Committee: Date A RESOLUTION AMENDING COUNCIL FILE NO. 02-268 BY ADDING LANGUAGE DIItECTING CITY STAFF TO FOLLOW MINN. STAT. § 15.99 AND TO PROVIDE EXCEPTIONS FOR CERTATN PRO7ECTS WHICH WOULD BE CONSISTENT WITH PROPOSED POLICIES AND OFFICIAL CONTROLS. AMENDMENTS ARE UNDERLINED 9 10 11 12 13 14 15 16 17 18 19 2Q 21 22 23 24 25 26 27 28 29 30 31 32 WHEREAS, the City Council, on October 3, 2001 (File #O1-1013), requested that the Saint Paul Planning Commission conduct a study of the development issues on Irvine Avenue related to its unique bluff-side location, steep slopes, drainage issues, narrow road widths and isolation from the city's main street grid and make recommendations, within six months, on appropriate development policies and zoning controls; and WHEREAS, a Plazuiing Commission task force has completed work on a series of recommendations including proposed amendments to the City's comprehensive municipal plan and to its official zoning controls within the Irvine Avenue Study Area; and WHEREAS, the Plauning Commission and then the City Council wili be reviewing and acting upon those recommendations in a manner established by statute, ordinance and policy, including providing sufficient notice for such public hearings as may be required; and WHEREAS, development within the Irvine Avenue Study Area while those recommendations are under consideration by the Plamiing Commission and City Council could result in land uses that would not be consistent with the proposed policies and official zoning controls; and WHEREAS, because of the potential negative impacts of additional development in the area on the general health, welfare and safety of the community , the Councii of the City of Saint Paul desires to immediately temporarily prohibit development on any pazcel of land or part thereof within the area of the Irvine Avenue Study until such time as the aforementioned recommendations can be acted upon by the Council of the City of Saint Paui; 33 NOW, THEREFORE, BE iT RESOLVED, that under a separate interim ordinance, the Council 34 of the City of Saint Paul will prohibit, on any parcel of land or part thereof within the area of the 35 Irvine Avenue Study, the issuance of plan approvals, lot splits or building and zoning permits 36 until the expirarion of six months as provided in Minn Stat. 462.355, Subd.
