" The Council of the City of Saint Paul has conducted a public hearing upon the above nnprovement, due notice
thereof having been given as prescribed by the City Charter; and
WHEREAS, The Council has heard all persons, objections and recommendations pertaining to said proposed improve-
ment and has fully considered the same; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does hereby order that the above-described improvement
be made, and the proper City officers are hereby directed and authorized to proceed with the improvement; and be it
FURTHER RESOLVED, That upon the completion-of said improvement, the proper City officers shall calculate
all expenses incurred therein and shall report the same to the City Council in accordance with Chapter 14 of the City Charter.

It is hereby requested that the Department of Finance and Manac�ement Service
act as directeci in the subject /�dministrative Order and schedule a public
hearing in tt�e natter of repairing these private connections.
EXISTIPdG CONDITIO�JS
The affected properties are on the south side of Portland P,venue between
'.!ilder Street and Cleveland AvenUe. This portion of Portland Avenue has
a S" concrete base course and a 2" asphalt wearing course, and the invert
of the combined sanitary and storm sewer is approximately lg' deep. Due
to the de�th of the sewer and the concrete base in the street , the estimated
cost to repair the connections is approximately $1400.Q0 per connection.
The 7epartnent of Publ ic ldorks last winter noticed pollution shotNinc; up at
Shadova Falls Park. The invert of the combined sewer in Portland Avenue from
i�loore Street and Cretin Avenue had deteriorated, and it was suspected tt�at
exfiltration of sanitary flow through tt�e invert was contributing to the
pollution at Shadow Falls. Therefore, at a cost of approximately S1t,OQ0
t��e iepartment of Publ i c 'Glorks poured a new Fa" th i cl; concrete i nvert i n th i s
length of seti��er in order to stop the exfiltration. tlowever, the sanitary flow
of the four brob:en connections is running outside of the sewer and is still
polluting Shaciow Falls.

The sanitary flow from those connections is �•�ashing away all the fine
material uncler the street surface, thus undermining the sewer and creating
large voids under the surface of the street, and it will be only a matter
of time before the street and se���er collapse totally. �,
RECOt1P1EIdD�T10'JS
Because of the inevitahle collapse of the street and sewer, and the pollution
appearing at Shadow Falls , the Department of Public �Jorks feels the situation
is approaching emergency proportions and, therefore, recommends that action
be taken as soon as possible to rer�edy the problem.
� Section 23�.22 �f the St. Paul Legislative Code requires that defective drains
be repaired at the property owners expense upon direction of the Director of
Public 41orl:s. In case of refusal to repair the defective drain, the Qirector
of Public !lorks shall cause repairs to be made at the expense of the owner.
liowever, in view of the large financial burden to the affected property owners
in this instance, it is the recommendation of the Department of Public Works
that a public hearing woulcl then be held to assess the property owners for
the full casts incurred by the Department of Public l�lorl:s , and thereby
allo�ring the property owners to spread their expenses over a period of
several years.
