I. -/ � � rdin�nce a: Ordinance N 0. : �� ) Presented By � Referred To Committee: Date , � Out of Committee By t-�' � Date An administrative ordinance approving the terms and conditions of a coilective bargaining agreement � between the City of Saint Paul and I�ternata.onal Union of Operating Engineers, Locals 36 and 967 WHEREAS, the Council pursuant to the provisions of Section 12. 09 of the Saint Paul City Charter and the Public Employment Labor Relations Act of 1971 recognizes International Union of Operating Engineers Locals 36 and 967 as the exclusive repre- sentatives for those classes of positions within the City of Saint Paul certified by the Bureau of Mediation Services in Case No. 73-PR-449-A for the purpose of ineeting and negotiating the terms and conditions of employment for all full-time personnel in said classes of positions as set �orth in an Agreement between the City and the exclusive representatives hereinabove referenced; and WHEREAS, the City through designated representatives and the exclusive representatives have met in good faith and negotiated the terms and conditions of employment for the calendar year of 1973 for such personnel as are set forth in an "Agreement" between the City and the exclusive representatives, now, therefore THE COUNCIL OF THE CITY OF SATNT PAUL DOES ORDAIN: Section 1. Section 2. That the hourly wage rate for the classes of positions set forth in Articles 1, 3 and 6 af said Agreement shall take foxce and effect in the manner and on the dates specified in said Agreement, Section 3. That all other terms and conditions of said Agreement shall take �orce and effect on the date of its execution by the City and the exclusive representatives . Section 4. That any other ordinance, rule ox regulation in £orce when said Agreement takes effect i.nconsistent with any provision of the terms and conditions of said Agreement is hereby repealed. Section 5 . Locals 36 and 967 as the exclusive representative of those classes of positions within the City of Saint Paul certified by the Bureau of Mediation Services in Case No. 73-PR-449-A, have met and negotiated in good taith in accordance with the Public Employment Labor Relations Act of 1971 and the requirements of Minnesota Statutes 179. 61, S�abd. 2; and _ WHEREAS, as a result of those negotiations , the designated representative of the City and the exclusive representative of the aforementioned classes of positions have reached agreement with respect to the terms and conditions of employment for employees working in such classes for the period January 6, I973 to January 5, 1974; NOW, THEREFORE, the parties hereto agree as follows : . 1. The City will, for the period of this agreement, provide for ' employees of the bargaining unit who elect to take early retire- ment after the time of the execution of this agreement and until such employees reach sixty-five (65) years of age, such health insurance benefits as are provided by the Gity for such employees at the time of the execution of this agreement, provided such employees are drawing a PERA early retirement pension. 5. The representative of the City and the exclusive representative shall jointly recammend to the Civil Service Commission that the title for class of positions "Janitor" be changed to "Custodian". 6. Adjustments-- A. The class of positions "Lime Recovery Operator" shall be ad3usted by ordinance to the hourly wage of "0-6 months of employment" - $5. 61 and "after 6 months of employment" - $5. 86 to be effective the first full payroll period following the effective date of the ordinance. B. The class of positions "Pumping Engineer III" shall be adjusted by ordinance to the hourly wage of ''0-6 months o� employment'? - $6 . 51 and "after 6 months of employment't - $6. 76 to be effective the first full payroll period following the effective date of the ordinance. C. The repxesentative of the City and the exclusive : representative have agreed� and jointly recommend that the Civil Service Commission approve that the class of positions "Instrument Re�aixman" be assigned from the Graded Division to the Ungraded Division at the hourly wage xate o� "0-b months o� emplayment" - $5 , 61 and -S- , :,:. f.� '^ � . . . .. . . . . � � . "after 6 months of employment" - $5 . 86. , . 7 . Night Shift Premzum-- A. Employees who are assigned to and work a shift which begins before 6: 00 a,m, or ends after 6: 00 p.m. and more than five (S) hours of the shift are warked between the hours of 6: 00 p.m. and 6. 00 a.m. shall be paid a night shift premium for the entire shift. B. Employees who are assigned to and work a shift whi�h begins before 6: 00 a.m. or ends after 6: 00 p.m. and less than five (5) hours of the shift are worked between the houxs of 6: 00 p.m. and 6 : 00 a,m, shall be paid a night shift premium for the hours worked between 6:00 p.m. and 6: 00 a.m. C. The night shi�t premium s'hall be So of an employee�s basic hourly wage rate. D, Additional compensation paid to employees assigned to the Public Sa£ety Building for "working hours not normally worked by other employees" shall be eliminated. 8.
