Loder to relax setback requirements on property located on the south side of Elmwood east of Point Douglas, and further described as follows: Lots 2 and 3, Block 14, Burlington Heights, Division 2. This appeal was heard at the September 6, 1973, meeting of the Board of Zoning. The applicant is building a house with attached garage on the site. The proposed garage would violate the setback requirements in that it would be 18.5 feet instead of 38 feet from the street line. The staff report indicated that the lot is irregular in shape, steeply " sloped, and that it would be difficult to level the land to enable the structure to be set back to the required distance. Discussion by the Board indicated the members' belief that a variance would be proper in this case, since the peculiar shape and topography of the lot make compliance with the setback requirements difficult. A motion was made and seconded to recommend approval of the appeal. The motion carried unanimously. PROPOSAL: The appellant is building a house with an attached garage on the site. C. VARIANCE: The attached garage is proposed to be built in a location which will violate the legal setback. The legal setback is 38 feet and the - proposed location of the garage is about 18.5 feet from the street line. This is 19.5 feet or 51.31% short of the requirement. D. AREA ZONING: The entire area is zoned "A" Residential, except the railroad property across Highway ��61 which is zoned Heavy Industrial. E. SITE CONDITIONS: The house is being built on the site. The site is on a steep slope into which a slight cut was made to accommodate the house and garage. The remainder of the site is very wooded. F. AREA CONDITIONS: The Mississippi River Valley bluff runs in a north-south direction through the site and its surroundings.
