02-329� � sS � P t � � � p }� � f � �.a 1 C `ad' i �, .�`� � Council File # O e�.� 3 pZ 9 Green Sheet # � 0 0� S 6 RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By Referred To Committee: Date 1 WHEREAS, the Ciry of Saint Paul contracts with various health benefit providers to 2 provide benefits for Ciry employees and retiress; and 3 4 � � 1 WHEREAS, the City of Saint Paul is required by bargaining unit contracts, City Council Resolutions and City policies to provide said benefits; and WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, for such a purpose will facilitate and allow the Ciry to provide such benefits, now therefore, be it RESOLVED, City officials have the authority to enter into contracts with health benefit providers to comply with bargauring unit contracts, City Council Resolutions, and City policies and, be it, 11 FURTHER RESOLVED that the Saint Paul City Council on behalf of the City of Saint 12 Paul hereby agrees to defend, indemnify and hold harmless the various health benefit providers 13 that the City enters into contracts with, from any and all damages they may be required to pay 14 as a result of suits, claims, actions or judgments arising out of the City's contract with said 15 health benefit provider; and 16 FINALLY RESOLVED, that nothing in the faregoing provisions shall be construed as 17 a waiver of the municipal tort liability lunits or the municipal defenses or immunities set forth 18 in Minnesota Statute Chapter 466.
