is hereby further amended so as to rezone the following des-

to-wit:
Lots 19 and 20, Block 7, Nininger
and Donnelly's Addition;
situate on property located on the southwest corner of Selby
and Grotto in the City of Saint Paul.
Section 2. This ordinance shall take effect and be in force
thirty (30) days from and after its passage, approval and
publication.

Dear Sir:
This is written in response to the petition of the Housing and Redevelopment
Authority to rezone from "B" Residence and Cammercial to Light Industrial
property located on the southwest corner of Selby and Grotto, and further
described as follows:
Lots 1-7, 19 and 20, Block 7, Nininger and Donnelly's Addition.
This matter was first heard by the Zoning Board at its May 17, 1973, public
hearing at which time the staff noted that the proposed use seemed to be
compatible with comanercial uses and questioned whether a rezoning was
necessary or if the proposed use could be allowed in the existing co�nercial
district. Same Board members expressed a reluctance to rezone this property
to Light Industrial if it was not necessary and the Board acted to lay over
the matter to get an administrative decision about whether a Light Industrial
zone is necessary.
This matter was heard again at the June 7, 1973, Zoning Board meeting at
which time a letter from Mr. Erickson (enclosed), which stated that the
proposed bindery use is an allowable use in a co�nercial zone, was read and
discussed.
The petitioner's attorney presented to the members a written statement (enclosed)
concerning the proposal. The statement noted the social value of the proposed �
use and outlined its physical characteristics. It referred to the Zoning Code
section on commercial districts arguing that the proposed bindery use is
similar to those allowed by that section. It disclosed that Control Data also
proposes a sub-assembly operation. Noting the section paragraph placing a
25% floor area limit on manufacturing, ti�e statement requested a variance from
that provision to allow a 100% floor area usage. It also requested a rezoning
of the residential portion of the site to a cotmnercial district.
Mr. Erickson said his letter detennining the proposed use to be allowed in
a co�nercial district referred to a bindery operation, but he said it should
also be considered as referring to the more recently proposed sub-assembly
operation with a variance from the manufacturing floor space limitation.

After further discussion, the Board heard a motion to recoIIrtnend the rezoning
of the residential portion to commercial be approved and to adopt as its
findings and action the following taken from the petitioner's statement.
On the subject site Control Data Corporation proposes to construct a
$300,000 facility where more challenging job skill training could be
provided through electronic component fabrication and assembly. With the
exception of a truck loading and unloading dock and automobile parking,
these activities would be wholly contained within the four corners of the
building. The building itself would be one story with an attractive exterior
appearance.
At the May 24, 1973 Board of Zoning meeting, the question was raised as to
whether these described uses were not in fact permitted uses under the existing
Commercial District classification. The matter was laid over until the Board
meeting of June 7 in order to receive the opinion of Glen Erickson, Assistant
City Architect. Mr. Erickson gave his written opinion that the uses were
proper within a Conanercial District.
Section 60.05 of the Legislative Code by definition recognizes that uses are
permitted in a Cammercial District that go beyond retail vending or service.
The Section states in part "no building shall be erected which is arranged,
intended or designed to be used for any trade, industry or use that is noxious
or offensive by reason of the emission of odor, dust, smoke, gas or noise
or by reason of excess fire hazard or for any of the following specified
trades, industries or uses." There follows a listing of manufacturing or
industrial uses, such as boiler making, carbonic gas manufacture, foundry
products manufacture, deemed to be noxious or offensive and thereby excluded
from a Coffiaercial District.
The processes proposed by Control Data are clean and inoffensive by any
standard of judgment and thus are allowable uses in a Commercial District.
The electronics industry in this transistor age could not have been previsioned
by the legislators who enacted the zoning code in 1922. The uses under
consideration could be considered for "B 3" use under the proposed new
comprehensive zoning code. If the uses proposed by Control Data are considered
to be a kind of manufacture falling into the area limitation of 60.05(d), then
by the powers vested in the Zoning Board and City Council under Section 64.03
of the Legislative Code, in particular subdivision i, the Board recommends
to the Council the variance of the provision of 60.05(d) to permit the
Control Data operation as being "in harmony with the general purpose and
intent" of the code "where there are practical difficulties or peculiar
hardships in the way of carrying out the strict letter of the" code to the end
that the "general welfare may be secured and substantial justice done".
The Social, economic and public interest strongly suggest that the Council
exercise its authority to vary Section 60.05(d) to permit 100% usage by
Control Data of the subject property. The petitioner consents to alter its
petition from light industrial rezoning to a request for extension of the
commercial district now in effect in Lots 1-7 to Lots 19 and 20, all in Block 7,
Nininger and Donnelly's Addition, and the Board recommends approval of the
petition so amended. The motion was seconded and carried by a vote of 4 to 0.

