Clair and Pascal Avenues to facilitate driveways , each of which would permit vehicular ingress and egress , would result in dangerous traffic congestion at the south side o� the St . Clair-Pascal intersection; That the narrow width of Pascal Avenue coupled with on�street parking on both sides of Pascal Avenue would unduly aggravate the traffic congestion created by vehicles entering and departing th� proposed parking lot; That during the winter months snow is anticipated to accumulate near the Pascal Avenue curbs there- by further narrowing the street for parking purposes and potentially inhibiting vision; That the safety of elderly individuals and young children would be seriously jeopardized owing to the necessity of vehicular traffic crossing over si,dewalks while entering and departing the proposed parking lot , particularly during the hours of darkness ; That the presence of a bus stop at the southwest corner of the intersection of St, Clair and Pascal Avenues would further aggravate the ingress and egress to the proposed parking lot as well as on�going vehicular traffic on St . That the narrow width of St. Clair Avenue permitting one lane traffic in each direction with on street parking on both sides of the street is not conducive to the safe accommo- dation of added commercial traffic both by vehicles and pedestrians; That based upon conditions presently existing at similarly situated parking lots adjacent to small grocery stores , the likelihood of litter being generated by use of the proposed parking lot to such a degree as to be injurious to the health and welfar� of the immediate environs is very great; That the late hours expected to be kept by _the proposed grocery stor� would encourage some individuals to congregate at or near the proposed park�ng lot during the evening hours thereby encouraging excessive noise and, based , upon similarly situated parking lots , vandalism . of private property in the immediate neighbor- hood; now, therefore, be it RESOLVED, That the City Council of the City of Saint Paul does hereby deny the Special Use Permit sought by the Southland Corporation. Marshall City Clerk 386 City Hall St. Paul, Minnesota 55102 Dear Mr. Marshall: This is written in response to the application of Southland Corporation for a permit to install a seven car parking lot on property located on the southwest corner of St. Clair and Pascal and further described as follows: Lots 28 and 29, Block 1, Sylvan Park Addition. This matter was heard at a public hearing held by the Board of Zoning on August 30, 1973. The staff report submitted at that hearing indicated that the proposed parking Lot plans as revised by the applicant met design standards. Several members of the public appeared to speak in opposition to the granting of the permit. Concern was expressed regarding the capacity of St. Clair and Pascal Streets to adequateLy serve the increase in traffic which might be generated, regarding the possibility that the lot might become a nuisance in the neighborhood c�;,�.e to its use as a gathering place for youths, and regarding the belief that the lights of the autos using the lot would prove disturbing to adjacent residents. `ti. r 421 Wabasha, Saint Paul, Minnesota 55102 (612) 298-4151 - 2 - A petition containing the signatures of more than 300 area residents, opposing the granting of the permit was presented to the Board. Mr. Ray Faricy, a state legislator representing the area, stated that it was his belief that the granting of the permit would be a detriment to the area. He further stated that the area is a "quiet neighborhood", and to grant the permit would be to add to an already "insurmountable problem" faced by the residents. The Board heard a motion to reco�end denial of the permit application. It has been nothing but a mess� a hazard and a nuisance. They Bulldozed on my property and when I asked workers what they were doing, the worker said �� I am working for 7-11 and I do not have to answer to you.n Through this y��,r we have had many conversation� with the management of 7-11 Corporation and uxifortunately many of the agreements with them were verbal They ass.ured us there would be no machines outside of the' building. WE HAVE AN ICE DISPENSER RIGHT OUT IN FRONT OF THE STORE ALREADY'. As of this date the verbal agreement on the fence has not been fulfilled. This store opened on September 28, 1973, and immediately put up a sign statirg that they are o�en 2!� �ours. WHY THE NAME 7-11? Rids from the Junior Hi�h School sit by the brick east wall and eat lunch and drink pop, then they 'ttiraw the cans in our yard. It is quite a hang-out for kids and dogs, We furnished the electricity and water for the construction and as yet have not been paid for it. As principal of Randolph Heights School, which houses approad.mately six hundred young children ages fiv�e-twelve, I am strong]�y opposed to this plan. In the first place, I believe this area does not need another grocery store, as there are alreac�y three super markets, Red Qwl, Knowlan's, and Country Club and a nwnber of area maxkets: Clemons on St. Clair and Pascal, Pittelkow's on Hamline, Miss Swiss on SSrndicate and St. Clair, Porter's on SYielling and Jefferson, Beg�nn's on Grand, Speec�r Market on Randolph and a P.D.Q. on Randolph and Edgewnbe. Further, we have had a nlunber of problems which have arisen