WHEREAS? The Council granted the petition of Roy Spa.nna.us
and others to vacate and discontinue for street purposes Lot 22,
Block l, Merrill' s Division of Rice St. Villas by resolution�
C. F. 261783, adopted Ju1y 31, 1973; and
WHEREAS, The City C1erk� in accordance with Section 228 .08
of the Legislative Code, has reported tha.t the petitioner ha.s
failed to comply with the terms and conditions of the vacation
resolution and, therefore informs the Council that the vacation
resolution is nu11 and void; now, therefore, be it
RESOLVED� Tha.t in accordance with Section 228 .08 of the
Saint Paul Legislative Code and upon the failure of the petitioner
to comply with the terms and conditions set forth in vacation
of street resolution, C. F. 261783, the Council of the City of
Saint Paul does hereby rescind the vacation and discontinua.nce for
public street purposes Lot 22, Block l� Merrill's Division of Rice
St. Villas, and the City Clerk is hereby directed to transmit a
copy of this resolution to the petitioner and to all affected
City departments.