A. SUFFICIENCY: In a letter dated April 11, 1973, the Department of Finance
declared the petition sufficient with the owners of 18 or 66-2/3% of the 27
eligible parcels having signed the petition.
B. HISTORY: There is no zoning history for this site.
C. PROPOSED USE: The petition does not declare a proposed use. Sponsors of
the petition indicate that Control Data, Inc, intends to develop the site
with a bindery to bind publications which they publish for company use.
D. FRONTAGE AND AREA: The site has a frontage of 398.33 ft. along Grotto St.
and 287.00 ft, along Selby Ave. for an area of 57,238.52 sq. ft.
E. AREA ZONING: Selby Avenue frontage is zoned commercial. South of Selby Ave. ,
the area west of Grotto is zoned "B" Residential and east of Grotto, "C"
Residential.
F. COMPREHENSIVE PLAN: The Comprehensive Plan called for Selby Avenue to be a
neighborhood street surrounded by high density residential uses. Commercial
uses on Selby were to be limited to Dale Street, an arterial and to Victoria,
a collector street.
G. SITE CONDITIONS: The site has a cotrunercial building, two homes and a vacant
lot on its Selby Ave, frontage, one home on its Grotto St, frontage, and an
abandoned four-plex and a vacant lot on its Hague Ave. frontage.

Southwest corner of Selby
Petition of the Housing and Redevelopment Authority to rezone from
"B" Residence and Commercial to Light Industry property located at
the southwest corner of Selby and Grotto, described as :
Lots 1 - 7, 19 and 20 , Block 7,
Nininger and Donnelly' s Add'n.
The purpose of the rezoning petition was to allow construction by
Control Data Corporation of a 15 , 000 square foot facility in which
would be operated a book bindery and fabrication and assembly of
relatively small electronic components of high intrinsic value and
related usages.
Control Data now operates a bindery at 1001 Selby Avenue in rented
space employing previously unskilled persons on public assistance and
students with educational difficulties tnereby provid�_ng employment ,
opportt�nity with preference to minority persons and skill training. '

On the subject site Control Data Corporation proposes to construct a
:�Z0�, 000 facility where more challenging job ski]_1 training could be
provided th rough electronic component fabrication and assembly. With
the ex�:eption of a truck loading and unloading dock and automobile

�arking, these activities would ae wholly conta3ned within the four '
cor:Ze.rs of the buildin3. The building itself woul� be one story
with an attractive exterior appearance. �
At the May 24, 1973 Board of Zoning meeting, the question was raised
as to whether these described uses were not in fact permitted uses
under the existing Commercial District classification. The matter
was laid over until the Board meeting of June 7 in order to receive
the opinion of Glen Erickson, Assistant City Architect. Mr. Erickson
gave his written opinion that the uses were proper within a Commercial
District.

Section �60. 05 of the Legislative Code by definition recognizes that

erected which is arranged, intended or designed to be used for any
trade, industry or use that is noxious or offensive by reason of the
emission of odor, dust, smoke , gas or noise or by reason of excess
fire hazard or for any of the following specified trades, industries
or uses. " There follows a listing of manufacturing or industrial
uses, such as boiler making, carbonic gas manufacture , foundry
products manufacture, deemed to be noxious or offensive and thereby
excluded from a Commercial District.
The processes proposed by Control Data are clean and inoffensive by
any standard of judqment and thus are allowable uses in a Commercial
District. The electronics industry in this transistor age could not
have been previsioned by the legislators who enacted the zoning code
in 1922. The uses under consideration could be considered for "B 3"
use under the proposed new comprehensive zoning code. If the uses
proposed by Control Data are considered to be a kind of manufacture
falling into the area limitation of 60. 05 (d) , then by the powers
��es����? in the Zor�inq Board and City Counci� under Section 64. 03 of
the Legislative Code, in particular subdivision i , the Board may
recc�nn�en� to the CQUr.cil the variance of the provision of 60. 05 (d)
tc� p��i.t the Control Data operation as being "in harmony with the
gen�r4-�1 purpose and intent" of the code "��here there are practical
di�ficu?ties or peculiar hardships in the way of carrying out the
str:ict �etter of the" code to th� end that the "general welfare may
l�e s�cured and substantial justice done" .
The social, economic and public interest strongly suggest that the
Board exercise its authority to vary 60. 05 (d) to permit 100$ usage
by Control Data of the subject property. Should the Board make
these determinations and recommendation, the petitioner consents to
alter its petition from liglit industrial rezoning to a request for
extension of commercial use now in effect in Lots 1-7 to Lots 19 and
20, all in Block 7, Nininger and Donnelly' s Addition.
