WHEREAS, The easements described therein are necessaxy for the Maryland-
Ga.ltier Sewer, Project No. 5-998, and the price at which the easements may be
purchased is at the total amount of $450.00, a fair and reasonable price accord-
ing to the appraisal obtained by the Assistant City Valuation Engineer; and
WI-�EREAS, The Assistant City Valuation Engineer has recommended the purchase
of said easements at the price stated above� as evidenced by his report submitted
herew�ith; now, therefore, be it
RESOLVID, That pursuant to Administrative Order No. D-38o, dated January �
17, 1973, the Council of the City of Saint Pau1 does hereby authorize the purchase
of the above described easements, and be it
FURTHER RESOLVED, That the proper City officials are hereby authorized and
directed to pay to Burlington Northern, Inc. , record fee owner� the sum of $�+50.00,
said sum to be paid to the aforesaid vendor from PIR Fund Cod.e 60000-7�+5-000 (L761,8),
to be reimbursed from ogo50-�65-000, upon its furnishing evidence of good marketable
title in the aforesaid vendor, and the total payment to be made upon tender by said
party of appropriate deeds conveying title to said easements �o the City of Saint
Pau1.

Ladies and Gentlemen:
Z`he Mayor of the City of Saint Paul by Administrative Order No. D-38o, dated
January 17, 1973, authorized and directed the acquisition of certain ease-
ments necessary for the P4a.ryland-Galtier Sewer, Project No. 5-998.
Pursuant to such authorization and direction, I, in �qy capacity of Assistant
Valuation Engineer, have secured an agreement with Burlington Northern, Inc. ,
owner of the land involved, for the purchase of easements for sewer purposes
on their land for compensation in the amount of $�+50.00. Therefore, it is
recommended to the Council that it authorize the purchase of these easements
in lieu of condemnation at the price of �450.00 as negotiated with the owner.
The easements herein reco�unended to be acquired are more particularly described
in the resolution submitted herewith for your consideration and action.

WHEREAS, Ordinance No. 14946, approved November 5, 1971 , grants permission to
the Port Authority of the City of Saint Paul to construct, operate and maintain
mooring anchors on property owned by the City of Saint Paul abutting the Mississippi
River and authorizes the Director of the Department of Public Works to issue permits
for said construction, operation and maintenance by resolution of the Council ; and
WHEREAS, The Port Authority has requested specific permission and authority to
construct, operate and maintain six (6) individual mooring anchors at mile 837.7 in
the Mississippi River according to and as shown on the plans prepared by the Port
Authority dated February 4, 1973 as revised June 4, 1973, which pians are on file in
the Department of Public Works under Project No. E-1160; Now, therefore be it
RESOLVED, That the Director of the Department of Public Works is hereby author-
ized and instructed to issue permits to the Port Authority of the City of Saint Paul
for the construction, operation and maintenance of said mooring anchors subject to
the provisions of Ordinance No. 14946, as amended, and the following terms and
conditions:
l . That said permittee shall pay the costs of administration, engineering
and inspection incurred by the Department of Public Works by reason of
an� undertaking incurred herein, said costs to be accounted for under
Public Works Project No. E-1160.
2. That the permittee shall submit insurance and bonds documents to the
Office Engineering Division of the Department of Public Works prior to
issuance of any permit.
3. That said permittee shall , prior to the inception of any work permitted
herein, obtain the approval of all authorities or agencies having juris-
diction over the construction or use of said mooring anchors and shall
comply with all applicable laws and regulations concerning the construc-
tion, operation or maintenance herein permitted.

Attached for your consideration and approval for submission to the
City Council is a proposed resolution authorizing issuance of a
permit to the Port Authority for construction of additional barge
mooring anchors near Holman Field and the seaplace basin on the
southerly bank of the Mississippi River. It is our understanding
that the Port Authority plans to lease this mooring site to
Capitol Barge Service, Inc. , who plan to begin construction just
as soon as possible. We would, therefore, appreciate your expedi-
tious review and approval .

taken to change my position from Acting Director to Director.
