RESOLVED, That the Council of the City of Saint Paul does here-
by approve application of McGough Construction Company for a permit
to excavate on property on the North side of Shepa.rd Road between
Davern and Snelling Avenues, the description being more fully set
forth in the application, which said application is on file in the
Office of the City Clerk and ma.de a part of this resolution, the
application ha.ving been referred to the Board of Zoning for exam-
ina.tion and report to the City Council on its decision as required
by Section 60.20 of the Saint Paul Legislative Code, this permit
being issued and granted subject expressly to the following
conditions:
1. The permittee shall file a $5,000.00 surety bond conditioned
for the full and faithful performance of all the terms and
conditions set forth in Sections 60.20 anc� 60.21 of the
Saint Paul Legislative Code.
2 . This permit is made expressly subject to all of the con-
ditions contained in Section 60.21 of the Saint Paul
Legislative Code.
3 . Tha.t the permittee shall ma.intain a ten-faot berfn between
the property line and the edge of the excavation at the
street grade.
4. Tha.t a fence be provided to enclose the excavation for the
protection of the general public of a type approved by the
Depa.rtment of Public Works .

Dear Sir:
This is written in response to the applicatio� of McGough Construction
Company, Inc. for a permit to excavate on prop�rty located on the
north side of Shepard Road between Davern and Sn��ling, and further
described by the legal description on file.
This matter was heard by the Board of Zoning on August t�, 1973, the
date for reconsideration of those matters heard by the previous Board when
it was not properly constituted. (This matter was heard by the previous
Board on June 21, 1973.) The staff explained that this matter had been
approved by the City Council and that thereafter a letter from the
Director of Public Works was received which indicated certain fencing
was required and that the excavation should remain 10 feet in distance
from the street line. "
The Board acted to recommend approval by a unanimous vote.

Th1s letter is written in response to your June 5, 1973 request for recom-
mendation on the application of McGough Construction Company's quarrying
operation at the referenced location. We have received sufficient assurance
from Twin City Testing Company, a consulting soils engineering firm, that
the structural stability of Shepard Road wiil not be affected by the quar-
rying ope�ation.
In reference to the various requirements under Section 60.21 of the St.
Paul Legislative Code, we offer the following recommendations.
(2). We suggest that the City Council reserve its right to require
cross-sections of the excavation.
(4). We suggest that the ten foot berm beta�een the property line and
the edge of the excavation at the street grade be maintained.
�5)• We recommend that a fence be provided to enclose the excavation
for the protection of the general public.

Construction Co., Inc.) are asking for a permit to quarry stone
to be used in the restoration of Old Fort Snelling. The legal

A. HISTORY: There is no zoning history for this site.
B. AREA ZONING: There is a Coammercial district north of Stewart east of Davern.
East of that is a "C" Residential district. Northeast of the site is a "B"
Residential district. A small "C" Residential district exists immediately
east. Unassigned land lies south of Shepard Road. Light Industrial zoning
extends westward across Davern to West 7th Boulevard, north of which is
Co�ercial, "C" Residential and "A" Residential zoning.
C. STANDARDS: The applicant states that the quarry will be leveled to the grade
of adjacent property upon completion of the quarrying operation.
D. FRONTAGE AND AREA: The site has a frontage of about 500 feet along Stewart
Avenue and along Shepard Road, for an area of about 169,600 sq. ft.
E. SITE CONDITIONS: The site has a stone quarry about 10 to 15 feet deep and with
tailings piled approximately S to 10 feet high around its edge. A slat type
snow fence surrounds the quarry.
F. AREA CONDITIONS: The IBrI Campany parking lot exists beyond vacant land to the
west. Mixed residential, Co�ercial and Light Industrial uses exist west of
Davern Street. The WLOL station and transmitter exist east of Davern, north of
which are retail uses. An apartxnent development exists north of Stewart Avenue
directly to the north of the subject site. Single family and duplex units exist
northeast of the site and several apartments are directly east of the subject
site. Shepard Road is to the south, beyond which is the Mississippi River Valley.

Gentlemen:
Attached is an application for permit to quarry stone, submitted
to the City Clerk by McGough Construct'ton Company, Inc. and for-
4�arded to °�.�blic W.r':s for rs��t�::.. !!ron examination, it appear�
that Chapter 4b2 of the St. Paul Legislative Code does not apply
in this instance, and therefo�e, we a�e transmitting the appiica-
tion to the Board of Zoning as specified In Sections 60.20 and 60.2i
of the St. Paul Legislative Code.
The quarrying actually was in operation late last fall without a
permit, and upon being brought to our attention, we requested that
all activity cease. The situation at that time was detailed in a
letter to the Minnesota Historical Society, the contracting agency.
A copy of that letter is attached for your fu�ther information.
McGough has submitted a copy of a report on what appears to be a
cursory study of the situation by Twin City Testing and Engineering
Laboratory, Inc. Upon review of this report, Public Works is still �
not convinced that th� quarrying operation is safe. Our concern is
with Shepard Road: the caves under the quarrying operation extend
to under Sheparc. Road, and the location of at least one fault line
in the rock through the caves and across Shepard Road is known.
There was a collapse of a cave roof up to the limestone, under Shepard
Road, shortiy after it was opened to traffic. Furthermore, the mouths
of all 12 cave entrances had eroded upward and back into the caves
under Shepard Road. One entrance had even eroded up to the limestone
before we filled and sealed it. The thickness of the limestone strata
under Shepard Road is not necessarily the same as under the quarrying
site.

The Department of Pubiic Werks recommends that the Minnesota Historical
Society have a more extensive engineering and geological investigation
rnade, by Twin City Test or an equaliy qualified soils engineering firm,
and the resulting report analyzed by our Department as well as the Zoning
Board. We would then anticipate being requested and able to make a recom-
mendation on the� permit request. If no further study is made, we recommend
that the attached application for a quarrying permit be denied.
