WHEREAS The Housing and Redevelopment Authority of the City
of Saint Pau� ha.s informed the Saint Paul City Council that there
are no funds available for reha.bilitation loans under Section 312,
Title III of the Federal Housing Act of 1964 and, therefore, it is
necessary and essential that the said Housing Authority undertake
a direct reha.bilitation loan program; and
WHEREt�S� Cha.pter 395, Section 2, Laws of Minnesota for 1973,
authorizes the City of Saint Paul to issue bonds in an amount not
to exceed one million dollars per annual increment period for the
purpose of making reha.bilitation loans for urban renewal develop-
ment and code enforcement areas with the determination provisions�
as set forth in said Section 312, being vested in the Council of
the City of Saint Paul or its designee in the event there is not
first available reha.bilitation loan money under said Section 312;
and
WHEREAS, The Housing and Redevelopment Authority ha.s adopted
guidelines for the administration of the direct loan program and
has requested Council approval thereof; now, therefore� be it
RESOLVED, Tha.t the Council of the City of Saint Paul, based
upon the informa.tion presented by the Housing and Redevelopment
Authority, does hereby find and determine tha.t there is not first
available reha.bilitation loan money under Section 312, Title III,
of the Federal Housing Act of 1964; and be it
FURTHER RESOLVED, Tha.t the Council of the City of Saint Paul
does hereby concur in the recommendations made by the Board of
the �ousing and Redevelopment Authority of the City of Saint Paul
as they pertain to a direct rehabilitation loan program to be
administered by the Housing and Redevelopment Authority; and be it

FURTHER RESOLVED, That this Council does hereby adopt the
guidelines and the determina.tion provisions for administration
of the direct rehabilitation loan progra.m as recommended by the
Board of the Housing and Redevelopment Authority, which guidelines
are attached hereto and shall be placed on file in the office of
the City Clerk; and be it
FURTHER RESOLVED� That the current annua.l increment period
for the purpose of ma.king such reha.bilitation loans is hereby
established as the period commencing July 1, 1973 and terminating
June 30, 1974, both dates inclusive; and be it
FURTHER RESOLVED= That the Council of the City of Saint Paul
does hereby express its intent to finance the direct reha.bilitation
loan program adopted and approved herein by means of issuing
general obligation bonds in an amount of one million dollars as
provided and authorized in Chapter 395, La.ws of Minnesota for 1973,
which Cha.pter 395 amends La.ws of 1963, Chapter 881; and be it
FURTHER RESOLVED, Tha.t the Council of the City of Saint Paul
hereby authorizes the issuance and sale of general obligation
bonds of said City in the par value amount of one million dollars
for the purposes contemplated by Cha.pter 395 of the La.ws of
Minnesota for 1973; and be it
FURTHER RESOLVED= That the Director of the Department of
Finar�ce and Management Services is hereby authorized and directed
to initiate preparation of the appropriate documents looking toward

Since one of HRA's most successful financial tools for rehabilitation, Section 312 loans,
s,ras phased out June 30, 1973, it is essential that we undertake a direct loan program.
Successful rehabilitation can only be accomplished by creating financing that offers
practical alternatives to conventional financing for low and moderate income families. ,

In recognition of this need, the State Legislature recently authorized the City to ;
issue up to $1 million in Urban Renewal Bonds for each of the next two years to continue
the Rehabilitation Loan Program in absence of Federal funds. .

guidelines, and procedures for origination and servicing. It is important to note that
the guidelines are parallel to those found in HUD Handbook 7375.1 (Rehabilitation Financing
RAA Programs Handbook), as required by tha State legislation, with the following minor
modif ications: '° .
1. Loans will be restricted to owner-occupants of not more than 2 dwelling units.
2. Income limits for priority processing will be raised to 135% of 221(d) (3)
(FHA low and moderate income limits).
3. Loans shall be limited to $5,000 on property being purchased on a contract •
for deed.
4. A mortgage will be required as collateral on all loans. � .
5. Refinancing of existing mortgages will be further restricted.
� 6. The interest rate will be 3% plus an additional amount up to 1� to cover
loan servicing charges and origination cests.
The staff recammends Board adoption of these guidelines foz administration of a direce
loan program. If adopted by the Board, City Council approval will then be requested.

