1 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the
2 subject of noise in the City of Saint Paul; and
4 WHEREAS, §293.11 provides for the granting of variances from the sound level
5 limitations contained in §293.09, upon a finding by the City Council that full compiiance with
6 Chapter 293 would constitute an unreasonable hardship on an applicant, other persons or on the
7 coxrimunity; and

WHEREAS, the University of Saint Thomas STAR organization., represented by Megan
Peterson and Amy Graff, Converts Intern and Assistant Director of Campus Life, who have been
designated as the responsible persons on the application, has applied for a variance to allow live
music at Midway Stadium, 1771 Energy Park Drive, on May 3, 2002; and
WHEREAS, applicant is seeking a variance for the hours of 5:30 p.m. to 930 p.m.; and
WHEREAS, if applicant is not granted a variance it will not be able to present the concert
for St. Thomas students, faculty and staff; and
WHEREAS, the Office of License, Inspections, and Environmental Protection has
reviewed the application and has made recommendations regazding conditions for the variance;
now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance for May
3, 2002 to the University of St. Thomas STAR organization., subject to the following conditions:

The variance shall be for the hours of 530 p.m. to 9:30 p.m. on
May 3, 2002.
All electronically powered equipment used in conjunction with the
event shall not exceed 95 dBA as measured at the closer of the
sound mix or at a distance of 50 feet from the front of the stage.

f� A�The applicant shall provide personnel and equipment who shali
3 provide continuous sound level monitoring between 530 p.m. and
4 9:30 p.m. on July 26, 2001 to ensure compliance with Condition
5 #2.

8 or sunilar devices shall be turned off no later than 9:30 pm.

Live Outdoor Band Concert at Midway Stadium
Attached is a sound level variance application from Megan Petersen and Amy Graff,
representing the University of St. Thomas STAR Organization, 2115 Summit Avenue,
Mail #4024, Saint Paul, 55105, to allow a band concert on an outdoor stage at Midway
Stadium, 1771 Energy Park Drive. A variance is requested from 530 p.m. to 9:30 pm. on
May 3, 2002.
Also attached is a copy of the Public Hearing Notice which will be sent to property
owners within 200 feet of 1771 Energy Park Drive.
