STAFF PRESENT: 7ohn Hazdwick, LIEP (Licensing, Inspecfions, Environmental Protection); Kristine Schweinler, LIEP The meeting was called to order at 10:02 a.m. Gerry Strathman stated this meeting is being held to hear objections raised to the license application submitted by Insurance Auto Aucrions, Inc. Kristine Schweinler reported this is a second hand dealer-motor vehicle license application by Insurance Auto Auctions, Inc. at 1336 Jackson Street. Fire has approved this license application. Zoning has not approved it pending a final inspection. Licensing would approve after zoning has done their final inspection. Ms. Schweinler stated there are issues that need resolving: 1) a site plan is needed showing where the motor vehicles will be parked, customers parking, and employee pazking; 2) LIEP has Brach's Auto Parts, Inc. currenfly licensed at this site, which is a motor vehicle salvage dealer. LIEP needs to know if that operation will continue. She has concerns about issuing two licenses to the same location; 3) All of the applicants live out of the state: two are from Illinois and one from California. She would like to know how the business will work with such a distance from the license handlers. Gerry Strathman asked what the area is zoned. John Hardwick reported he is represenfing the zoning admnustrator. The properiy is zoned I-2, which is a heavily industrial zone. Motor vehicle salvage is a permitted use, but it requires a special use pernut from the City Planning Commission. Auto dealership is a permitted use without special conditions other than a normal site plan review process. Mr. Hazdwick stated he is not clear if this application is accessory to the salvage operation or a separate business. The salvage operation does not have a special condition use pernut, but it was established before the special condition use pernut was required. Any expansion of that salvage operation would need a special condition use permit from the Plauniug Commission. Carol Kusnierek, 54 Geranium Avenue West, Co-Chair of the District 6 Pianning Council, Vice Chair of their Land Use Task Force, appeared and stated the Task Force denied the license application at the Februa.ry 27 meeting because there were several concerns. Principally, the usage does not conform to the Arlina on Jackson Sma11 Area Plan, which has been adopted as part of the City's comprehensive plan. They also have environmental concerns related to the City's future plans for traiis that will nui through the area. They are concerned that no one from Insurance Auto Auctions appeared at their mee6ng to answer questions. Verna Gilson, 57 Magnolia Avenue East, appeared and stated she is on the Land Use Task Force of the District 6 Planning Council. Insurance Auto Auctions does not fit in with the long range plan for the area. There are 41 auto businesses in the area. The Jackson Arlington Small Area Plan is part of the City's comprehensive plan adopted in 1991. According to that plan, Jackson Street to I-35 and Arlington to Maryland was to be developed in phases. Phase 1 has already been done on the eastern section of the property. " Mr. Strathman asked is this a Port Authority development. Ms. Jungwirth responded yes. The plan is to build office warehouse, office showroom, and some retail in this azea That was considered the highest and best use because it would bring in the greatest number of jobs for the area. The estimated jobs would be 1500. For the amount of land they use, operations like junk yards, salvage yazds, and car sales do not give the rehun on properry tases and jobs for the area. Is this property in Phase 2 or 3, asked Mr. Stratl�man. Ms. Jungwirth responded she is not certain where they divided the phasing. Last year, the City adopted the Trout Brook North Phalen Greenway Pian. This site includes the Trout Brook which also falls into the DNT metro greenway plan, which the City comprehensive plan has adopted also. That leads into other concerns: are the vehicles on prepared surface, is there runoff. The zoning now is I-2, but the City will eventually be addressing zoning along the greenway from the river all the way to Larpenteur. Another issue is safety; where cars will be pazked is part of that. When it was the salvage yazd, there was a blind approach in the azea. It was very unsafe. Mr. Sirathxnan asked when the Port Authority plans to redevelop the site. Ms. Jungwirth responded the District Council is hoping to deal with that more. The City just participated in the Met Council Mississippi Riverfront. The greenway was included in the City's proposal. This was just a few weeks ago. The City just submitted a grant to proceed with the greenway in that area to get it restored, put trails in, and add native plantings. Mr. Strathman suuunarized the Ciry has plans for this properry which are inconsistent with this usage, but the plans are not imminent. There