul does hereby -
make the following Order:
ORDER
l. The owner of the above described building shall make the
same safe and not detrimental to the public peace, health, safety
and welfare by having the said building razed and the materials
therefrom removed £rom the premises within thirty (30) days from
the date of the service o£ this Order;

2. Unless such corrective action is taken to comply with this
Order or an answer served upon the City of 5aint Paul and filed in
the 0£fice of the Clerk of the District Court of Ramsey County,
Minnesota, within twenty (20) days from the date of the service of
this Order, a Motion for Summary Enforcement of this Order to raze
and remove the $aid building will be made to the Ramsey County
District Court;
3. In the event that the building and accessory building is
to be razed by the City of Saint Paul pursuant to judgment of the
District Court, all personal property or fixtures which may un-
reasonably interfere with the razing and removal of this building
and accessory building shall be removed within ten (10) days from
the entry of judgment; and if not so removed, the City of Saint Paul
shall remove and dispose of such personal property and fixtures as
provided by law;
4. If the City of Saint Paul is compelled to take any corrective
action herein, all necessary costs expended bq the City will be
assessed against the above described real estate and collected as
other taxes; and be it
FURTHER RESOLVED, That a certified copy of this resalution
and incorporated Order herein be served upon the last record owners
of the above described property in the manner provided by law.

Gentlemen:
The Building Department is hereby submitting its report on the
condition of the structures at the above location.
The owner of record is R. De Wayne Beard and the legal description
of the property is Lot 2 , Block 13, Lewis 2nd Addition.
A recent inspection indicates the following:
Building Classification: Single family frame dwelling.
Exterior: The two chimneys are in poor condition. The siding
is rotted. Part of the roof is in poor condition. The cornice is
rotted. Foundation is crumbling and the south side is settling.
Basement: The foundation is falling into the basement.
First Floor: The plaster is missing and cracked in two rooms .
In the center room the floor slopes approximately eight inches. The
living room ceiling sags. The floor in the north room is rotted and
sagging.
Second Floor: The floors are sagging. The plaster is off the
ceiling and shows evidence of a leaking roof.
Plumbing, Heating and Electrical Systems : Plumbing is missing
and broken. The soil pipe in the basement has holes. The electrical
wiring is inadequate. The house is heated by a space heater.
Accessory Buildings: The 14 ' x 20 ` frame building is structurally
unsound and is leaning.
The subject property has been boarded up by the owner since
August 23, 1971.

hazard and the owner has made no attempt to satisfactorily repair
