nuisance charge affecting the property at 1115 Marion Street. Origiaally
you requested this report f'�am the Departm�nt of Public Works, but they
referred it to the Depaxtment of Finance and Ms,nagement Services since their
cost was recovered from a fluid set up for removal of public nuisa.nces by the
Public Safety Depaxtment, acnr Coffinunity Services.

The Department of Fins,nce and 1►�nage�uent Services has revie�vred this matter
and recomQnend.s the City Council approve the attached resolution, authorizing
the Director of Taxation to cancel the $305.70 public nuisance ch,axge fraom
the 1973 tax roll for the property legally described as I,ot 7, Block 14,
Auerbach and Hands Addition to the City of St. Paul.
The public nuisance assessment charge oP $305.70, which was levied againat the
sub�ect property and which necessitated this report, is in no way connected
with the flanction of the Department of Finance arul Manage�ment Services. How'-
ever, this matter wa.s referred to us by the Depa,rtment of Public Works For
investigation since it was a cost levied by the City of St. Paul.
In general, when the Bureau of Health receives cosrplaints from the public on
uuisances in the comQnunity, they investigate a�l aotiPy the record awner he
has 24 hours to remove such nuisance. If the awner fails to take action, the
Public Works Maintenance Division is directed., by Council Resolutioa, to do
the work and forwaxd the cost to the County Auditor for collection in the same
manner as taxes.
In this particular case, the Bureau of Health through Frank Staffenson, Di.rector
of Housing Code er�orcement, investigated numerous public camplaints froma 1968
to and including April 1q73, but more particulaxly his depaxtment sent aotice
to record o�raer, Maxy Lundberg, in 1971 advising her to remove debris inside
building. She was deceased at that time and the notice was returned. Also at
that time, the Ramsey County WelPare Department iras taking action to enforce an
old age assistance lien against the property. Mr. Staffenson said he informed Mr.
Mo�re of the Welfare Depaxtment verbally in May 1970 of rrumerous complaints,
however, no official notice was sent to the Welfare regaxding the abatement of
the rniisance because the Ramsey County Welfare Department did not file the
documents confirming their oymership of the property until March 1973•
Since no action was taken to abate the public nuisance, the Comm�issioner of Public
Works was directed to do the work and assess the cost in the same m�nner as taxes,
all pursuant to Council Resolution, C. F. 256213, approved November 3, 1971.

The req,uest for this action at this tim� is being made by the Ramsey Coun�y
Welfare Board, awner of the property. Their reasons for saaae are noted in the
attached memorandum to the Ramsey County Welfare Boaacd frama Robert Moore, Ramsey
County Welfare Department employee, dated. April 2, 1973.
We concur with the WelPare Board in their request, tha.t this charge be ca.nce]1ed
so the property may be sold and put back on the tax rolls as productive rev�nue
producing property as well as being improved to the extent it will no longer
be a public nuisance and detriment to the character of the neighborhood.
In this regard, we will also save the City o� St. Pa.ul the additional cost of
razing the buildings, which action is presently contemplated. by the City Attorney
pending the autcome of this matter and subseqnent improvement of the dwelling.
We therefore ask the I�yor to approve said resolution for submission to the City
Covncil.
