WHEREAS, The Council of the C' ty of Saint Paul, by its
Resolution, C. F. 62815, approved ctober 29� 1925, and as
amended by its Resolution, C. F. 6 196� approved November 20,
1925, did vacate the alley in Bloc 1 of Cromwell Addition, said
vacation reserving to the City of aint Paul and other public
instrumentalities public utility e sements contained therein and
thereon; and
WHEREAS� The Council ha.s been requested to waive said re-
tained easements, and the effectiv City Departments, Northern
States Power Company and Northwest rn Bell Telephone Company
have filed written certificates of intended non-use of reserved
rights and easements, which certif'cates are attached hereto; and
be it
RESOLVED� Tha.t the Council of the City of Saint Paul� pursuant
to Section 228 .06 of the Saint Pau Legislative Code� as amended,
does hereby waive the retained eas ents contained in Resolution,
C. F. 62815, approved October 29 925, and as amended by Resolution,
C. F. 63196, approved November 2�, 1925, in the following described
property:

Honorable Council Members:
On behalf of the owners of the property involved
(Howard E. Commers and Annette F. Commers) we request that
you adopt an appropriate resolu ion releasing the easements
reserved by the terms of paragr ph (1) (the section 228
easements) which is part of you vacation resolution vacating
an alley as adopted by the Counail on October 29, 1925 (bearing
Council file No. 62815) and as a�mended on November 20, 1925 by
Council file No. 63I96. Excluded from this request is the
Easterly 37 feet of the platted ,alley in the plat of Block 1,
Cromwell Place.
With respect to the part of the alley involved in
our request it would be describ�d as follows :
All of the platted alley in Block 1 of
Cromwell Place except; the East 37 feet
thereof and except that portion directly
in the rear of Lot 10� and the West 50 feet
of Lot 9 in said Block l.
We are of the opinion that there were no public
utilities in the above-described par� of the alley in 1925.
Shortly thereafter a brick building was erected which completely
covers the above-described part of the alley. This building
is still standing. We assume that there are no public
utilities running under the building.

The legal description of Mr. and Mrs. Commers
property is as follows:
Lots one (1) , two (2) , three (3) , four (4) ,
five (5) , six (6) , seven (7) , eight (8) ,
nine (9) , eleven (11) and twelve (12) , in
Block one (1) Cromwell Place, and so much of
the vacated alley (adjacent to and bordering
on said lots) , described in resolution of the
Council of said City of St. Paul approved
November 20 , 1925, which accrued to the said
lots by said vacation, subject to the rights
of the City of 5t. Paul to a strip of land
twenty (20) feet wide along the easterly line
of said Lot one (1) , extending from the present
alley to Territorial Road and Ellis Street and
described in a deed from Dickerman Investment
Company to said City of St. Paul, dated Decem-
ber lOth, 1925 according to the plat thereof
on file and of record in the office of the
Register of Deeds in and for said Ramsey County.
The Westerly fifty (510) feet, from front to
rear, of Lot nineteen�, (19) of Auditor' s Sub-
division No. 4 , St. P�ul, Ramsey County, Minn. ,
being a tract of land fronting upon University
Avenue, in the City of St. Paul, fifty (50) feet
in width, and extending at an equal width to the
rear of said Lot ninelteen (19) , according to the
plat thereof on file and of record in the office
of the Register of De�eds in and for said Ramsey
County.
A copy of Council fil� Nos. 62815 and 63196 are
enclosed herewith.
