Whereas, after having provided notice to affected property owners the HPC conducted a
public hearing on November 15, 2001, at which all interested persons were given an opportunity
to be heard. Thereafter, the HPC denied the application and informed the applicant of the
decision by way of a letter dated November 16, 2001; and
Whereas, Pursuant to the provisions of Saint Paul Legislative Code § �3.06, the City of
Saint Paul, Department of Public Works - Traffic Division, duly filed with the City Council an
appeal from the determination made by the HPC and requested a hearing before the City Council
for the purpose of considering the actions taken by the HPC; and
Whereas, Acting pursuant to Saint Paul Legislarive Code § 73.06, and upon notice to
affected parties a public hearing was duly conducted by the City Council on Wednesday,
December 19, 2001, where all interested parties were given an opportunity to be heard; and
Whereas, The Council, having heard the statements made, and having considered the
application, the report of staff, the record, minutes and resolution of the Commission, does
hereby
Resolve, That the Council of the City of Saint Paul hereby reverses the decision of the
Heritage Preservation Commission in this matter, based on the following finding of the Council:
1. Pedestrian safety at the intersection must be the key concern and the traffic island addresses
that concern. The Heritage Preservation Commission's denial of the pernut request was in error
when it balanced the design of the traffic island against pedestrian safety.
And Be it Further Resolved, That the appeal of the City of Saint Paul, Department of
Public Works - Traffic Division, be and is hereby granted subject to the condition that the fmal
design of the traffic island and the materials to be used in its construction must first be submitted
to the staff of the Heritage Preservation Commission for its review and approval.

This one slipped by me. This was an appeal heard in December, 200. The Council granted the
appeal by the Department of Public Works in order to build a traffic calming device at the
intersection of Suminit and Western. I had thought that I had prepared the resolution and filed it
with you to place on the Council's consent agenda. Instead, it appears that I drafted the resolution
and then filed it under my "done" file without ever giving it to you for the adoption by the Council.

permit application to construct a traffic island at Westem & Summit Avenues, which is located in the

Staff report presented at the HPC public hearing meeting on November 15, 2001 and the decision letter
sent to Public Works, denying the permit to construct the traffic island.
A concept review was conducled on Seplember 6, 2001 and the commission responded favorably,
although, rhe commission does not approve, deny or make any formal votes during a concept review.
Public notices are not sent out for concept reviews; it is a time for the HPC to be introduced ro a project
and to give informal feedback to an applicant.
When the public hearing meeting was conducted, there were testimonies both for and ngainst the island.
The commissian unaniniously denied the permit application and several commission members stated they
were swayed by public testimonies heard and had concerns for the historic context and history of the
area.

A. SITE DESCRIPTION:
The intersection of Westem, Portland and Smmnit Avenues measures 85 feet wide. The curbing is
granite and the sidewalks are cement with a tile pattern to mimic the older tiles. The land to the east
of the intersection has a hianwlaz pazk and garden and just to the west is a lazge Victorian Era
house with a carriage house facing Westem (the main house faces Portland).
B. PROPOSED CAANGES:
The applicant is proposing to construct an island at the intersecUon of Westem-and Summit
avenues. The goal for the applicant is to shorten the pedestrian crossing and to define traffic lanes •
to improve safety. According to the applicant, a plan to reconfia �re the intersection was proposed
to the neighborhood and the HPC several years ago. The HPC was not in support of reconfiguring
the intersection and removin� the original layout of the intersection. This current proposal preserves
the layout of the existing curbing and adds a new island.
The HPC conducted a concept review of this proposal on September 6, 2001. The Commission
responded favorably at the time, but recommended using granite curbing to be consistent with the
sunounding streets. The applicant is proposing granite curbing, with colored concrete curbing at the
radii, and a stamped concrete sidewalk. The preferred option by the applicant for landscaping is sod
with three trees.
C. GUIDELINE CITATIONS:

The traditional pattern of public streeu, curbs, boulevards, and sidewalks in the area shoedd be maintained.
Distinctive features of public spaces in tlte area, st�ch as brick alleys, stone slab sidewalks, granite ca�rbs,
and the early twentietlz centz�ry [antern style street Zights, should be preserved. The same style shottld be
irsed when new street tights are instaflerl: �ew streetfitrnitctre busshelters,-telephone —
booths, kiosks, sign standards, trash containers, planters and fences should be cornpatible with the
character of the district.
Brick alleys and stone slab sidewalks generally should be maintained and repaired as necessary with •
original materials; asphalt and concrete patches shoz�ld not be zesed. When concrete tile pe�blic sidewalks
need to be repZaced, new poured concrete sidewalks should be the same width as the zriting sidewalks and

