Marshall City Clerk Room 386 City Hall Dear Sir: This is written in response to the appeal of Michael and Norma Arrigoni to relax density requirements on property located on the southwest corner of Clarence and York, and further described as follows: Lots 15 and 16, Block 8, Fairchild's and Howard Addition. This matter was heard at the March 15, 1973, Board of Zoning public hearing, at which time the staff report was read and snapshots of the site were presented. The Board noted that the variance request was not represented and acted to recoAanend denial by a vote of 3 to 1. One member felt that just because it was not represented by the applicant was no grounds it should be denied since the land is zoned "B" and the variance is very minor. HISTORY: An identical appeal was granted in 1966 but the property was not developed and the variance lapsed under provision of Code section 64.03, paragraph p. B. PROPOSAL: The appellant proposes to develop the property with two duplexes. C. VARIANCE: Each lot has 5,940.00 sq, ft. A duplex in a "B" Residential district requires a lot size of 6,000 sq, ft. so each lot is 60 square feet, or 1% short of that required. D. AREA ZONING: The immediately surrounding area is zoned "B" Residential. East 7th Street frontage is zoned Commercial. The area east of Birmingham Street has "A" Residential and "C" Residential. The area west of Johnson Parkway is zoned Industrial. E. �ITE CONDITIONS: The two lots are vacant, wooded and several feet above the grades of their frontage streets.