ELIGIBII�ITY REQUIRE?�iENTS

A rehabil.itation loan from the existing Urban Renewal Rorid Fund may be made �
only with respect to a *residential property located within: (a) an NDP or urban '
renewAl project approved by HUD for execution, or (b) a Section 117 code enfor�ement '
projec� appro�ed by. HUTl. Tne property must need rehabilitation to meet the Mini-
mum Housing Code and must contain no more than two D.U. (D.U. as defined in the
Minimum H�ousing Code of the City of St. Paul.) ,

RL UIREiiF.NTS APPLICATiL� TO EVERY LOAN. In order to. be eligible for a rehabili-
tation loan, the appiicant must: !

not be approved if the applicant's record shows a disregard tor former obli- I
'. gations, or if there� is a clear inability to make the payments that will be ',

In order f.c�r a purchaser und�r a land saler� contract to be eligible 'for a rehabili-
[ation grant and/or l.oan to cover .rehai�i.litation cost�, a11 of the following mini- .
mum requirements must be met.
(1) The contract shall be a written, legally binding instrument involving
a residential property containing, after re.labilitation, not more than
two dwelling units.
(2) Under the contract, the seller and any subsequent holder of the fee
. to the property must be obligated, without qualification, to deliver
to the purch�,ser fee simple title and a deed to the property u�on
full payment of the contract price, or some lesser amount.

• � (a) Full use, possession and quiet enjoyment of the property;
� (b} Equitable title to the property. �
(4) The purchaser shall have had possession and use of the property

� application for a rehabilitation grant and/or loan.
* Loan Limitations on Property under Land Sales Contract: The loan must be ,
for less than $5,000. . .
ASSURANCE THAT REHABILITATION t•7ILL BF C�i�SPLETED. In some instances the -
rehabilitation cost may exceed tne amount oi a rehabilitation grant andfor
rehabilitation loan. In such cases a rehabilitation grant and�or rehabili-
' tation loan will not be made unless the applicant can provide whatever
additional amount is needed to assure completion of the work. *Any building
which has been' brought into code compliance through relocation, F.H.A. or V.A.
-sales guarantee or use of the 312 or 115 program is not eligible for considera-
tion of this program for a period of at least five years.
GRANTS AND LOP:NS ON RESIDL'NTIAL PROPERTY. _ If the applicant_ for an RAA rehabili-
. tation grant and/or rehabilitation loan on residential property is obtaining a
supplementat conventional la�n, the ap�licant must sho�� evidence in c�rritir.�-

COSTS INCLUDABLE IN A REHABILITATION LOAN
After rehabilitation, the proper�� must conform to the minimum Housing Code.
The loan may also include amounts for purposes other than meeting code as �et
forth in this section. �

a. Objectives of the Urban Renewal Plan.
b. Good and readily maintainable condition.
c. Kitchen equipment. (Modernization including stove and refrigerator).
d. Acquisition of land. (To bring the pro�erty into conformity with PRS).
e. Conversions: Only if necessary to meet Code or Zoning Code, or to
eliminate a nonconforming usE or if trere is an insufficient
� market for the property in its present form, and conversion wiZl
make rehabilitation and maintenance economically feasible. For
example, a large single-family house which is obsolete and toa �
� expensive to rehabilitate, naintain and heat in its present form
may be converted into several dwelling units with rehabilitation
loan funds. ,

a. New construction, substantial reconstruction, expansicn of the size
of a structure, or the finishing of unfinished spaces such as an .
attic or basement.
b. Materials, fixtures, equipment or landscaping of a type or quality �
which exceeds that customarily used in the locality for properties
of the same general type as the property to be rehabilitated.

� The maximum amount for a rehabilitation loan is the least of the amounts

Reha.bilitation Loans - Direct Program

Enclosed please find resolution of the City Council
approving the Housing and Redevelopment Authority' s
Direct Reha.bilitation Loan Progra.m� which adopts City-
approved determina.tion provisions to be followed by
the Housing Authority in the administration of this
program� and authorizes the issuance of one million
dollars general obligation bonds of the City of Saint
Paul for the purpose of funding the first incremental
year of the Reha.b Program which incremental year is
fixed by the resolution as commencing July 1, 1973 and
termina.ting June 30, 1974. Attached to the resolution
is a copy of the guidelines and determination provisions
recommended to the City Council by the Board of the
Housing and Redevelopment Authority.
The Housing Authority should appear at the Council
meeting and explain the Reha.bilitation Loan Program to
the Council, and I suggest tha.t you contact Mr. Helfeld
for the purpose of arranging for this presentation on
beha.lf of the Housing Authority.
