THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain prop-
erties in the City of Saint Paul, as amended, be and the same
is hereby further amended so as to rezone the following des-
cribed property from "A" Residence District to "C-1" Residence
District, to-wit:
Lots 1 to 7 inclusive, Block 8, and
Lots 1 to 7 inclusive, except portions
of Lots 1 to 5 inclusive in railroad
right-of-way, 100 feet wide across said

TO THE HONORABLE MEMBERS 0� THE CITY COUNCIL;
Tn a letter dated May 2 , 1973, you request advice as to
the praposed amendment o£ a rezoning petition pertaining
to the above descr�bed matter, It is apparent that the
property presently is "A" residential and the petition
filed requests a rezoning to "C" residence. At the
request of the Planning sta£f the Zoning Board recommended
that rather than an amendment to a "C" classification, it
should be rezoned to a C-1 classification, This rezoning
to a C-1 classification met with the approval of the
petitioner and the attorney for the petitioner, You now
ask what procedure should be followed so as to present
this matter to the City Council so as to canform with
the Zoning Board recommendation and the approval of such
recommendation by the petitioner.
Rather than requiring the petitioner to commence a new
acta:on in obtaining a new petition for a rezoning to a
C-1 classification, it is our opinion that this petition
can stay before tfie Saint Paul City Council in the same
£orm that a,t now exists and the City Council has the
authority to adopt the recommendation of the Planning
Board and to rezone it to a C-1 classification rather
than a "C" residence since a C-1 classification is more
restrictive. T� the City Council approves the rezoning
to a C-1 classi��cation, the minutes of the City Council
meeting should so reflect and a proper ordinance would

Please be advised that the above described lands recent,ly wer� con-
sidered by the �,oning Co�nittee of the Planning Board in connection with a
proposed application to rezone from A Residence to C Residence, so as to
permit the construction of multiple residential units thereon. At the
time of the hearing before the Zoning Cormnittee a Staff recommendation was
made that the property be rezoned, but to a C-1 classification, rather than
a C classification, permitting a lesser number of units to be constructed
upon the premises. This reco�nendation was approved by the Planning Commission,
and on behalf of the applicant, Sherman Investment Corporation, it is hereby
requested that the application be amended so as to request a rezoning from
A to C-1 Residence, rather than A to C Residence.
An amended plot plan showing the development for a C-1 Residence
District is in the process of being completed by the ownerts architect,
and will be filed with the Planning Department and the City Clerk shortly.
It is my understanding that because a less intensive use is being
sought by the applicant that there is no need to again prepare and file a
consent petition, because the usage is the same but merely less intensive
in character. If there is any question on this matter, please advise, and
we will proceed accordingly.

Dear Sir:
This is written in response to the petition of the Sherman Inve�tment Company
to rezone, from "A" Residence to "C" Residence, property on the east side of
Westminster between Nebraska and Arlington. The legal description is attached.
The petition was considered by the Board of Zoning at a public hearing on
April 19, 1973. The Chairman of the Zoning Board noted that staff had met
twice with people in the neighborhood and said staff was prepared to make a
professional reco�endation to the Board on the petition and requested staff
to do so.
Staff gave the planning background for the area within which the property
proposed to be rezoned is located, noting that the 1963 Comprehensive Plan
proposed single family for almost all of the area, that the Planning Board in
early 1969 voted to amend the Plan to include high density residential for the
area, but that in late 1969 voted to not modify the Comprehensive Plan pending
a public hearing on a development plan which the Board, residents, and property
owners had developed, at the request of City Council, during the suIIaner and fall.
Staff then gave the zoning background for the area, noting that over the last
ten years, on scattered sites, in about a dozen rezoning actions, 24 acres
had been rezoned to "C" Residence and 2 acres had been rezoned "C-1" Residence.
In September, 1972, the Planning Board adopted a proposed zoning map for the
area as part of a comprehensive zoning ordinance for the City, which proposed
multiple family for most of the area west of the Soo Line Railroad tracks
from Wheelock Parkway to Westminster and west of Arkwright from Nevada to
Maryland.
As to the rezoning in question, the petitioner requests that three platted
parcels of land be rezoned to "C" Residence which, when vacated streets and
alleys are included, will result in a parcel with an area of approximately
139,000 square feet. Staff reco�¢nended the land be rezoned for multiple
family use. The recent rezonings and street vacations, the proposed develop-
ment plans, and the proposed zoning districts of the new zoning ordinance
indicated multiple family for the area and these parcels in particular. Since
Nevada Avenue had been vacated, the parcel north of vacated Nevada just west
of Arkwright cannot be developed for either one or two family use; multiple
family is the only feasible residential alternative. The parcel north of
vacated Nevada at Westminster adjoins a railroad track embankment and bridge