have been vehicles there during the week now. The following appeared: Roger Behrens, 90 Seventh Street South, Minneapolis, representing Insurance Auto Auctions; Jeff Zupec, 1280 7ackson Street, branch manager of Insurance Auto Auctions; and Sidney Kerley, 850 Algorquin Road, Shauxnburg, Illinois, Vice President and Corporate Counsel of Insurance Auto Auctions. Mr. Behrens stated Insurance Auto Auctions has a license for 1280 Jackson Street, which is right next to 1336 Jackson Street. They have already received their state license far 1336 Jackson Street. These vehicles aze not dismantled; they are just pazked at the facility. Insurance Auto Auction works prnnarily for insurance companies. If a car has been deemed a total loss due to an accident and the claunant has been paid for the loss, the insurance companies calls Insurance Auto Aucrions who retdeves the vebicles from the body shop or tow yards, and brings them to this facility. This is where they are parked, stored, inventoried and secured until they receive a title from the insured or claimant. Then, they auction the vehicles electronically through the� Internet site. They do not repair; vehicles are sold as is. Then, customers retrieve those vehicles. Their major customer is the insurance industry. Buyers are dealers in Minnesota and the four state azea, body shops and repair facilities around the state. Mr. Stratlunan asked wi11 there be any salvage aperation. Mr. Zupec responded there will be no dismantling nor repairing of vehicles in either location. They aze stored until the sa1e. Mr. Strathman asked about pazking. Mr. Zupec responded there are no Saturday operarions at this location. It is not retail customers coming into their facility; these are professional buyers from the four state area. The customers come in and out throughout the week. There is ample parking in front of the building. Mr. Strathman asked who in the state is responsible. Mr. Zupec responded he is the branch manager for the two facilities and Minnesota operations. He answers to the corporate office in Illinois. He is the responsible person on site. Mr. Strathxnan asked how long the lease is for. Mr. Zupec responded it is a five yeaz lease. Mr. Hardwick asked are there junk vehicles there now. Mr. Zupec responded the junk vehicles have been removed. Ms. 7ungwirth asked is this business affiliated with 1280 Jackson Street and Twin City Wrecker. Mr. Zupec responded they have nothing to do with either business. Their landlord operates Twin City Wrecker Sales at 1280 Jackson, but they are not affiliated with them. Behveen 1280 Jackson and the wrecker across the street, stated Ms. Jungwirth, there is a lot of wrecker traffic. At 1280 Jackson, there aze problems with theft and vandalism. They aze the only azea in the City that has the junk cazs. Mr. Kerley stated he would like to address some of the issues raised in terms of ownership and people living out of state. He is a corporate officer based in Illinois. Even though they aze out of state, they aze very responsible as to what goes on in their facilities. They have 621ocations nationwide. He flew in just to attend this meeting. As for the meeting at District 6 Plauniug Council, he was not aware of it. He definitely would have liked to attend the meeting to answer any questions and concerns. Insurance Auto Auction does provide a public service: accidents happen, vehicles aze going to be damaged, and they have to go somewhere. They cannot remain stored in homes and yards. Insurance Auto Auctions keeps yards clean and vehicles shielded. Mr. Strathman asked how they propose to deal with the license issue with respect to the salvage yard. He cannot see how the City can refuse to issue a license to Insurance Auto Auctions because of Mr. Brockley's issue. Without Mr. Brockley's permission to cancel that license, stated Ms. Schweinler, she is hesitant to approve another license for this locafion. That may be something the legal department will have to take up with Mr. Brockley. Her other concern is LIEP still needs the completed site plan showing where the parking will be located. Mr. Hardwick stated he needs to know what will happen with the building to determine the exact number of parking spaces required. He needs a more complete site plan and floor plan. Mr. Strathman stated he understands the City and the neighbors have plans for this area; however, he does not believe the City can deny the license based on a plan whose implementation is unclear. There are no imminent plans to redevelop this site. There are long term plans, but the City cannot prohibit the use of the site because there may be activity at some point in the future. He understands that there aze a lot of automotive businesses in that area, but that is not a basis for denying the license because there is no limitation as to the number of automotive businesses that can be in an area.
