1 BE TT RESOLVED, that, upon the petition of BP Products North America, Inc., as documented in Real
2 Estate Division File Number 04-2002, publac properties hereinafter described aze hereby vacated and
3 discontinued as public property; and be it further

5 RESOLVED, that, with the accompanying Utility Easement Certificate of Intended Non-Use, filed
6 voluntarily on behalf of the Department of Public Works, made a part hereof by this reference and filed
7 in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of this departsnent, waives
8 the right to the uulity easement in the vacated area hereinafter described.

Ramsey County, Minnesota.
13 This vacation shall be subject to the terms and conditions of Chapter 130, codified Mazch 1, 1981, of the
14 Saint Paui L.egislative Code as amended, and to the following conditions:

1. That the petitioners, their successors and assigns shall pay $500.00 as an adminisuaUde fee for
this vacation which is due and payable within 60 days of the effecuve date of this resolution.
2. That the abutung property owners shall provide the City a copy of the deed transferring the
easteriy one-half of the alley, which accrues to the property to the east, to the property owner
abutting the a11ey to the west.
3. That the abutting property owners shall provide the City a copy of an easement agreement
providing for access and use of the alley by the abutung property owner to the east.
4. That the petitioners, their successars and assigns shall maintain ownership and responsibility of
the elcisting storm sewer facility located in said vacated area; this includes all maintenance and
costs and expense as needed for ongoing operauon of said storm sewer facility.
5. That, with the exception of the Department of Public Works, all utility easements shall be
retained within the vacated area to protect the interests of the uulifies, including but not limited
to, the utilities described below:

a. That a permanent utiliry easement shall be retained within the vacated area to protect the
interest of Northem States Power Company, d.b_a Xcel Energy.
4 b. That a permanent utiliry easement shall be retained within the vacated area to protect the
5 interest of Qwest Communications, Inc., and that Qwest will be abie to maintain its aerial
6 plant that is in this right-of-way on poles on the west side of the alley.
8 c. That a permanent utility easement shall be retained within the vacated area to protect the
9 interest of A. T. & T. Broadband, Inc.

6. That the petitioners, their successors and assigns agree to indemnify, defend and save hazmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, negiect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
7. That the petitioners, their successors and assigns shali, within 60 days of the effective date of this
resoluuon, file with the City Clerk an acceptance in writing of the conditions of this resolution
and shall, within the period(s) specified in the terms and condiuons of this resolution comply in
all respects with these terms and conditions.

LIEP has no objections to the proposed vacation.
As you may know, the request for vacation is part of a larger batch of approvals that BP needs to get in order to
build a new convenience store. (They also need a rezoning, zoning variances, Special Condition Use Permit and
site plan review in addition to this vacation. l think all of these will be approved.)

1 BE TT RESOLVED, that, upon the petition of BP Products North America, Inc., as documented in Real
2 Estate Division File Number 04-2002, publac properties hereinafter described aze hereby vacated and
3 discontinued as public property; and be it further

5 RESOLVED, that, with the accompanying Utility Easement Certificate of Intended Non-Use, filed
6 voluntarily on behalf of the Department of Public Works, made a part hereof by this reference and filed
7 in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of this departsnent, waives
8 the right to the uulity easement in the vacated area hereinafter described.

Ramsey County, Minnesota.
13 This vacation shall be subject to the terms and conditions of Chapter 130, codified Mazch 1, 1981, of the
14 Saint Paui L.egislative Code as amended, and to the following conditions:

1. That the petitioners, their successors and assigns shall pay $500.00 as an adminisuaUde fee for
this vacation which is due and payable within 60 days of the effecuve date of this resolution.
2. That the abutung property owners shall provide the City a copy of the deed transferring the
easteriy one-half of the alley, which accrues to the property to the east, to the property owner
abutting the a11ey to the west.
3. That the abutting property owners shall provide the City a copy of an easement agreement
providing for access and use of the alley by the abutung property owner to the east.
4. That the petitioners, their successars and assigns shall maintain ownership and responsibility of
the elcisting storm sewer facility located in said vacated area; this includes all maintenance and
costs and expense as needed for ongoing operauon of said storm sewer facility.
5. That, with the exception of the Department of Public Works, all utility easements shall be
retained within the vacated area to protect the interests of the uulifies, including but not limited
to, the utilities described below:

interest of Northem States Power Company, d.b_a Xcel Energy.

5 interest of Qwest Communications, Inc., and that Qwest will be abie to maintain its aerial
6 plant that is in this right-of-way on poles on the west side of the alley.

6. That the petitioners, their successors and assigns agree to indemnify, defend and save hazmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, negiect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
7. That the petitioners, their successors and assigns shali, within 60 days of the effective date of this
resoluuon, file with the City Clerk an acceptance in writing of the conditions of this resolution
and shall, within the period(s) specified in the terms and condiuons of this resolution comply in

LIEP has no objections to the proposed vacation.
As you may know, the request for vacation is part of a larger batch of approvals that BP needs to get in order to
build a new convenience store. (They also need a rezoning, zoning variances, Special Condition Use Permit and
site plan review in addition to this vacation. l think all of these will be approved.)
