262370 WHITE - CITY CLERK COUILCll /�/�� /� rPINK r- FINANCE GITY OF SAINT PAUL y CANARY - DEPARTMENT lY' h� 1 BL�rUE -��IAYOR File NO. � Council Resolution � Presented By Referred To Committee: Date Out of Committee By Date WHEREAS, the State Legislature in the 1957 Session did pass an Act described as Laws of Minnesota for 1957 , Chapter 812, which law created new powers and duties in addition to those duties already possessed by the Port Authority of the City of Saint Paul, said powers and duties consisting of the creation and development of industrial development districts within the City of Saint Paul by such Port Authority in line with the newly added duties and responsibilities referred to, and specifically granting authority to said Port Authority to make a budget for its operations in the industrial develop- ment field under said new Act and granting the power to said Port Authority to request the City Council to levy such taxes for such purposes; and WHEREAS, the Port Authority of the City of Saint Paul has informed the Council that it has prepared and made its budget for industrial development operations in i9.74 under and pursuant to the provisions of the Laws of the State of Minnesota for 1957, Chapter 812 , and that said budget for industrial develop- ment is in. the amount of $130,000 ; and WHEREAS, the said Port Authority has filed with this Council a certified copy of the resolution passed by said Port Authority reauesting that under said law the City Council levy as taxes for the benefit of and expenditure for industrial development by said Port Authority of said amount, and that there be imposed upon the property legally taxable in the City a levy sufficient to produce the amount of $130, 000; now, therefore, be it RESOLVED, That under and pursuant to said law referred to, Laws of Minnesota for 1957 , Chapter 812 , and for the purpose of making available said sum of $130,000 for the support of COUNCILMEIV Yeas �er Nays Requested by Department of: Konopatzki [n Favor Levine Meredith Against BY �c�a Roedler Tedesco Mme.President � I'�1I1't Form Approved by City Attorney Adopted by Council: Date . ' Council Resolution Presented By Referred To Committee: Date Out of Committee By Date Page 2 . the industrial development program of said Port Authority of the City of Saint Paul, and subject to the maximum legal tax levy provided in said law, there be and is hereby levied for the support of said Port Authority of the City of Saint Paul on all property taxable therefor in said City, a tax for the year 1973 , collectible in 1974, sufficient to produce the amount of $130,000 as set forth in the budget of the Port Authority of the City of Saint Paul and duly made of record in the minutes of the meeting of said Port Authority of the City of Saint Paul ; and be it FURTHER RESOLVED, That said amount is to be levied subject to the provisions of Minnesota Statutes 458 .199 authorizing 35/100 of one mill upon the dollar of the assessed valuation of all taxable property in said City (excluding money and credits) , together with adjustment for untaxed personal property as authorized by Minnesota Statutes, Section 272 .64, adjustment for homestead exemptions on real property as authorized by Minnesota Statutes, Section 273, 13 (7a) , and adjustment for sales tax replacements as authorized by the Tax Reform and Relief Act of 1967, Laws 1967 Extra Session, Chapter 32 , and particularly provided for in Articles XV and XVI of said Act; and be it FINALLY RESOLVED, That the City Clerk is directed to certify a copy of the tax levy as aforesaid for the year 1973 collectible in the year 1974, to the County Auditor of Ramsey County, immediately upon adoption and approval of this Resolution. SCOTT DAVIES August 28, 1973 Members of the Council of the City of Saint Paul City Clerk's Office 386 City Ha11 HONORABLE NfEMBERS OF THE CITY COUNCIL On August 21, 1973, the Port Authority of the City of Saint Paul passed Resolution No , 841, a copy of which is on file with the City Clerk which in effect requests the City Council to levy taxes for the benefit of and expenditures by the Port Authority of the City of Saint Paul pursuant to Minnesota Statutes 458 , 199. This request by the Port Authority and the subsequent Resolution passed by the Saint Paul City Council is done annually. It is requested that the City Council place this Resolution on its agenda as soon as possible. For purposes of information it should be pointed out that Minnesota Statutes 458 . 199 authorizes the City Council to levy taxes for the benefit of and expenditure by the Port Authority not exceeding in any one year an amount ec{ual to 35/100 of one mill upon the dollar of the assessed valuation thereof upon all the taxable property in the City of Saint Paul , excluding money and credits and that any money levied for such purpose shall be paid over by the County Treasurer to the Treasurer of the Saint Paul Port Authority for the expenditure by the Port Authority as in its judgment best serves the public interest in carrying on and executing the duties of the Port Authority in creating industrial development districts . The statute specifically provides that such tax levy shall be in addition to and in excess of any limitation upon the amount that the City of Saint Pau1 is otherwise permitted by law to levy as taxes .