• should�be scored in a 2 foot square or 18 inch sguare pattern to resemble the old tiles, expansion joints
should match the scoring. Handicap ramps shoe�ld be installed on the inside of curbs as part of the poured
concrete sidewalk; where there is granite curbing, a section should be Zowered for the ramp.
Electric, telephone and cable TV lines sho2dd be placed underground or along alleys, and meters should be
placed whereinconspicuous.
D. FINDINGS
l. Public features, such as street pattems, curbs, sidewalks and alleys, contribute to the character of
the Hi11 Historic District.
2. The guidelines state that "the traditional pattern ofpublic streets, curbs, boz�levards and
sidewalks in the area should be maintained. "
3. The existing street pattern at Summit and Western Avenues will not be altered by this proposal,
however, a new element will be added to an 85' wide intersection.
4. The new traffic island will use materials and sidewalk pattems that are consistent with the
surrounding curbing and sidewalks. The proposed trees are in line with existin� boulevazd trees.
5. The addition of a new triangular traffic island will not negatively impact the Hill District or
surrounding structures. This feature could also be removed without disrupting the existing street
pattern.
E. STAFF RECOMMENDATION
• Based on the findings, staff recommends approval of the permit to install a traffic island at Westem and
Summit Avenues.

At its October 11, 2001 regular board meeting the Ramsey Hill Association reviewed the request by the
city of Saint Paul Department of Pubiic Works to construct an island at the comer of Summit and Western
Avenues. After hearing the departmenYs presentation and taking comments from some interested
community residents the RHA Board adopted a motion to oppose the installation of the traffc island
regardless of the design until all other traffic caiming measures have been explored and implemented to
the fullest extent. Further, if the island and/or its design is approved by the Commission, the Association is
directed to appeai the decision to the City Counci4.
At the meeting no evidence was presented to indicate the need for the island or that there has been any
change in traffic usage or pattems since a similar island was ordered removed at the request of the
Heritage Preservation Commission and the community some years ago. In fact, accident counts show
that this is actually one of the safer intersections in Saint Paul. In addition, the oniy person we are aware
of that has requested the island was present and agreed that it would not achieve its intended goal — to
create a safer intersection for pedestrians. Finally, Public Works staff stated that the details regarding
right-of-way for tuming vehicies has not yet been considered.
As a result, the Ramsey Hill Association requests that the Heritage Preservation Commission deny the
request for the traffic isiand and its proposed design at this.time. The Ramsey Hill Association does not
take the safety of citizens lightly and, in fact, has been working ciosely with the Department of Public
Works on safety measures for Selby Avenue. However, in this instance, our organization believes that
such a structure is an unnecessary and unsightly intrusion at this historic intersection and, as everyone
seems to agree does nothing to impact the driver/pedestrian problems because they occur on the west
side of the intersection. Further, the structure, regardless of its design detracts significantiy from our
efforts to make the three parks at this intersection more attractive to residents and visitors alike.
The Association stands ready to work with the Department of Public Works and the Police Department to
identify needs and then institute measures that could achieve the intended goal without destroying the
current historic design. if other measures prove to be unsuccessfu( or conditions change we then wouid
reconsider our position.

SummiVWestem intersection. I tive nearby and walk and drive this irrtersedion daily in all seasons.
The real problem at this intersection is drivers southbourxf on Westem tuming right onto Summit who
simply roil through the stop sgn, sometimes at considerable speed. This is an issue for police
enfarcement, not Public Works.
To my knowledge the angled configuration of these streets is historic and as such should be preserved.