by the store on Syndicate and St. Clair such as a gathering place or a. meeting place away from home. Last year� one of our boys got away from a man who held a knife at his throat. I believe the police were notified of this. We hav�e had other incidents emanating from that store where characters would stop to bribe some of the children to get into their cars. Another item is the fact tha.t I frequently get compl�ints from parents as to the debris which is cast on their lawns such as canc�,y and gtm► wrappers, ice cream cups, p�p cans etc. Another store in this area would certainlp be superfluous and increase the traffic problems unless a large parking area would be provided. In the event a parlQ.ng area should b� provided, this too would mean another hangout. Again, I repe at, I am oppo sed to the aforementione d pl an, be cause i t represents an additional hazard for the safety of my young children. I feel reasonably sure that if the parents in this neighborhood were polled, they would uphold me one hundred percent since man�r of them have heard a.bout some of these events mentioned abov�e. Marshall City Clerk Room 386 City Hall Dear Sir: This is written in response to the application of Southland Corporation for a permit to install and operate a seven-car parking lot for a Seven- Eleven grocery store on the southwest corner of St. Clair and Pascal. Application was made on March 23rd, but the applicant was informed that the commercial district had a depth of only 100 feet, while the platted lot and the site plan was 120 feet deep. Originally, the applicant expressed an interest in rezoning the remainder of the site, but apparently abandoned that approach because on Monday of this week revised plans were filed which proposes development of only the commercially zoned portion. Since it was filed before the effective date of the amendment to the parking lot permit procedures, this application may not be subject to that amendment. However, since the amendment is now in effect and since Councilman Konopatzki has shown an interest in this application, we would like to bring it to the attention of the Council. For now we are treating it as an administrative permit and will continue to process it as such unless we receive instructions to the contrary. The Fire Department indicated "no objection" . 8. The matter was heard before the Zoning Board on August 30 , 1973. At this hearing the Planning Board staff submitted a report" and informed the Zoning Board that the plans met all design standards. See Alexander v. Ci-t�of Minneapolis, GMinn. S. Ct. 1963). 125 N.W.2d, 583. �-2_ � , In that case Plaintiff was denied a building permit to construct an apartment building on land that was properly zoned because the City of Minneapolis had issued a "hold-order" on building permits pending adoption of a proposed Comprehensive Zoning Ordinance. The Court held such hold-order void and granted Plaintiff the permit stating: °The , power of a municipality to amend zoning ordinances must arise out of some legislative enactment dele- ' gating such authority to it, either directly or by implication. Here the only statute under which defendant City is authorized to amend its zoning ordinances is Minn.St. 462.18, and we find nothing therein which would empower it to indefinitely suspend application of its zoning ordinances as to certain property, or to nullify them through the adoption of "ho�d or�ers" not having the effect of ordinances . In fact, even if such "hold order" had been adopted as an "ordinance, " its validity would be questionable. As stated in State ex rel . Fairmount Center Co. v. Arnold, 138 Ohio St. 259, 34 N.E.2d 777, 136 A.L.R. 840 : � �A municipal council may not, by the enactment of an emergency ordinance, give retroactive effect to a pending zoning ordinance thus depriving a property owner of his right to a building permit in accordance with a zoning ordinance in effect at the time of the application for such permit. + The language of the United 5tates Supreme Court in Pennsylvania Coal Co. v. Mahon, 260 U.S. 393 , , 415, 43 S.Ct. 158, 160 , 67 L.Ed. 322 , 326 , has reference to the exercise of the police power and constitutional restrictions against taking private property without due compensation. There Mr. Justice Holmes stated: � " . .The protection of private property in the Fifth Amendment . . provides that it shall not be taken for such (public5 use without compensation. A similar assumption is made in the decisions upon . the Fourteen Amendment. (Citing cases . ) When this seemingly absolute protection is found to be qualified by the police power, the natural tendency of human nature is to extend the qualification more and more until at last private property dis- appears . But that cannot be accomplished in this way under the Constitution of the United States . The genera� rule at least is that while property may be regulated to a certain extent, if regulation goes. too far it will be recognized as a taking. * * * In general it is not plain that a man`s misfortunes _3_ . of necessities will justify his shifting the damages to his neighbor' s shoulders. (Citing cases. ) We are in danger of for- � getting that a strong public desire to improve the public condition is not enough to warrant achieving the desire by a shorter cut than the constitutional way of paying for the