and multiple family zoning; multiple zoning is desirable, especially if used
for parking. The parcel on Westminster between Nevada and Arlington should
be rezoned since the two northerly parcels would be rezoned, existing apart-
ments adjoin to the east, and the parcel is proposed for multiple family in
the new zoning ordinance.
While staff reco�nended the land be rezoned for multiple family, staff
believed the land should be zoned "C-1" Residence rather than "C" Residence.
The "C-1" Residence will make a better transition between the higher densities
to the south and the lower densities to the north by allowing more open space,
less building mass and parking area. The "C-1" density will mean less traffic
generation. The "C-1" Residence zoning was consistent with the 1969 develop-
ment plan and the proposed zoning ordinance. Staff also recamanended that
since the apartment development to the south has inadequate parking facilities,
a contingency be placed on the rezoning to require that additional parking
spaces for the existing apartments be provided on the rezoned site to relieve
the inadequate parking situation. (A copy of the entire staff recoBnnendation
is enclosed.)
The petitioner's attorney stated the petitioner would amend his petition to
"C-1" Residence if favorable action was taken by the Board. (Subsequently,
petitioner did propose to amend his petition, but the City Attorney's office,
in a memo dated June 5, 1973, advised that the petition stay in its present
form and the Council has authority to adopt recaamendations of the Zoning Board.)
Four opponents objected to the rezoning, stating that a new zoning ordinance
is being developed which grandfathers many previous rezonings which were made
primarily because one developer received some important rezonings, that there
is traffic problems in the area and schools are overcrowded.
The Planning Coordinator su�narized from previous neighborhood meetings
residents' objections: the area should be developed for one and two family
homes; life style of apartment dwellers; traffic generation and congestion;
rodent infestation; and installation and removal of no parking signs.
After discussing the matter, a motion was made to deny the petition, but
failed for a lack of a second. Subsequently, a motion to recom�end "C-1"
Residence was made, seconded, and passed by a vote of three for and one
against.

The 1963 Comprehensive Plan proposed single fs�ily for almost all of the
western part of the Wheelock Neighborhood, which is the neighborhood within
which the property proposed to be rezoned is located. In early 1969, the
Planning Board voted to amend the Plan to include high density residential
for the area, in response to a rezoning request. In the spring of 1969, as
a result of another proposed rezoning in the area, the City Council
directed the Planning Board to draca up a comprehensive development plan for
the area.
The staff, after working with residents, land owners, and developers,
proposed two alternate plans for the area. Plan A �roposed a linear park
occupying some of the low lying peat areas and wood slope areas between
Arkwright and Westminster Street. The Plan was a "New Concept" residential
plan which proposed a variety of housing types -- multiple family, townhouses,
modular dwellings, and single family -- and a co�nercial area north of
Arlin�ton at Westr�inster. i�ultiple family was to cccupy 19 acres of land and
ne�? apartments were to be constructed at a C-1 density.
Plan B also proposed a linear park, but the central part, south of Arlington,
was f.arther east, on ..ttie land the City recently acquired for a park. The
�lan was a traditional development plan and propased multiple family west
of �he park, single family east of the park, and comm�ercial north of Arlington
a.�_ T'estminster. Multiple family use was to occupy 59 acres of land and new
ap;.ttments were to be .:onstructed at a C-1 density.
The Planning Board received the Plans in late 1969; it voted to not modify the
1963 Comprehensive Plan until a public hearing was held and appointed a committee
to set up hearings. No further action was taken on the matter.

BACKGROUND - ZONING
Over the last ten years on sites scattered through the area, in about a dozen
rezoning actions, 24 acres have been rezoned to "C" Residence and 2 acres have
been rezoned to "C-1" Residence. One rezoning was withdrawn and one rezoning
was denied on land east of the Soo Line tracks at Wheelock Parkway. On all
of the rezoned sites, apartments have been constructed or the City Council
has approved building permits for apartments.
In September, 1972, the Planning Board adopted a new zoning map for the area
as part of a comprehensive new zoning ordinance for the City. The Board
proposes ipultiple family for most of the area west of the Soo Line Railroad
tracks from Wheelock Parkway to Westminster and west of Arkwright from
Nevada Avenue to Maryland Avenue. The multiple family area constitutes

In reco�ending the multiple family, the Board recognized the recent multiple
family rezcanings in the area. In drawing the line between the multiple
family d:�stricts and tne single and two family districts, the railroad tracks,
the t_ew park, and the back lot lines of homes facing on Arkwright and Maryland
were used. P1an B, previously mentioned, which proposed multiple family for
ttge area, was also used as a guide for districting. The areas nearest the
freeway iuterchanges and lands already zoned "C" Residence for which building
permits were secured were zoned RM-2, medium c�ensity multiple family. RM-2
was placeo nEarest interchanges since it is more efficient and causes least
_ conflict to locate the highest traffic generators nearest the transportation

facilit9e^� °�hich they will be using. An existing apartment site and two
. proposed apartment sites -- all south of Cottage Avenue between Mississippi
• and Arkwright Streets -- were zoned RM-2, since RM-2 most closely approximated
the existing and proposed apartment's densities.