Our neighborhood assoGiatian, th.e Ramsey Hi0 Association invited Mr. Shetka to its
pctober rraecting when it was advised of this project. Mr. Shetka was asked to first paii�t
crosswalks at the inter�ections or instaU a stop sign as iesser i�itrusive steps. He
essenti2tly reft�ced, saying, "crosswalks don't work". He was reminded that the State law
requires that Csrs now stop for pedestrians in crosswalks. He was asked to instail some of
thc uaffic eoncs that remind drivers of the nQw law. He also said that doesn't work
either. What's at issue 6ere is enforcement. Why do we have crosswalks throughout the
city if they "don't work"T The State law is relatively new and it will take some time fpr
Minnesotans to get used to it. The concerned citizen herselfagreed at this meeting that
the island wouldn't solve the problein. In the meantime, historic Summit Avenue is going
to be blighted with a traflic hazard because of one citiaen's request and the detemtination
of Public Works.
� This ii�tersection has becn configured this way for decades Peopte who use that
interse..tioh kttow to use caution; they use it repeatedly and are familiar with it. This sa�ne
cbnfiguration Es used in multiple spots throughaut the City. I ask you to not "punish" the
� h;storic Avenue for one driver's inattentiveness and one citizen's request. There are many
less restrictive efforts that can be tried before this plan is implemented. The Historic Hill
District deserves better from the City.

ANNOUNCEMEN't'S - Spong announced that the brick alley appeal will be before the city
council on Nov. 28. Dan Scott will represent the HPC at the appeal.
III. APPROVAL OF THE AGENDA - The agenda was amended to include discussions regarding
1524 Summit and 698 Stewart Avenue. Larson will give a brief report regarding the Historic
Saint Paul annual meeting during the staff announcements. The agenda was approved as
amended.
V. PUBLIC HEARING/PERMIT REVIEW
A. Western/Summit - building permit to install a triangular traffic island
Spong reviewed the staff report. The applicant, A1 Shetka, Public Works, reviewed the proposal.
The hearing was opened for public testimony.
Jim Rends, nearby resident, spoke in opposition to the island and stated that he does not believe it will
help traffic, nor does it comply with the historic nature of the street.
Mark Voerding, 115 Farrington Street and the vice-president of the Ramsey Hill Association (RHA),
read a statement opposing installation o£ the island until all other remedies are exhausted. He stated the
RHA will appeal the HPC decision if the HPC approves the island. Mr. Voerding submitted a letter to
HPC staff for the record.
Jim Hirsch, 403 Portland, stated that safety is an issue, but does not believe there has been enough
discussion abouY other altematives.

Shetka stated that he did attend the RHA meeting and offered to install a temporary island to see how it
wouId function� - FIe does riof believe the $5 foot crossingissafe. --- -- — -
Foote asked if the island will affect traffic tuming right from Westem onto Summit because they roll
through the intersecrion and speed. Shetka stated that the island will berter define the intersecrion and

• give motorists a cue to stop.
Larson asked about what had been done before. Shetka stated that in 1984 Public Works moved the curb
lines out and made 90 degree angles. However, they did not get approval through the HPC and had to
remove and restore the street to its original appearance.
Younkin asked what was meant by using concrete a the "radii." Shetka said the granite cannot be
machined for the tight comers and so concrete will be used just for the radii and will look like granite.
Benton asked if there will be additional signage. Shetka stated that a yield sign may be installed. Benton

Chuck Goener stated that he is opposed to the island and that he believes a temporary island may not be

Larson moved denial of the building permit. Benton offered a second. Both commissioners stated
that they were swayed by public testimony opposing the island and had concerns regarding the
historic context and significance of this intersection. The motion carried unanimously.

• I recall a comment from a HPC member durin� deliberations relatin� that the island was
quite small and inferrin� it would not function weli for pedestrian safety. The trian�ular
island is lar�e; approximately 45 feet on a side and approximately 1,000 square feet in area.
• Durin� opposin� testimony the HPC chair had to continually remind the speakers to limit
commen[s as to �vhy the island does not fit the historic character of the district.
• The Parks Department supports the island construction and the trees/grass area will match
the character of the adjoining boulevards and area.

in the immediate area in support of the island proposal. They indicated they would like to

distance for a pedestrian to cross while confronting trlffic. I cannot help but ima�ine the

The purpose of this letter is to express my support for the Saint Paul Public Works DepartmenYs plan to
install a Pedestrian Island at the Intersection of Summit Avenue and Western Avenue in Saint Paul. I'm
sure you are aware of this intersection with four streets merging at odd angles. I have been a resident of
this historic neighborhood for ten years and I am proud of the three small parks boarding this busy
interseciion. The only feasible way to gei to Overlook Park to Nathan Nale Park to Cochran Park is by
walking.
1 appauld the St Paul Public Works and especially AI Shetka for taking the initiative to design this
pedestrian island to support safty for the pedestrian while combining all the historic guidelines as outlined
by the Heritage Preservation Commission.
The Ramsey Hill Association and the Heritage Preservation Commission Board's have voted against this
proposal. Historical area, yes it is -- but, we are not being driven by horses anymore!! It is my hope you
will vote in favor of the construction of this pedestrian island proposed by the St Paul Public Works
Department.