change. " 6. The Law Re uires Issuance of the Permit. Citv of St. Paul. decided by our Minnesota Supreme Court on November 19, 1971 (192 N.W.2d 1$9) • In that case, Red Barn applied for a special use perrnit for construction of a parking lot, which application was denied by the City Council. The Supreme Court held that where the requested use was compatible with the basic use authorized with the commercial zone in which the land was located, all requirements of existing laws and ordinances had � been complied with and the requested use did not endanger public • health or safety or general welfare of the area affected, denial of the permit was arbitrary. The pertinent portion of the opinion reads as follows: "The City Council does have the authority under certain circumstances to deny a special use permit. Said denial, however, can only be based upon facts which indicate that the public health, safety or welfare would suffer should such a permit be issued. There are no facts before this Court, nor were there any presented to the City Council, which would support such a finding. No traffic survey has ever been taken, and no facts were presented relative to any possible increase in traffic or endangering of the health, safety or welfare of the public by the issuance of this permit. "Our Minnesota Supreme Court in Golden v. City of St. Louis Park, said'while there should be no objection to a municipality's endeavors to apply aesthetic � considerations to plans for future development, in doing so it should be aware that where such plans involve � destruction or diminution of property rights or interests, just compensation therefor should be paid to the owners whose rights or interests are thus taken for the benefit of the community as a whole. ' In the instant case the action of the City Council in refusing to grant the permit application is an effective denial to the plaintiff of a lawful use of its property. The Court can find no provision in the existing zoning ordinances of the City � of St. Paul which provide for any aesthetic considerations as applied to the facts in the instant case. R5� � � "The Court can certainly sympathize with the concerns of the residents as to the aesthetic effect upon the neighborhood. Under existing laws and ordinances, however, the Court can find no authority vested in the City Council to deny a permit for the construction of a parking lot on those grounds, providing that the applicant has complied with all requirements of our existing laws and ordinances. The applicant herein has so complied, and therefore his application for a special use permit must be granted. "We are of the view that the trial court's determination is consonant with the views expressed by this court to the effect that an arbitrary denial of a permit may be found when the evidence presented at the hearing before the municipal governing body and the review- ing court establishes that 'the requested use is compatible with the basic use authorized within the particular zone and does not endanger the public health or safety or the general welfare of the area affected or the community as a whole." See Hay v. Township of Crow (Niinn. S . Ct. 1973) , 206 N.W. 2d, 19-: "It is no� settl�d that where a zoning ordinance specifies standards to apply in determi.ning whether to grant a s�ecial use permit and the appl.icant fully complies with the specified standard5, a denial of the permit is � arbitrary °as a matter of l.aw. Ct. 1973) , 203 N.W.2d, 396 : "The City Council is th.e final authority as to whether or not a conditional-use permit wi11 be granted; but if the party seeking the permi�t meets all the standards pre- scribed in the ordinan�e, the Council has no discretion to deny the permit. Its refusal, to grant the permit in such circumstanCes is arbitrary as a matter of law, and mandamus will. lie to Compel. the Council to grant the permit. " Zvlka v. City of Crystal (Minn. S.Ct. 1969) , l67 N.W. 2d, 45: "In theory, if not in practice, provisions authorizing the issuance of special use permits are intended to provide more flexibil,ity in land-use control than provisions authorizing a variance. While the adminis- trative body, be it the Council itsel.f or a planning commission to which power to act is delegated, has broad discretionary power to deny an application for a special- use permit, it cannot do so arbitrarily. A denial would be arbitrary, for example, if it was establ.ished that al1 of the standards s ecified by the ordinance as a condition to granting the permit ave been met. Roedler: I want you to know that my husband and I are concerned about the possibility of a 7-11 grocery store being built on the property located at 14fi2 St. Clair. We lived at that address from August, 1972 through March 1973 when we tiyere told to leave prepatory to tearing the building down. Besides the obvious, needless destruc- tion of a very nice piece of land, the erection of a 7-11 would generate harrassment for the exceptionally nice people in that neighborhood and would probably run the corner grocery store across the street out of business. We cannot feel that the advantages of a 7-11 at th�t lacati�n'in any way outweigh the disadvantages. I believe it� is 'time to stop thinking of �his sort of thing as "progress;” instead we should feel that America is progressing if we can save areas like this.
