WHEREAS, the City of Saint Paul has established a workable, efficient
and relatively inexpensive rate regulation procedure under its franchise
issued to Northern States Power Company for electric and gas services
supplied to the consumers of the City of Saint Paul; and
WHEREAS, the State of Minnesota is considering a bill for state
regulation of both electric and gas services of all privately owned pub-
lic utilities within the State of Minnesota, such bill now pending before
the House of itepresentatives Committee on Governmental Operations and
entitled House File #1835; and
WHEREAS, the pending legislation would have rate reg�ulation adminis-
tered by the Public Service Commission of the State of Minnesota at a cost
far in excess of what it now costs the consumer of the City of Saint Paul
with the additional prospect of loss of control over the electric and gas
rates by the consumers through their elective body, the City Council of
the City of Saint Paul; and
WHEREAS, the City Council of the City of Saint Paul did unanimously
approve a motion in its proceedings on October 26, 1973, that Thomas J.
Stearns, Public Utility Rate Expert and Assistant City Attorney, express
its disapproval of and opposition to House File ##1835; now, therefore,
be it

RESOLVED, by the City Council of the City of Saint Paul that its
proper officers are directed to advise representatives of the I�ouse of
Representatives, of the Senate, and of the Committee on Governmental
Operations of the House of Representati�r�s that the City of Saint Paul
opposes state regulation of gas and electric utility rates and opposes
the bills now pending before the legislative bodies which would afford
regulation of such rates entirely by the Public Service Commission or
any other commission created for that purpose at the level of the state
government; and further be it
RESOLVED, that if the Minnesota State Legislature should consider
approving leg�islation that will permit regulation of rates of privately
owned public utilities by administrative bodies of the State of Minne-
sota, it should either exempt the cities of the first class from such
regulation or permit the City of Saint Paul and other cities of the
first class and the surrounding communities which have joint agreements
with said cities of the first class to have the option of reg�ulating
their rates under such joint agreements or by virtue of the councils
of the cities of the first class themselves, which regulation shall be
conducted pursuant to the terms of the agreements and/or franchises
issued to privately owned public utilities, including the Northern
States Power Company.
