WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
��
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council' that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Ramsey County Public Works Department,
represented by James Tolaas, Project Engineer, who has been
designated as the responsible person on the application, has
applied for a variance to allow construction work to take place
on the Ford Bridge over the Mississippi river, during the period
from May 1, 2002 through December 1,2004; and
WHEREAS, applicant is seeking a variance for the hours of
7:00 a.m. to 7:00 p.m. from Monday through Saturday during the
course of the project; and
WHEREAS, i£ applicant is not granted a variance it will not
be able to perform the necessary construction work on the bridge
in a timely manner, and the completion date would be extended,�
causing increased costs and inconvenience to the public; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding issuing the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance for the Ramsey County Public Works Department
to permit construction work on the Ford Bridge to exceed the
sound level requirements of Chapter 293 on Monday through
Saturday, beginning May 1, 2002 and continuing through December
1, 2004.
1) The variance shall be for the hours between
7:00 a.m. and 7:00 p.m. and shall permit
construction equipment and machinery to
operate during those hours without the
limitations set forth in Chapter 293.

2) Ramsey County Public Works Department shall

3 periods which do not otherwise unduly hinder
4 the project or unreasonably increase the

7 3) The Saint Paul City Council reserves the right to

9 complaints about the noise being created and to
10 amend or revoke the variance.

Bridge Construction on Ford Bridge
Attached is a sound level variance application from James Tolaas, Project Engineer for
Ramsey County Public Works, 3377 North Rice Street, Shoreview, MN 5512b, to allow
work equipment such as concrete saws, concrete pauers, jackhaminers, barges, cranes, and
tandem hucks, to operate from 7:00 a.m. to 7:00 p.m. Monday through Saturday during
construction on the Ford Bridge over the Mississippi River. The variance for the work is
requested from May 1, 2002 to December 1, 2004.
Also attached is a copy of the Public Hearing Notice sent to property owners within 200
feet of the Ford Bridge.
