That a permanent utility easement shall be retained within the vacated area to protect the interest
of Northem States Power Company, d.b.a. Xcel Energy.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of Qwest Communication, Inc.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from a11 suits, actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a ciaim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims ar liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
all respects with these texms and conditions.

On Wednesday, February 27, 2002 the �and Use Task Force of the District 6
Pianning Council discussed this issue and would encourage denial of the
application for the following reasons:
A. It is in direct conflict with the Arlington(Jackson Small Area Plan
which is part of the city's comp plan.
B. Its close proximity to the Trillium site which is being developed as
a nature preserve.
C. The applicant is not in compliance with restrictions that are on his
license regarding the amount of cars currently allowed on the site.

The District 6 Planning Council received your {etter regarding vacation
inquiry File #07-2002 (Maryland Ave. Auto Sales)
On Wednesday, February 27, 2002 the �and Use Task Force of the District 6
Pianning Council discussed this issue and would encourage denial of the
application for the following reasons:
A. It is in direct conflict with the Arlington(Jackson Small Area Plan
which is part of the city's comp plan.
B. Its close proximity to the Trillium site which is being developed as
a nature preserve.
C. The applicant is not in compliance with restrictions that are on his
license regarding the amount of cars currently allowed on the site.
