Dear Sir:
This is written in response to the application of Construction 70 for a
permit for a fast food restaurant on property located on the southwest
corner of Edmund and Snelling and further described as follows:
Lots 1-3, Block 2, R. B. Thompson's Addition; Lots 1-4, Block
1, Stierle, McConville & Seeger's Midway Addition.
This matter was heard at the September 6, 1973, Zoning Board public
hearing at which time the staff outlined the changes that would be needed.
The applicant briefly explained the proposal.
Mr. Merrill Robinson, representing the Hamline Community Association, said
his organization has a policy of opposing fast food restaurants. He said
if it must be allowed he would like to see a 6-foot fence and landscaping
between it and the residence to the west. The applicant agreed to change
his plans accordingly.
The Board heard a motion to recommend approval subject to staff recommenda-
tions. The motion was seconded and carried unanimously.
Subsequently, plans showing a 6-foot fence and trees buffering residential
property were received September 11, 1973.

1952 but was cancelled when that facility was never built. A permit for a

granted in 1956 for a portion of the site and a similar permit covering
a larger portion was granted in 1957. A permit for a revision was issued
in 1960.
B. AREA ZONING: Snelling Avenue frontage is zoned Co�nercial. The area west
of Snelling south of_ the alley between Edmund and Thomas Avenues is zoned
"C" Residential. The area north of this district is "B" Residential.
C. DESIGN STANDARDS: Revised plans dated September 11, 1973, meet design
standards.
D. FRONTAGE AND AREA: The site has a frontage of 183.8 feet along Snelling
Avenue and a depth of 125.72 feet for an area of 23,107.34 sq. ft.
E. SITE CONDITIONS: The portion of the site proposed for the drive-in contains
a number of gas pumps. The portion of the site covered by the legal
deacription not proposed for the drive-in is a car wash building. The previous
access to this building will be cut off by the drive-in development.
F. AREA CONDITIONS: Snelling and University frontages are developed cammercially.

Dear Sir:
This is written in response to the appeal of Leonard and Dolores
Dochniak to relax setback requirements on property located on the
southeast corner of Jessamine and Cypress, and further described as
follows:
� Lot 15, Block 13, Eastville Heights Addition.
This matter was heard before the Board of Zoning at its meeting on
August 30, 1973. The appeal requested that the setback requirements
for the premises in question be relaxed in order to enable the
applicant to build a porch on the front of his home, which would be
7-1/2 feet from the street line.
The applicant pointed out that the variance in setback would mean
only that the house in question would be as close to the street as
the other homes on the block. The applicant also stated that the
traffic sig�it line would not be impeded by the granting of the
variance, since the building on the opposite corner of the intersection
is closer to the street line than the applicant's house would be, and
that building does not impede traffic sig�it lines. No one appeared in
opposition to the request.
A motion was heard and seconded to recoBanend granting the request.
The motion passed unanimously.
