Dear Sir:
This is written in response to the appeal of Leonard and Dolores
Dochniak to relax setback requirements on property located on the
southeast corner of Jessamine and Cypress, and further described as
follows:
Lot 15, Block 13, Eastville Heights Addition.
This matter was heard before the Board of Zoning at its meeting on
August 30, 1973. The appeal requested that the setback requirements
for the premises in question be relaxed i�. order to enable the
applicant to build a porch on the front of his home, which would be
� 7-1/2 feet from the street line.
The applicant pointed out that the variance in setback would mean
only that the house in question would be as close to the street as
the other homes on the block. The applicant also stated that the
traffic sig�it line would not be impeded by the granting of the
variance, since the building on the opposite corner of the intersection
is closer to the street line than the applicant's house would be, and
that building does not impede traffic sight lines. No one appeared in
opposition to the request.
A motion was heard and seconded to reconnnend granting the request.
The motion passed unanimously.

A. HISTORY: There is no zoning history for this site.
B. PROPOSAL: The appellant proposes to build a porch on his house to 7-1/2 feet
from the street line.
C. VARIANCE: The legal setback for this block face is 12 feet, so the proposed
porch would be 4.5 feet or 37.5% beyond the legal setback.
D. AREA ZONING: Commercial zoning exists along Earl Street, which is one
block east and also along Forest Street, which is one block west. "A"
Residential zoning exists 1/2 block northward and beyond. The rest of the
area is zoned "B" Residential.
E. SITE CONDITIONS: The site is occupied by a two story frame house in good
condition, wherefrom a porch has been removed. It is a corner lot.
F. _ AREA CONDITIONS: The site is surrounded by homes similar to it. Harrison
School exists on the block across Cypress.
