WHEREAS! The Council of the City of Saint Paul vacated Eaton
Street by resolution, C. F. 228666, approved Ma.y 19, 1966; and
WHEREAS� The City by previous condemnation and deed had ac-
quired a portion of Eaton Avenue by deed of conveyance, and this
pa.rt of Eaton Avenue, being vacated, is no longer needed for public
purposes; and
WHEREAS� The Port Authority of the City of Saint Paul holds
, the title to Lots 1 and 2, B1ock 23� Marsha.11' s Addition to West
Saint Paul and the said Port Authority ha.s requested that the City
release and quitclaim its interest to tha.t portion of vacated
Eaton Avenue, and the Department o� Public Works concurs in this
recommendation; now� therefore� be it
RESOLVED� That the Council of the City of Saint Paul does
hereby approve and authorize the conveyance by quit claim deed of
the following described property to the Port Authority of the City
of Saint Paul for no additional compensation because the said prop-
erty was vacated and discontinued by the City Council' s resolution,
C. F. 228666, and the City Attorney is hereby directed to record
said quit claim deed on beha.lf of the City of Saint Paul.

Ma.rsha.11's Addition to West Saint Paul, lying east of
a line 60 feet west of. .,and pa.rallel with the West line
of Block 4, Eaton and �orrison' s Addition to West Saint

Dear Mr. Marzitelli:
The Port Authority of the City of Saint Paul ha.s
entered into a contract with Thoma.s Obert, Richa.rd
Lurie and Malin Greenberg for the purpose of selling �
a pa.rcel of land located on new Plato Boulevard west
of R ert Street f or the urpose of cons an
o f ice an re a o e t -

consists of Lots 1 and 2, Block 24, Ba.zil and Robert' s
Addition to West Saint Paul and, also, Lots 1 and 2,
' Block 23, Ma.rsha.11's Ad.dition to West Saint Paul.
The City of Saint Paul vacated Eaton Avenue adjoining
this property in 1966. Upon examina.tion of title to
this property, in anticipa.tion of the sale, the City
Attorney ha.s advised the Port Authority that there
exists a deed of conveyance to the City of Saint Paul
on a portion of land tha.t was acquired for Eaton
Avenue and that in order to clear title, the City of
Saint Paul, in addition to adopting a resolution vacat-
ing Eaton Avenue, should quit claim wha.tever interest
the City ha.s in that portion of Lot 2, Block 23,
Ma.rsha.11' s Addition to West Saint Paul. To this end,
we have obtained the recommendation of the Department
of Public Works, a copy of which is attached to this
letter. We ha.ve prepa.red a resolution authorizing the

Dear Mr. Segat :
IThe St. Paul City Council did vacate Eaton Ave, from Filimore Ave.
to the southerly line of Florida St. in 1966. All that part of Lot 2,
Bloek 23, Marshatl 's Addition to West St. Paul is included as part of
this vacation received by the City of St. Paul by deed in 1884 for
Eaton Ave. and bounded and tying east of a line 60 feet west and paral-
lel with the west line of Block 4 of Eaton and Morrison's Addition.
Therefore, the Department of Public Works recommends that the City
quit claim its interest to that portion of Lot 2, Block 23, Marshall 's
Addition as per your letter dated September 4, 1973.

It is my recommendation tha.t the City Council be re-
quested to approve this quit claim deed so that the
Port Authority may convey marketable title in accordance
with their purcha.se agreement. To this end I ha.ve pre-
pa.red and attach a resolution in which the Council
would authorize the necessary quit claim deed action.
If there is any further information that I may supply,
plea�e feel free to call.
I ask that you ha.ve this ma.tter presented to the Council
as soon as possible so that we ma.y be in a position to
aid the Port Authority in closing their sale transaction
dur'ng the first week in D�ecember.
