An easement over and across that part of the southwesterly'/z of Lot 13, Block 53, Rice
and Irvine's Addition to Saint Paui, according to the recorded plat thereof, Ramsey
County, Minnesota, lying easterly of a line drawn from a point on the northeasterly line of
said southwesterly i/z of Lot 13 distant 10.02 feet northwesterly of the most easterly
corner of said southwesterly 1 /z of Lot 13 to a point on the southwesteriy line of said Lot
13 distant 0.50 feet northeas[erly of the most southerly corner of said Lot 13.

That the peutioners, their successors and assigns agree to indemnify, defend and save hazmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petiuoners or any of their agents or employees.
That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in wriung of the conditions of this resolution

175 Fort, LLC, a limited liability company under the laws of the State of Minnesota, constituting
the owner of all of the abutting properties, does hereby petition the Council of the City of St.
Paul to vacate its interests in the properCy legaliy described as follows ("Propert}�'):
That part of West Seventh Street as platted and dedicated in Fort Road Addition,
according to the recorded plat thereof, Ramsey County, Minnesota, described as
be nni at the most easterly corner of Lot 2, Block 1, said Fort Road Addition;
thence South 11 degrees 16 minutes 30 seconds East, the northeasterly line of said
Lot 2 has an assumed bearing of South 56 degrees 16 minutes 30 seconds East, a

175 Fort, LLC requests the vacation of the Properiy for the following reason.
There is currently an addition attached to 175 Fort, LLC's property at 175 West
Seventh Street, which encroaches partially on West Seventh Street as platted. The
addition was built where there was a previous encroachment (deck, patio, etc.).
The City pursuant to its Resolution dated November 1, 2000 vacated the area we
are requesting to be vacated retaining a reversionary interest. Since we had to
remove the decklpatio, etc. to structurally support the new addition, a reversion
under the previous Resolution vacating the above area may have occurred. We
aze therefore asking that the City of St. Paul vacate its interest in the above
described property entirely (without any reversionary interest) in that if the
current addition and any other improvements currently located on the property
were destroyed for any reason we want the ability to rebuild the same without
having to seek an additional vacation of the property.
We have attached six copies of the current site plans of the improvements constructed on the
lands to be vacated. The survey also shows the property to be vacated.

Note to Vacation File 1'MS #02-2002
On February 21�`, 2002 , Real Estate Staff and its legal cour►sel, met with
a representalave from Public Works and the petitioner's legal counsel to
discuss a revesionary condition in CF #00-1047 (appv.11-1-2000).
It was agreed that since the building encroachment was removed after
11-1-2000 councii approval date and the structure was rebuilt on the
encroachement again, the petioner would need to re-apply to vacate that
portion of West 7�' St. again.
Specifics were discussed concerning the reversionary condition that's included
in the vacation resolution if the structure were to ever be removed.
Ail parties present came to an agreement as to how the language in the
resolution should read concerning reversion rights if the structure were to
ever be taken away.
Since the intial reversion clause in CF #00-1047on1y affected Public Works
directly, the new vacation pefition was directed specifically for Pubiic Works to
consider and no other utilities or deparhnents were sent inquiries. All Real
Estate staff concurred with this approach to processing the petition.

the vacation of that part of Seventh Street West as more fully
described on file and on record in the office of the City Clerk
of Saint Paul, Minnesota, will be heard and considered by the

That part of West Seventh Street as platted and dedicated in Fort Road Addition, according to the
recorded plat thereof, Ramsey County, Minnesota, described as beginning at the most easterly
comer of Lot 2, Block 1, said Fort Road Addition; thence south 11 degees 16 minutes 30
seconds East, the northeasterly line of said Lot 2 has an assumed bearing of South 56 degrees 16
minutes 30 seconds East, a distance of 10.69 feet; thence South 28 degrees 27 minutes 27
seconds West, a distance of 195.90 feet to the southeasterly extension of the southwesterly line of
sais Lot 2; thence North 51 degrees 27 minutes 45 seconds West, a distance of 11.34 feet, to the
most southerly corner of said Lot 2; thence northwesterly along the southeasterly line of said Lot
2 a distance of 20235 feet to the point of beginning.
20 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner will dedicate to the City of Saint Paul Department of Public Works an
easement for street purposes legally described as follows:
An easement over and across that part of the southwesterly'/z of Lot 13, Block 53, Rice
and Irvine's Addition to Saint Paul, according to the recorded plat thereof, Ramsey
County, Minnesota, lying easterly of a line drawn from a point on the northeasterly line of
said southwesterly'/z of Lot 13 distant 10.02 feet northwesterly of the most easterly
comer of said southwesterly 1 /z of L.ot 13 to a point on the southwesterly line of said Lot
13 distant 0.50 feet northeasterly of the most southerly comer of said Lot 13.

1 3. That this vacation shall be for the life of the existing encroachment only. At such time the
2 encroachment no longer exists the vacated property shall then revert back to the City as public

6 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
7 brought as a result of injuries or damages received or sustained by any person, persons or

9 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
10 because of any claims or liability arising from any violation of any law or regulation made in

MCIWorldCom has been notified by your office regarding the above referenced project.
For your records, in reviewing the design prints received from your office, it has been determined
that MCIWorldCom does have facilities within your construction area and a conflict may exist.
In order to auoid this conflict, it will be nesessary for your conshuction to maintain a minimum
of twenty-four (24) inches vertical clearance when crossing MCIWorldCom cable and sixty (60)
inches horizontal clearance when your running line is parallel to our facilities.
Please contact your locai One Call System number at least 48 hours prior to any
construction. During construction it wili necessary for us to monitor our facilities.