• As a resident of Summit Avenue, and one �vho has many visitors and guests to
his home, I find that the pedestrian who walks along Sttmmit Avenue endangers
himself each time he attempts to cross Summit at Western A��enue. The traffic is
fast-moving; and it gi�•es little or no consideration to the pedestrian attempting
to cross Western on the north side of the street. The unsafe situation can be
remedied b}� a tr�affic island installed on the north side.

I support the HPCs decision to den the Public Works-Traffic Division a building
pemut to construct a triangular traffic island at the intersection of Western & St,mmit
Ave.
'I'he city attempted to construct such an island about five or so years ago, and the public
outpouring of negative comments caused the project to be halted. 'The same outrage is
present today for these and other reasons:
1. The intersection is presenfly wide and safe.
2. I have lived in this neighbor since 1966 and have operated a business at 79 No.
Westem since 1976 and I do not recall ever seeing an accident at this intersection. If
there have been accidents, they have been very few.
3. The money to be expended should be returned to the taxpayers in lower taxes. The
local government has too much money now - as witnessed by this unnecessary project.
4. ANY new construction in the intersection will necessarily make the traffic lanes
narrower and unsafe.

A. SITE DESCRIPTIOIV:
The intersection of Westem, Portland and Summit Avemies measures 85 feet �vide. The curbin� is
granite and the sidewalks are cement �vith a tile pattem to mimic the older tiles. The land to the east
of the intersection has a trian�ular park and garden and just to the west is a large Victorian Era
house with a cania�e house facing Westem (the main house faces Portland).
B. PROPOSED CHANGES:
Th� applicant is proposin� to construct an island at the intersection of Westem and Summit
avenues. The goa] for the applicant is to shorten the pedestrian crossin� and to define traffic lanes
to improve safety. According to the applicant, a plan to reconfi�ure the intersection ���as proposed
to the neighborhood and the HPC several years ago. The HPC was not in support of reconfigurin�
the intersection and remo��ing the original layout of the intersection. This cunent proposal preserves
the layout of the existin� curbin� and adds a new island.
The HPC conducted a concept re�•ie�v of this proposal on September 6, 2001. The Commission
responded favorably at the time, but reconunended using granite curbin� to be consistent with the
sunoimding streets. The applicant is proposing granite curbing, with colored concrete curbing at the
radii, and a stamped concrete sidewalk. The preferred option by the applicant for landscaping is sod
with tl�ree trees.

3. The existin� streef pattem at Summit and Westem Avenues �vill not be altered by this proposal,
hotivever, a new element will be added to an 85' �vide intersection.
4. The new traffic island �vill use materials and sidewalk pattems that are consistent �vith the
sunoundin� curbin� and sidewalks. The proposed trees are in line with existin� boulevard trees.
5. The addition of a new triangular traffic island �vilt not negatively impact the Hill District or
sunoundin� structures. This feature could also be removed without disnipting the existin� strezi
pattern.
E. STAFF RECOMMENDATION
Based on the findings, staff recommends approval of the permit to install a traffic island at Westem and
Summit Avenues.

I am sorry that I was out of town for the discussion regazding the
pedestrian island at the corner Western and Summit Avenues. The
announcement of the meetin� came after I had left on a business trip and I
did not retum until one day after the meeting was over. Consequently, I am
appealin� the Heritage Preservation Commission's (HPC) decision at its
November 15th 2001 meetin� under Chapter 73 o the St. Paul Legislative Code.
I live at this very intersection, at 400 Summit Avenue. For almost as long
as I ha� e lived here I thou�ht that an island or roundabout was needed at
this intersection, if only because of its sheer size. But with sharp
increases in both automobile and pedestrian traffic, the need has been
growin� in recent years.
This is a very lon� and dangerous intersection. Four streets (not rivo)
intersect here (Summit, Western, Portland, and Irvine), and it is, to�ether
with the intersection just a block away at the top of Ramsey Hill, the most
busy intersection along all of Summit Avenue without a traffic li�ht. I
cannot even begin to calculate the number of times horns and screeching
brakes have been heard just outside our home.
Three city parks lie within a hundred yards or so of this intersection, and
the pedestrian traffic along the block between Western and Ramsey Street
makes it one of the most �valked blocks in the city. It strikes me as
remarkable that the city would not want to make this area as pedestrian
friendly as possible. I understand that this pedestrian island is opposed by
the HPC but safety, in my opinion, should never be sacrificed to someone's
notion of what is "historically correct." (And what makes it "historically
correct" in the first place, the fact that no island or roundabout was
constructed there in the past?) I cannot even begin to ima�ine what the
legal ramifications might be if a pedestrian were hit, or worse, even killed
at this intersection, and it were shown in court that a pedestrian island

