RESOLVED, That an extra in the amount of $4,173.00 be allowed under Contract
L-7496 between the City of Saint Paul and Robert 0. Westlund, General Contractor,
said contract for Bituminous Work, Fencing, Grading and Sodding at Johnson Parkway
Tennis Courts, and said addition to cover the cost of one pedestrian gate (198.00),
430 cubic yards of granul�ar fill ($1 ,075.00) , and two (2) inches of bituminous
sub-paving over entire court area ($2,900.00), as more fully set forth in contractor's
letters of July 13, 1973, copies of which have been filed with the Department of
Finance and Management Services: Charge to 60000-502-000 to be reimbursed from
93771-460-012. Job #71-39.

Gentlemen:
Due to the unstable condition of the subgrade material below court A�
we are unable to pave court.Since there have been at least 15 days of
dry weather we feel the wa�er table in this area must be quite high
regardless of weather condition�s and that the court area wi11 not dry
out.
WE can fix the problem by adding an extra layer of pavement to seal ,.
the surface below prior to the final paving.The additional cost of this
work will be $2900.00

SUBJECT: Johnson Parkway Tennis Courts Contract 9�L-7496

There is one tennis court remaining to be paved on this job, and the court
area has been consistently too wet to apply the bituminous surfacing. This
condition is tne result of an abnormally high water table in the court area,
located at the intersection of Johnson Parkway and East P�laryland Ave.
Ar� extra for fill material was authorized by Chis office last April, in an
ariount not Co exceed $2,000.00, in hopes that filling with granular material
would alleviate the problem. Mr, Westlund actually delivered more fill
than was autnorized by the extra in an effort to correct the problem and this
procedure t:elped considerably, but the court remains too wet, even though we
have had more than two weeks of dry weather.
;1r. Westlund proposes to apply an additional layer of pavement to seal the
court before final paving. (See attached correspondence) I have discussed
this type of procedure with Public Works Pavin� Section, and I am satisfied
that it will be successful and that ttiis extra should be approved in the a-
nount of $2,900.00. I also feel that Mr. Wes�lund acted in good faith and
should be compensaCed for fill material hauled to the site in quantities be-
, yond those previously authorized, in Che amount of $1,075.00. (See attached)
This brings us to a tofal of $3,975.00 additional funds rec�uired to com.plete
the job. If authorized to �ave the court as proposed, I�Ir. Westlund taill
guarantee the surface under the terms as stated in our specifications. �Iow-
ever, he will not guarantee the court surf ace if he has to pave it as original-
ly specified.