'7 That part of West Seventh Street as platted and dedicated in Fort Road Addition,
g according to the recorded plat thereof, Ramsey County, Minnesota, described as
9 beginning at the most easterly corner of Lot 2, Block 1, said Fort Road Addition;
10 thence South 1 I degrees 16 minutes 30 seconds East, the northeasterly line of said
11 Lot 2 has an assumed bearing of South 56 degrees 16 minutes 30 seconds East, a
12 distance of 10.69 feet; thence South 28 degrees 27 minutes 27 seconds West, a
13 distance of 195.90 feet to the southeasterly extension of the southwesterly line of

That the petitioner will dedicate to the City of 5aint Paul Department of Public Works an
easement for street purposes legally described as follows:
An easement over and across that part of the southwesterly'/z of Lot 13, Block 53, Rice
and Irvine's Addition to Saint Paui, according to the recorded plat thereof, Ramsey
County, Minnesota, lying easterly of a line drawn from a point on the northeasterly line of
said southwesterly i/z of Lot 13 distant 10.02 feet northwesterly of the most easterly
corner of said southwesterly 1 /z of Lot 13 to a point on the southwesteriy line of said Lot
13 distant 0.50 feet northeas[erly of the most southerly corner of said Lot 13.

1 3. That this vacation shall be for the life of the existing improvements within the encroachment
2 (All of which aze herein after refered to as the "Improvements") and/or the repair or

That the peutioners, their successors and assigns agree to indemnify, defend and save hazmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petiuoners or any of their agents or employees.
That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in wriung of the conditions of this resolution
and shall, within the period(s) specified in the terms and conditions of this resolution, comply in

PETITION TO VACATE CTTY INTEREST
175 Fort, LLC, a limited liability company under the laws of the State of Minnesota, constituting
the owner of all of the abutting properties, does hereby petition the Council of the City of St.
Paul to vacate its interests in the properCy legaliy described as follows ("Propert}�'):
That part of West Seventh Street as platted and dedicated in Fort Road Addition,
according to the recorded plat thereof, Ramsey County, Minnesota, described as
be nni at the most easterly corner of Lot 2, Block 1, said Fort Road Addition;
thence South 11 degrees 16 minutes 30 seconds East, the northeasterly line of said
Lot 2 has an assumed bearing of South 56 degrees 16 minutes 30 seconds East, a
distance of 10:69 feet; thence South 28 degrees 27 minutes 27 seconds West, a
distance of 195.90 feet to the southeasterly extension of the southwesterly line of
said Lot 2; thence North 51 degrees 27 minutes 45 seconds West, a distance of
1134 feet, to the most southerly comer of said Lot 2; thence northwesterly along
the southeasterly line of said Lot 2 a distance of 20235 feet to the point of
beginning.
175 Fort, LLC requests the vacation of the Properiy for the following reason.
There is currently an addition attached to 175 Fort, LLC's property at 175 West
Seventh Street, which encroaches partially on West Seventh Street as platted. The
addition was built where there was a previous encroachment (deck, patio, etc.).
The City pursuant to its Resolution dated November 1, 2000 vacated the area we
are requesting to be vacated retaining a reversionary interest. Since we had to
remove the decklpatio, etc. to structurally support the new addition, a reversion
under the previous Resolution vacating the above area may have occurred. We
aze therefore asking that the City of St. Paul vacate its interest in the above
described property entirely (without any reversionary interest) in that if the
current addition and any other improvements currently located on the property
were destroyed for any reason we want the ability to rebuild the same without
having to seek an additional vacation of the property.
We have attached six copies of the current site plans of the improvements constructed on the
lands to be vacated. The survey also shows the property to be vacated.

On February 21�`, 2002 , Real Estate Staff and its legal cour►sel, met with
a representalave from Public Works and the petitioner's legal counsel to
discuss a revesionary condition in CF #00-1047 (appv.11-1-2000).
It was agreed that since the building encroachment was removed after
11-1-2000 councii approval date and the structure was rebuilt on the
encroachement again, the petioner would need to re-apply to vacate that
portion of West 7�' St. again.
Specifics were discussed concerning the reversionary condition that's included
in the vacation resolution if the structure were to ever be removed.
Ail parties present came to an agreement as to how the language in the
resolution should read concerning reversion rights if the structure were to
ever be taken away.
Since the intial reversion clause in CF #00-1047on1y affected Public Works
directly, the new vacation pefition was directed specifically for Pubiic Works to
consider and no other utilities or deparhnents were sent inquiries. All Real
Estate staff concurred with this approach to processing the petition.

Dear Mr. Sawyer:
MCIWorldCom has been notified by your office regarding the above referenced project.
For your records, in reviewing the design prints received from your office, it has been determined
that MCIWorldCom does have facilities within your construction area and a conflict may exist.
In order to auoid this conflict, it will be nesessary for your conshuction to maintain a minimum
of twenty-four (24) inches vertical clearance when crossing MCIWorldCom cable and sixty (60)
inches horizontal clearance when your running line is parallel to our facilities.
Please contact your locai One Call System number at least 48 hours prior to any
construction. During construction it wili necessary for us to monitor our facilities.
You should address future correspondence concerning the project to the attention of National
Supporl/Investigations at the above address. Please include the above MCIW ID number.
If you need further assistance with this project, please do not hesitate to call the Field Manager,
