The Redevelopment Agraement by and among the City of Saint Paul, its HRA, and Centex defines Chestnut Plaza as the area which is 75 feet on either side of the center line of Chestnut Street. Section 5.13 of the Redevelopment Agreement provides that Centex is to dedicate all of Chestmrt Plaza to the public. Portions of Chestnut Plaza are currently owned by the City; other portions of Chestnut Plaza are owned by the HRA. In addition to current Chestnut Street, parts of Chestnut Plaza aze encumbered by easements for public road rights-of-way and utilities. The part of Chestnut Plaza that is northeasterly of Chestnut Street has been excluded from the preliminary plat of the Upper Landing Urban Village and, accordingly, is not subject to any request to vacate any streets, alleys, or public easements within that area. The plat, however, xiL ir_!ede *.he portion of Chestnn± Plaza hzt :ies sonthvesterly : Ches±r.u* SYree±. Ln a3ditior., we are also requesting that the public easements and streets rights-of-way lying within the southwesterly portion of Chestnut Plaza be vacated. We are not requesting that any part of Chestnut Street be vacated. We anticipate that Centex will close with the HRA prior to the Ume when the plat is of record. Given the fact that the parties and the Redevelopment Agreement have always anticipated that Chestnut Plaza would be dedicated to the public for public use, we have no obj ection to keepin all of Chestnut Plaza in public ownership. We would expect, of course, that the City and the HRA cooperate with Centex in the development and construction of Chestnut Plaza. The City and the HRA will also need to add their signatures to the plat since both the City and the HRA will be owners of property included within the new plat. ltT" C- .. .... 0-38 FREDRIKSON & BYRON, P.A. Attarnrys andAdsnsors Tim Agness City of St. Paul Parks and Recreation Apri14,2002 Page 2 By proceeding in this fashion, we believe that we will help assuage your concerns about ownership of the southwesterly portion of Chesmut Plaza upon vacation of the easements and street rights of way. With this in mind, I understand that the Department of Parks and Recreation will have no further objections to the proposed resolution to vacate streets and alleys and that you will "sign off' with Real Estate on the vacation resolutions.
