WHEREAS� The Council of the City of Saint Paul, by its
Resolution C. F. 255166, approved August 5� 1971, awarded the sum
of $29,500.00 for land taken by the City for the purpose of acquir-
ing a permanent easement for utility purposes over a portion of
the Burlington Inc. right-of-way in the Southeast 1/4 of Section
29, Township 29 North, Ra.nge 22 West, as more fully described in
said resolution; and
WHEREAS� Subsequen� to the adoption of the above-referenced
resolution, it was discovered that there was an error in the
description of the location of the utility easement� and both the
Ra.ilroad and the City of Saint Paul now agree to a correction of
this legal description; now, therefore� be it
RESOLVED, Tha.t the Council of the City of Saint Paul does
hereby approve that certain Agreement between the Burlington Northern
Inc. and the City of Saint Paul, a copy of wh�ch is attached hereto
and incorporated herein by reference and which �greement provides
for the correction of the error in t�.e legal description of the
util��y easeme��- �-o be acquired by the City of Saint Paul for the
purposes and in accordance with the previous Resolution C. F. 255166,
and the Mayor� City Clerk and Director of the Department of Finance
and Management Services are hereby authorized and directed to
execute the said Agreement on beha.lf of the City of Saint Paul.

Re: Agreement Correcting Legal Description of Utility
Easement from Burlington Northern Inc.

Dear Mayor Cohen:
The City Council, by Resolution C. F. 255166, approved
August 5, 1971, authorized the acquisition of utility
easement from the Burlington Northern Railroad for com-
pensation in the amount of $29,500.00. Following this
condemnation, it was discovered tha.t there was an error
in the legal description, and it has taken us two years
to have the Railroad execute an Agreement correcting
this legal description.
I enclose herewith a resolution, together with a copy
of the proposed Agreement between the City and the
Burlington Northern Ra.ilroad, which Agreement corrects
the error in the legal description of the utility ease-
ment acquired by the City of Saint Paul. This ha.s been
reviewed by the Depa.rtment of Public Works and the
Valua.tion Engineer and approved by both of them. Would
you please have� the City Council approve the resolution,
and thereafter our office will obtain the City signatures
to the Agreement and provide payment to the Railroad in
accordance with the City Council's action.
