WHEREAS, Pursuant to resolution, C. F. No. 261366, approved May 31, 1973, a public hearing was duly held on June 14, 1973, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structures located at 798 Dayton Avenue, Saint Paul, Minnesota; and WHEREAS, Upon the facts presented at the said hearing consisting of photographs, inspection reports and the recommendations of the Building Department, it is found and determined by the City Council that according to the records and files in the office of the Register of Deeds, the last record owner of the above-described property is William Carpenter; and that there are no other lien holders of record; and that it is further determined that the above-described building and garage constitute hazardous buildings within the definition of Minnesota Statutes Section 463.15 for the following reasons : a. The building and garage are standing vacant, abandoned and are subject to being entered by un- authorized persons; _ - . The exterior condition of the building is as follows : the mortar on the foundation of this dwelling is eroded. The front porch framing and trim are rotted and the rear porch is dilapidated and deteriorated, Roof shingles are missing and rotted; c. The interior condition of the building is as follows : the floors of both the first and second story are sloping. Some flooring is humped. Plaster is missing from the ceiling. A second £loor fireplace has been vandalized. Window glass has been broken. The plumbing and electrical systems have been vandalized and fixtures removed; d. The building in the above condition is beyond reasonable repair; e. The building is unfit for human habitation in its present condition and the above corrections must be made in compliance with the Building Code and the Housing Code of the City of Saint Paul in order to make the same habitable; f. The building constitutes a nuisance and a hazard to the public health, safety and welfare because of its physical damage, dilapidation and inadequate maintenance; g. There is a garage on the property on which the windows are smashed, the siding is rotten as well as the bottom plate; the south wall is bowed; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463. 15 through 463. 26 , and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: WMITE - CITY CLERK � COUC1C11 �O�C PINK - FINANCE BL'lJe�v MEYORTMENT GITY OF SAINT PALIL File NO. The owners of the above described building and garage shall make the same safe and not detrimental to the public peace, health, safety and welfare by having the said building and garage razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. Unless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the Office of the Clerk of the District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the service of this Order, a Motion for Summary Enforcement of this Order to raze and remove the said building and garage will be made to the Ramsey County District Court; 3. The owner of record is William Carpenter. � The legal description of the property is Lot 5 , Block 5 , Nininger and Donnelly' s Addition. The buildings are a three-story frame duplex and a two-car frame garage. The mortar on the foundation of this dwelling is eroded. The front porch framing and trim are rotted and the rear porch is dilapidated and deteriorated. Roof shingles are missing and some are loose and about to fall off. The water table trim is rotted. The floors of both the first and second story are sloping. Some flooring is humped. Plaster is missing from the ceiling. A second floor fireplace has been vandalized. Window glass has been broken. The plumbing and dectrical systems have been vandal- ized and fixtures removed. This building is a fire hazard due to it' s proximity to the neighboring dwelling. The garage siding is rotten as well as the bottom plate. The south wall is bowed. The subject property has been boarded up by the City since April 28, 1972.
