This permit is made expressly subject to all of the con- ditions contained in Section 60.21 of the Saint Paul Legislative Code. 3 . Tha.t the permittee shall ma.intain a ten-faot berfn between the property line and the edge of the excavation at the street grade. 4. The staff explained that this matter had been approved by the City Council and that thereafter a letter from the Director of Public Works was received which indicated certain fencing was required and that the excavation should remain 10 feet in distance from the street line. SITE CONDITIONS: The site has a stone quarry about 10 to 15 feet deep and with tailings piled approximately S to 10 feet high around its edge. A slat type snow fence surrounds the quarry. F. AREA CONDITIONS: The IBrI Campany parking lot exists beyond vacant land to the west. Mixed residential, Co�ercial and Light Industrial uses exist west of Davern Street. The quarrying actually was in operation late last fall without a permit, and upon being brought to our attention, we requested that all activity cease. The situation at that time was detailed in a letter to the Minnesota Historical Society, the contracting agency. A copy of that letter is attached for your fu�ther information. McGough has submitted a copy of a report on what appears to be a cursory study of the situation by Twin City Testing and Engineering Laboratory, Inc. Upon review of this report, Public Works is still � not convinced that th� quarrying operation is safe. Our concern is with Shepard Road: the caves under the quarrying operation extend to under Sheparc. Road, and the location of at least one fault line in the rock through the caves and across Shepard Road is known. There was a collapse of a cave roof up to the limestone, under Shepard Road, shortiy after it was opened to traffic. Furthermore, the mouths of all 12 cave entrances had eroded upward and back into the caves under Shepard Road. One entrance had even eroded up to the limestone before we filled and sealed it. The thickness of the limestone strata under Shepard Road is not necessarily the same as under the quarrying site. _ . . The Board of Zoning -2- March 26, 1973 The Department of Pubiic Werks recommends that the Minnesota Historical Society have a more extensive engineering and geological investigation rnade, by Twin City Test or an equaliy qualified soils engineering firm, and the resulting report analyzed by our Department as well as the Zoning Board. We would then anticipate being requested and able to make a recom- mendation on the� permit request. If no further study is made, we recommend that the attached application for a quarrying permit be denied. Addi.tionally attached is a copy of a letter sent to the City Clerk.
