O1, et sequa, the City of Saint Paul has the authority to franchise all corporations operating a public utility over, upon and under any street or public place and pursuant to such authority has issued a franchise by Ordinance #15319, approved February 7, 1973, to Northern States Power Company for its business and purpose of conducting, distributing and supplying electricity within the limits of the City of Saint Paul; and WHEREAS, under Section 11 of the franchise ordinance the Company did agree to pay a sum of Seventy Thousand ($70, 000) Dollars for the City to conduct a rate hearing and to compensate advisors and consultants who would serve the City in connection with such hearing; and WHEREAS, Northern Sta.tes Power Company did file, on October 12, 1973, an application under the franchise for an increase in its electrical rates, and Leonard E. Brauch have had extensive experience in the field of utility rate regulation, Mr. Mahlum having parti.cipated in hearings involving regulation of the rates of the Northern States Power Company, and Mr. Brauch having undertaken extensive research, investigation and examination of the purported basis for the requested increase in electrical utility rates as filed by the Northern States Power Company on October 12, 1973; and WHEREAS, it is, thus, to the benefit of the community and within the purview of the above-mentioned section of the franchise that William M. Mahlum and John E. Brauch be appointed as advisors and consultants to Thomas J. Stearns, Public Uti.lity Rate Expert, during the course of the hearing on the electrical rates at an expense not to exceed Twenty Thousand ($20, 000J Dollars to further the investigation, preparati.on, analysis, hearing, and other material aspects of the case; now, therefore, be it RESOLVED, that the proper city officers are authorized and directed to enter into a contract with William M. Mahlum and John E. Brauch for consulta,nts' and advisors' services to be provided during the term of the hearing before Leonard E. Mahlum and John E. Brauch and the remaining Ten Thousand ($10, 000) Dollars shall be paid only in the event there is su.fficient money remaining in the funds available under Section 11 of Saint Paul Ordinance #15319 after compensation for the services of the Hearing Examiner, Leonard E. Lindquist, the Rate Expert, Elmer Fox & Co. , and Court Reporters, Logan and Styrbicki, have been determined and are paid.