The areas away from the freeway interchanges and bordering existing low
density residential uses were zoned RM-1, low density multiple family. The
RM-1 was placed in the interior on vacant land and on land with houses on
large lots. The RM-1 district was designed for garden apartments and town-
houses on sites where few or no buildings would have to be removed. Lower
land investment could support lower densities. The RM-1 was placed next to
existing low density residential since this district has the best transitional
density for boundaries between apartments and single family.

THE PROPOSED REZONING
The Sherman Investment Company requests that three platted parcels of land
be rezoned to "C" Residence. When adjoining vacated streets and alleys
are added to the, three platted parcels, the resultant buildable land area
will be 139,288 square feet. The developers ' preliminary site plans show
107 dwelling units in three buildings, with some of the parking underground.
The new apartments would be integrated with the existing apartment site to
the south, sharing parking lot spaces and drives and a recreation facility.
The Zoning Board received on April 12, 1973, an amended application for a
129-car parking lot for this existing apartment development. The applicant
is James Rutzick. .

STAFF RECOMMENDATION
Staff reco�ends the land be rezoned for multiple family use. The recent
rezonings and street vacations, the proposed development plans, and the
proposed zoning districts of the new zoning ordinance clearly indicate
multiple family for the area and these parcels in particular. Since Nevada
Avenue has been vacated, the parcel north of vacated Nevada just west of
Arkwright cannot be developed for either one or two family use; multiple
family is the only feasible residential alternative. The parcel north of
vacated Nevada at Westminster adjoins a railroad track embankment and bridge
and multiple family zoning; multiple zoning is desirable, especially if used
for parking. The parcel on Westminster between Nevada and Arlington should
be rezoned since the two northerly parcels would be .rezoned, existing
apartments adjoin to the east, and the parcel is proposed for multiple
family in the new zoning ordinance.
While staff recommends the land be rezoned for multiple family, staff
believes the land should be zoned C-1 residence rather than "C" residence
for the reasons below.
A C-1 residence density makes a better transition between the higher density
to the south and the low density to the north. The lower density of the
C-1 district results in more open space, less building mass, and less
parking area than C residence; the abrupt change from higher density to lower
density can bP modulated more readily by the C-1 district.
The C-1 density which allows 82 apartments will mean less traffic is generated
� than the developers proposed l0i apartments. While the dif�erence in number

of apartments is only 25 for this particular site, this rezoning will set the

pattern for future rezonings. If the entire area is rezoned C residence

rather than C-1 residence, the increase in traffic will be higher.
Staff has observed that the existing apartment development to the south has
an inadequate number of parking spaces. The developer should provide
additional parking spaces on the proposed site for the existing apartments
to relieve this inadequacy. The C-1 density will leave a larger area
available for the additional parking.
The staff believes Plan B of the 1969 study is still valid as a guide to area
development. The Plan's reconnnendation for a park has been carried through
to the recent acquisition of land for a park at Arlington and Arkwright.
The recommendation for C-1 density should also be followed.
The C-1 density is consistent with the proposed zoning ordinance which
indicated RM-1 for the area. The developer could construct 82 dwelling
units with C-1 zoning. The RM-1 district would permit 82 dwellings if
parking is underground and 2/3 of the units are one bedroom apartments and
1/3 of the units are two bedroom apartments.
In conclusion, staff reco�ends the land be rezoned for multiple family
but to C-1 residerce rather than C residence. A contingency should be
placed on the rezoning to require that additional parking spaces for the
existing apartments to tt�e south be provided on the site to relieve an
existing inadequate parking situation.

Dear Mr. Marshall:
Reference is made to a petition being placed before the
authorities of the City of St. Paul by landowners and adjacent to our
right of way on the North side of Arlington and East of Westminister
in St. Paul, Minnesota, for rezoning from A residence to C Residence
for the purpose of constructing garages and additional parking facilities
for apartments. It is my understanding the lands involved are described
in the petition as follows:
Lots 1 to 7 inclusive, Block 8. Lots 1 to 7 •
inclusive, EXCEPT parts of Lots 1 to 5 inclusive
in railroad right of way, 100 feet wide across
said Lots 1 to 5 and Lots 20 to 31 inclusive
all in Block 5, Morton's Additiou to the City of
St. Paul.
We have declined to be a party to the petition in question
with respect to our right of way because we believe that it is out of
order for the Railroad Company to be a party to any petition for rezoning
lands adjoining such operating right of way. The S00 LINE is neither for
or against the proposal and has no objection to this ma�ter being brought
to hearing.

Management Services declared the petition sufficient with the owners of 34,
or 74% of the 46 eligible parcels having signed.
B. HISTORY: There is no zoning history for this site.
C. PROPOSED USE: The proposed use is that of multi-family dwelling units.
D. FRONTAGE AND AREA: The site has a frontage of 589.48 feet along Nevada Avenue,
423.86 feet along Westminster, and 127.12 feet along Arkwright, for a total
area of 128,137.31 sq. ft. exclusive of adjoining streets and alleys.
E. AREA ZON?NG: A "C" Residential district adjoins the property to the south.
The rest of the area north of Arlington and east of the railroad tracks is
