WHEREAS, the City of Saint Paul, Division of Parks and Recreation, provides a variety
of activities to youth; and
WHEREAS, the Division of Saint Paul Parks and Recreation offers activities to youth at
Wilder Recreation Center, 958 7essie Street, and Arlington Recreation Center, 665 E. Rose
Street, both of which are within the East Consolidated Week and Seed boundaries, described as
Maryland Avenue to the north, Bush Avenue to the south, Payne Avenue to the east and I-35 to
the west; and
WHEREAS, District Six Planning Council agrees to reimburse the Division of Parks and
Recreation for a total of up to $3,000 during the coming year for provision of youth recreational
and leisure activities at these two recrearion centers; and
WHEREAS, District Six wishes to have the City indemnify and hold District Six
hannless from any claims relating the city's prograimning at these recreation centers; and
WHEREAS, the expenditure of public funds, which includes the promise of defense and
indemnification, will facilitate and allow the City to provide these youth programs and activities;
now, therefore be it
RESOLVED, that the City Council of the City of Saint Paul hereby agrees to defend,
indemnify and hold District Six harmless from any and all damages it may be required to pay as
a result of suits, claims, demands, costs and expenses asserted by any person or persons by
reason of death or injury which arise out of the youth recreational and leisure activities provided
at Wilder Recreation Center and Arlington Recreation Center which are in whole or in part
funded by the grant from District Six Planning Council, and which are caused by any negligent
act or omission of the City, its officers, or employees.

2 FURTT3ER RESOLVED, that the foregoing indemnification shall not be construed as a
3 waiver of the municipal tort liability limits and defenses set forth in Minn. Stat. §466A1, et seq.

January, 2002 a�d be compieted by December 37, 2002, if the City holds District Six harmless.
