No. 260135 approved November 18, 1g72 and C.F. No. 260886 approved March 23, 1973, did authorize the Department of Public Works to issue permits to Foley Brothers, Inc. , 450 Endicott Building, St. Paul , Minnesota, 55101 , to operate stone crushing machinery pursuant to Chapter 462 of the St. Paul Legislative Code, in connection with the construction of i-94 from Plum St. to Kennard St. kno+�m State ProJect No. 6283-45 �94 = 392) ; and WHEREAS, Said Fotey Brothers, Inc. , has requested an additional permit; now therefore, be it hereby RESOLVED, That the Department of Public Works is hereby authorized to issue to Foley Brothers, Inc. a permit to quarry stone and operate stone crushing machinery within the right-of-way of Trunk Highway No. 61 within the corporate limits of the City of St. Paul , subJect to the following terms and condttions: i . Permittee shall comply with all the provisions of Chapter 462 of the St. � Paul Legislative Code. Permittee shall deliver the $5,000.00 surety bond required under Section 462.03 to the" Office Engineer of the Department of Public Works for approval by the City Attorney and transmittal to the Department of Finance and Management Services. No permit shall be issued untess and until an approved bond is on file in the Department of Finance and Management Services. 2. Permittee shall pay the cost of pubiication of this Resolution. x 3. Permittee shall place and operate its stone crushing machinery in strict accordance with the foilowi�g described tocations, dates and tirt�es: Location: Northerly site limit - 100' north of Oid Hudson Road. Re: Construction of I-g4 - Plum � Street to Kennard Street, � S.P. 6283-45 (94 = 392) Dear Mayor Cohen: Attached is a proposed Resolution authorizing the Department of Public Works to issue a permit to Foley Brothers, Inc. , the prime contractor for the Minnesota Highway Department's referenced construction, to operate stone crushing machinery on Trunk Highway No. 61 right-of-way near Old Nudson Road and Birmingham Street. The proposed location is adJacent to and northeasterly of the location used to crush rock by authorization of the Council by Resolution, Council File No. 260886 approved March 23, 1973 (copy attached) . The contractor has requested this third permit to crush rock to enable him to crush the existing concrete retaining wall near the Earl Street bridge and use the agre- gate thereby obtain for further construction. To date, the Department has received no complaints on the contractor's first two permits.
