SCOTT DAVIES Members of the Council of the City of Saint Paul: The City Council, at its regular meeting held Tuesday, November 6, 1973, had before it for consideration the adoption of a resolution levying real estate taxes to support the 1974 Budget adopted by the City Council on October 25, 1973. The resolution proposes a tax levy of $30,333,781.00 and includes the sum of $364,814.00 for tax shrinkage, for a total tax levy in the amount of $30,698,595.00. The adopted 1974 Budget contains, in addition to expen- diture appropriations, estima.ted receipts and revenue sumcna.ries. Contained within the adopted revenue sunmla.ry is an estimated amount of tax levy necessary to support the adopted budget. The levy estimate appears on Page XIII of the adopted Budget in the same amount as set forth in the proposed tax levy resolution. The Council's consideration of the proposed tax levy resolution is continued until Tuesday, November 13, pending receipt of legal opinion to the following question: ISSUE: MAY THE CITY COUNCIL LEVY TAXES IN AN AMOUNT LESS THAN WHAT IS NEEDED TO SUPPORT THE ADOPTED 1974 BUDGET? OPINION: In accordance with Chapter 10 of the City Cha.rter, the City Council is required to adopt the City budgets on or before October 25. In accordance with Section 10.04, the budgets must conform to the following limitations: City Hali, Saint Paul, Minnesota 55102 612 298-5121 � r � � ����� �6' Members of the City Council Page Two November 12, 1973 1. The total of proposed expenditures sha.11 not exceed the total of the estimated in- come or fina.ncing provisions in each of the budgets (Section 10.04. 1) ; and 2. A portion of the annual operating budget provided by ad valorem taxes on real and personal property sha.11 not exceed the amount set forth in Section 11.03 of the Charter (Section 10.04.2) . The Budget adopted by the City Council on October 25 ha.s complied with the above two limitations in tha.t the Budget contains the necessary financing provisions in addition to the appropriations for expenditures. The answer to your question is governed by the provisions contained in Section 11.04 of the City Cha.rter which pro- vides as follows: "Certification of Tax Le . In a i ion to e amoun require to e provided, the council in the adoption of a tax levy reso- lution may include a reasonable amount for tax shrinkage. The tax levy resolution sha.11 be certified to the county auditor in accordance with law and not later than November 15 of each year." (Empha.sis added) It is our opinion tha.t the adoption of a tax levy resolu- tion by the City Council no later than November 15 of each year is a ma.ndatory provision leaving no discretion to the City Council. It is our further opinion tha.t the City Council is required to levy a tax in the same amount as set forth in the adopted Budget - revenue summa.ry. The Cha.rter imposes a mandatory obligation upon the City Council to adopt a resolution levying a tax on all tax- able real and persona.l property in the city in such . : _ ,��,��� � Members of the City Council Page Three November �2, 1973 amount tha.t will be sufficient to fund that portion of the adopted budget which is fina.nced by the estimated amount of tax revenues contained in the fina.ncing sumtna.ry of the adopted budget. The City Council ma.y not inten- tionally adopt a �ax levy which will not be sufficient to fully fina.nce its adopted budget because this would clearly violate the Charter requirement set forth in Section 10.04. 1, tha.t the City Council adopt a balanced budget. The provisions contained in Cha.pter 10 of the City Cha.rter, setting forth the authority and manner in which the adopted budget ma.y be amended, permits budget amendments only during the budget fiscal year. If the Council were to adopt the tax levy resolution in an amount less than what is necessary to fina.nce the adopted budget, the re- sult of this action would be an unbalanced budget or an amendment to the budget before the fiscal year commences. As stated above, this would constitute an indirect amend- ment to the budget in a ma.nner which the Council would be prohibited from doing in a direct ma.nner. CONCLUSION: The City Council is required to adopt a resolution levy- ing taxes in an amount sufficient to support the adopted 1974 Budget and ma.y not reduce the tax levy as a means of indirectly reducing the adopted 1974 Budget.