hirned down by the HPC against the advice of the Traffic Division and
Department of Public Works could have saved a life.
Furthermore, this intersection is problematic for residents of Summit Manor
Nursin� Home which lies just several hundred feet to the north on Westem.
Residents of Summit Manor who come to stroll on Summit, often in
�vheelchairs, are confounded by the massive expanse of tke intersection and
some will not even venture to cross Summit to access Lookout Pazk. My wife
Bobbie Jo Carpenter has multiple sclerosis, and she will not cross the
intersection to Nathan Hale Park, or to Cochran Park for the feaz of
traversing such a long stretch of pavement.
When my wife and i first moved into our home the traffic on Irvine was
modest; howecer, over the course of t�velve or thirteen years, �vith the
construction of new condominiums and residences on Irvine and Pleasant, the
population on Irvine alone has gro�vn by well over 100 percent, and so
consequently the traffic. Add to this increase those seeking quick escapes
from the traffic on Ramsey Street foilowin� events at the Excel Center who
often take Pieasant to Irvine, and cross Summit to Western to access
Interstate 94. These events typically let out in darkness and the safety at
this intersection is even further compromised.
Three parks �vithin a hundred yards or so of each other makes for a
pedestrian paradise, and the stretch of Summit behveen Ramsey St. and
Westem should be as pedestrian friendly as possible. The Summit, Ramsey,
Western azea is one of the most visible and central in our beautiful city,
yet the particular Western-Summit intersection is an eyesore. A nicely
landscaped pedestrian island or roundabout �vould not only improve traffic
and pedestrian safety but would enhance the beauty of the area.

Dear Council Chairperson Bostrom:
The purpose of this letter is to express my support for the Saint Paul Pubiic Works
Department's pian to install a Pedestrian Island at the Intersection of Summit Avenue
and Western Avenue in Saint Paul. I'm sure you are aware of this intersection with four
streets merging at odd angies. I have been a resident of this historic neighborhood for
ten years and I am proud of tne three small parks boarding this busy intersection. The
only feasible way to get to Overlook Park to Nathan Hale Park to Cochran Park is by
walking.
I appauld the St Paui Public Works and especially AI Shetka for taking the initiative to
design this pedestrian island to support safty for the pedestrian while combining all
the historic guidelines as outlined by the Heritage Preservation Commission.
The Ramsey Hill Association and the Heritage Preservation Commission Board's
have voted against this proposal. Historicat area, yes it is -- but, we are not being
driven by horses anymore!! It is my hope you will vote in favor of the construction of
this pedestrian island proposed by the St Paul Public Works Department.

As a resident of Summit Avenue, and one who has many visitors and guests to
his home, I find that the pedestrian �vho walks along Summit Avenue endangers

At its October 11, 2001 regular board meeting the Ramsey Hili Association reviewed the request by the
city of Saint Paul Department of Public Works to construct an isiand at the comer of Summit and Western

community residents the RHA Board adopted a motion to oppose the installation of the traffic island
regardless of the design until all other traffic calming measures have been explored and implemented to
the fullest extent. Further, if the island and/or its design is approved by the Commission, the Association is

the island wouldn't solve the problem. Tn the meantime, historic 5ummit Avenue is going
to be blighted wilh a trafTic hazard because of one citizen's request and the detem�ination
of Public tVorks.
This intersection has beon configured this way for decades _P,�eop_1e. �who u�e t a
intersectioh krtow to use cat�tio�; they use it repeatedly an are faid niliar with it. This sa�ne
configuration is used in muitiple spots throughout the City. I ask you to not "punish" the
historic Avenue for one driver's inattentiveness and one citizen's request. There are many
