COUGHLIN PLANNING COORDINATOR March 14, 1973 Madam President and Members of the Council Room 719 City Hall Saint Paul, Minnesota 55102 Dear Madam and Council Members: On February 23, 1973, the City Planning Board held a public hearing on two ordinances amending the Zoning Code. Ordinance 260540 regulates drive-in and fast food restaurants and Ordinance 260539 changes the procedures for approving parking lots. The Notice of Public Hearing was published in the Saint Paul Legal Ledger on February 3, 10, and 17, 1973. Copies of the Printer's Affidavit of Publication are attached. The two Ordinances had been considered previously by the Planning Board at its meeting on December 15, 1972. At that meeting the Board discussed and adopted a subcommittee report which described the purposes of the Ordinances and recosmnended their approval. A copy of the report, marked Report ��1, and the minutes of the meeting are attached. At the conclusion of the public hearing on the two Ordinances on February 23, after hearing all who wished to testify, the Board considered a subcommittee report which proposed findings on the Ordinances and which recommended that the provision, as published in the public notice, for access to residential streets, Section 60.05, f. , (2), be amended. The report, marked Report �k2, giving the Board's findings and reco�nended amended provision is attached. After considering the public hearing testimony and report, the Board adopted the subcou¢nittee report. Motions were made and seconded to approve Ordinances 260540 and 260539. Both motions passed unanimously. The minutes of the public hearing at this date have not been approved by the Board; upon approval of the minutes by the Board they will be sent to the Council so that the record may be camplete on these two Ordinances. E P o c�.-t- 2 REPORT TO THE CITY PLANNING BOARD ON ORDINANCE 260540 (RESTAURANT), AND ORDINANCE 260539 (PARKING LOTS) REVIEW OF PAST ACTION Ordinances regulating fast food and drive-in restaurants and changing the procedures for approving parking lots were referred to the Planning Board in July and November of 1972. On December 15, 1972, the Planning Board adopted the report of the New Zoning Ordinance Subcommittee which recammended substituted ordinances for the ordinances referred to the Board. (Copy of report attached.) On January 24, �a73, the Board's substituted ordinances were introduced in the City Council and referred to the Board for. a public hearing. (Ordinances 260539 and 260540 attached.) PUBLIC HEARIPdG The Planning �oard will hold a public hearing on the two ordinances at its regular meeting on February 23, 1973, at 9:30 A.M. at the Bosrd's office. � Newspaper notices have been published in the Legal Ledger on February 3, 10, and 17, 1973. CHANGE TO RESTAURANT ORDINANCE The provision prohibiting access from drive-ins and fast food restaurants onto local residential streets adopted by the Board in December was changed in the ordinance referred to it in January. ' The ordinance adopted by the Board in December stated: "(2) Points of vehicular ingress and egress shall not be onto a local residential street." � The ordinance referred to the Board in January states: "(2) Points of vehicular ingress and egress shall not be ontc a Page 2 street located in a residentially zoned district." The Subcommittee believes neither provision adequately defines the situation which is to be regulated. The Subcommittee recouanends the follow- ing provision be substituted: "(2) Points of vehicular ingress and egress shall not be onto a street which is used primarily for access to abutting residential property." ,..�_.; +: The a�ove provision defines local residential street and will adequately specify the type of street from which access is to be prohibited. REQUIRED ACTION BY PLANNING BOAR� Section 64.06 of the Zoning Code requires the Board to make the following findings: 1. Consider whether the number of description of real estate affected by amtr.dments to an existfng zoning ordinance render the obtaining of written consent impractical. . 2. The Planning Board shall have nade a survey of the whote area of the City or of an area of not less than 40 acres, within which the amendment would take affect when adopted. 3. A finding must be made on one of three alternatives: a. the amendment is reasonably related to the overall needs of the City, or; b, the amendment is reasonably r.elated to existing land use, or; c. the �nendment is reasonably related to a plan for future land use. 0 PLANNING BOARD FINDINGS ON RESTAURANT ORDINANCE 1. Since the ordinance affects all land within the City, the obtaining of written consent of two-thirds of the desc�i°ption of real estate affected by the ordinance is impractical. ' ' Page 3 2. The Planning Board has made many surveys of the whole area of the City beginning in 1957 and continuing into 1972. Such surveys consist of land use surveys, existing zoning surveys, and survey in conjunction with comprehensive plans. 3. a. The ordinance is reasonably related to the overall needs of the City because public officials are allowed to review the design of fast food and drive-in restaurants in relationship to surrounding uses and conditions. The existing zoning code allows fast food and drive-in restaurants to locate in all non-residential zonin� districts throughout the City without regard to the character of an area. Until this condition is remedied by a new zoning code which distinguishes between differing commercial districts such uses should be examined at public hearings. b. The 6rdinance is reasonably re'lated to existing use by prohibiting fast food and drive-in restaurants from small, isolated zones and b� regulating the trafric flow of fast food and drive-in restaurants when they are near residential uses. c. The ordinance is reasonably related to a plan for future land use by furthering the Comprehensive Plan principals of eliminating conflicts between residential and non-residential use and protecting the boundaries of adjacent land use groups. ° PLANNING BOARD FINDINGS ON PARKING ORDINANCE 1.
